As with many metropolitan areas, Austin Texas sits as an example of what happens when Marxism is allowed to spread like cancer.
In a recent trial, a Texas man named Daniel Perry was convicted of murder for shooting and killing a Black Lives Matter protester who was pointing a loaded AK-47 rifle at him. While the local police determined Mr. Perry acted in self-defense, another rogue Soros-backed District Attorney disregarded the evidence, hid exculpatory evidence in the case, and took Mr. Perry to trial.
With manipulated and selective evidence presented to the jury, Sgt Daniel Perry was found guilty on Friday. Today, with mounting pressure from an outraged public, Texas Governor Greg Abbott intervenes and says he will pardon Sgt Perry as quickly as possible through the Board of Pardons and Paroles. Let’s be clear though, justice has not been served; an injustice has been halted.
(Via Fox News) – Texas Governor Greg Abbott said Saturday he intends to seek a pardon for an Army Sergeant recently convicted of murder for shooting a Black Lives Matter protester during an anti-police demonstration in 2020.
“I am working as swiftly as Texas law allows regarding the pardon of Sgt. Perry,” the Texas Republican tweeted Saturday along with a statement on how his office will go about a pardon.
Abbott said in his tweet that pardons in Texas must be recommended by the Board of Pardons and Paroles. “I have made that request and instructed the board to expedite its review,” Abbott said.
[…] Perry, who was stationed at Fort Hood at the time of the shooting, was driving for Uber to make extra money in downtown Austin on the night of July 25, 2020, when he encountered a large crowd of protesters. They were illegally blocking city streets that night, according to police, as protesters in Austin and elsewhere had done during the weeks of rioting.
Among the protesters was 28-year-old Garrett Foster, who was carrying an AK-47. Perry’s defense team says that the demonstrators encircled and starting pounding on his vehicle and that Foster raised the firearm at Perry, prompting him to open fire with a handgun he legally carried for self-defense.
“When Garrett Foster pointed his AK-47 at Daniel Perry, Daniel had two tenths of a second to defend himself. He chose to live,” Doug O’Connell, an attorney for Perry, told Fox News Digital in a statement last year.
“It may be legal in Texas to carry an assault rifle in downtown Austin. It doesn’t make it a good idea. If you point a firearm at someone, you’re responsible for everything that happens next.”
Abbott explained that Texas has one of the “strongest stand your ground” laws in the country that “cannot be “nullified by a jury or a progressive District Attorney.” (read more)

Texan here. To be perfectly honest, Austin/Travis County has always been very liberal. Migration from liberal places has made it worse, but as a college town, it has never been considered conservative. We lived there for several years but hated how liberal and very “adult” it was. Not much to do with kids unless it was parks, which they do have beautiful ones. It was never a great family town. It was hard to find a really good church in the city limits. We were thrilled to move on from there.
This is why, when we left a blue state for Texas we not only moved rural, we looked up the % of 2016 Trump voters vs. Hillary in our targeted counties. We’re loving it here and liberal globalists find it offensive with all of it’s Trump signs, guns, pickup trucks that do actual work and plenty of exhaust coming out of the backsides of cattle. Take that AOC!
The people we have moving here to flee their blue area nightmares are good solid conservatives and we are happy to have them.
Once in a while a crackpot liberal makes the mistake of moving in and we shun them furiously.
No invites to our cookouts, we discourage our kids to make friends with them etc.
They many not always move but they are unhappy and do not recommend our area to their liberal friends.

Exactly what has happened to Colorado since 2013 with all mail ballots and Dominion.
When I left Silicon Valley because of the liberalization and moved to CO, except for Boulder, it was very conservative. Now not so. Now I live in FL, because it’s maybe the last place one con find a conservative. And it’s changing.
It just happened in Wisconsin. The lefty judge Janet wants to “fix” the gerrymandering. There will never be a chance for conservatives again. It will be an expansion of Illinois. All because the GOP members refuse to impeach her even after promising (hah) to do so.
The judge should have thrown the case out since he should be well versed in Texas self-defense laws. Both the DA and the judge should be held accountable for an unjust prosecution and trial.
Judges get away with this stuff because they are not held to account. Not in Red states, not in Blue states.

In Texas, we believe in local government. So, the judge is elected by the People. Sometimes, we get the bad choice when the people in the county are crazy. Then there are times the whole state is crazy. Like when we elected Don Yarborough (a crooked Democrat lawyer who ran for State Supreme Court (Civil) by confusing the voters with Ralph Yarborough (a decent old school Democrat years ago). The head of the Democratic Party was going around telling voters not to vote for Democrat nominee. He won, but was indicted for various frauds. He fled to Grenada, but was turned over to the Texas AG, who with a Texas Ranger, borrowed a private jet and went to pick up our wayward son ……
State district judges in Austin are liberal democrats. In fact, the Appellate court for the Austin District if now majority democrat. However, the Texas Court of Criminal Appeals (Supreme Court for criminal cases) is all Republicans. No way the trial judge would rein in the DA. Getting the case to the TCCA takes too long and it’s time to slap these criminals in the jaw.

A governor who waited to take action until a justified public outcry is a weak governor.

Procedurally, the governor has rules to follow; he can, of course, announce his intentions at any time. That’s a choice.
The problem with announcing intentions prior to the verdict is that politicians and talking heads run their mouths off without any facts only to have it blow up in their face. In this case, Abbott acted wisely and waited until the verdict was given. He didn’t run his mouth only to find out that the “facts” he had didn’t match the facts presented in the trial.
Remember what happened to Kyle Rittenhouse? He was declared guilty without any facts by every left wing nut job from politicians to talking heads even after the trial happened and he was acquitted.
I don’t know about you, but I prefer it when a politician exercises a bit of restraint here and use common sense.

The defendant under 18 US Code §242 Deprivation of Rights under Color of Law. Brady violations are a slam dunk against any government official that violates it. I wouldn’t be too surprised to see this DA and his office get investigated by the Texas BAR and AG for said violations. On top of that I wouldn’t be surprised that the DA’s office gets sanctioned and pretty much every case he’s been party to as DA is reviewed by the courts. It appears that a whole lot of people that are in prison because of him may be getting out due to the Brady violations.

I lived in Austin for 20 years, from my junior year of high school. Went to college there, got married there, my kids were born there. Finally fled the state 11 years ago. Austin was always liberal, but has now gone full-on batsh*t crazy! We visit friends there on occasion. There are panhandlers on every street corner, homeless encampments under the overpasses, and it’s getting more dangerous by the day. It’s especially dangerous to be openly conservative. I wouldn’t live there again even if you paid me.

If the article is read…the robber left the area. At that point the clerks life was no longer in danger. Instead the clerk retrieved his gun and chased the robber firing the first shot. Robber turned and fearing for his life returned fire killing the clerk. Robber was exercising lawful self defense.
The clerk should conceal carry and when the opportunity presented, should draw his weapon and fired during the robbery. That would be a clean shoot.

I’m curious…
All of the information laid out here talks to the prosecutor withholding exculpatory evidence from the GRAND jury. I don’t know about Texas, but I don’t believe there is usually a requirement to show exculpatory evidence to a grand jury. That being said, I’m not sure how instructing a witness to remove exculpatory evidence plays…extremely unethical at best.
I’m more interested in whether this exculpatory evidence was withheld from the defense in the actual trial. If purposely done so, that may be a crime.
If not withheld from the defense, that opens another line of inquiry as to how one gets a guilty verdict…
Perry should be freed immediately, but I don’t know if I like the idea of a pardon. If that is what it takes to get him released immediately, then so be it, but he still would be a pardoned convicted felon. The final disposition needs to indicate that he was never convicted, and that the charges should never have been brought…and the prosecutor needs to be charged with malicious prosecution, in whatever form and venue that takes.
Public law enforcement and judicial officers have qualified immunity, however, ‘qualified’ immunity has been (purposely, imho) conflated with ‘absolute’ immunity. Not sure what criminal charges, if any, could attach, but civil action could assuredly happen…and that would be the best way to attack this…the PERSONAL pocketbook of the prosecutor.

Thank you, I’ve been trying to seek first to understand then be understood! I didn’t see anyone making a distinction between the grand jury and the criminal trial with respect to Fugitt’s affidavit. I don’t know what Texas laws says either regarding exculpatory material and grand juries, I’m not an attorney or in Texas. It does seem really unethical, and I wouldn’t want to stand before God knowing I’d denied a man a fair trial. If these DAs were interested in real justice reform, they’d give everyone the same opportunity to avoid indictment. But they pick and choose scalps politically.
I do think that the jury convicted based on his texts, which may have been used against him as pre-meditation. Jury’s are fickle things, and I don’t trust 3/4 of Americans to practice any discernment. A quarter of them are plain evil, and 1/2 are content to be propagandized. While Perry had every right to legally do business as an Uber driver in that area, and concealing a weapon for his defense, knowing what was happening I wouldn’t have driven through the area that night. As a CHL (in my state), I go out of my way to avoid trouble.
To be clear, I’m not blaming Perry for Foster’s death in a “skirt to short” type of argument. Also, as far as I know, there is only a still image of Foster approaching Perry’s vehicle with his weapon at low ready; stock shouldered and barrel lowered. There isn’t a picture of Foster pointing the weapon at Perry (to my knowledge, I didn’t review all the evidence presented at the trial, was Fugitt’s full investigation used by the defense?). That doesn’t mean Foster didn’t, or that he wasn’t half a second from being a deadly threat.
Unfortunately for Foster, he was the most obvious threat in a crowd of illegal protesters surrounding a vehicle and beating on it where Perry had the right of way. If it was dark, and I was in the same situation with someone approaching my vehicle at the ready with a gun, I’d have assumed that it was a car jacking. The fastest thing to do is accelerate the vehicle in any direction. Perhaps Perry assessed he was boxed in by the crowd. Perhaps shooting the obvious assailant made sense in that moment instead of potentially running over a handful of unarmed people with a vehicle. Under stress there isn’t always a clear choice; I hesitate to Monday morning quarterback and pray I avoid that situation. Someone unnamed returned fire at Perry 3 or 4 times, missing him. No other participants were shot! To his credit he stopped when he was safe and self reported to the police. I think at least he thought he did the right thing.
My perception is that this is a politically motivated prosecution, just like Kyle Rittenhouse. I just don’t know that the prosecution was executed badly or illegally. Life ain’t fair, and the world is mean.
Text messages from the driver totally wrecked the defense. The 28 year old Air Force veteran legally carrying the AK-47 never points the rifle at the driver. See photos and vid. If the prosecutor broke the rules then that is good for the defense on appeal. In FL we have several cases where police do not initially charge the shooter because of stand your ground laws. Later after seeing all the evidence prosecutor files charges. Almost always because video conflicts with defendant statements. Based on what I see this was a hard to defend shooting.
Does anyone know the criminal background of Garrett Foster? I strongly suspect this wasn’t his first rodeo (riot).
Make the prosecutor serve the sentence he wanted for the soldier. Preferably in some hell hole.

The entire Biden administration applauds these types of DA and all of the one sided judicial actions. From the press secretary to racist KH, who couldn’t wait to run to Nashville to support the lawless actions taken by the 3 impeached congresspeople. (2 out of 3) Now saying there were 7 victims. Notice how the WH barely mentions the 6 real victim s.? [. I . Intimidation and a one sided rule of law will continue to get worse until there are some real consequences for the guilty side. Isn’t it a crime (Brady Bill) for a DA to NOT present exculpatory evidence????? Looks like this Austin DA needs to be on trial.

So if people who live in Austin can get out of there before the bottom totally drops out of the real estate market, will the Mayor and business community demonstrate any concern for the the impact of this case? The capital of the tate, should IMHO always be just about the best and safest city in a state, not a dangerous place to visit.

If there is anything other than the obvious dangers of activist SJW prosecutors, it is this: don’t shoot your mouth off on social medai saying stupid things. This unjust prosecution would probably never have happened without the defendant’s FB posts about killing rioters. If you don’t say it, they can’t use it.
A detective involved is alleging witness tampering due to being forced to remove tw0-thirds of his presentation to the grand jury as it was entirely exculpatory.

I often feel that Gov. Abbott is not strong enough in his actions and disagree with things he hasn’t done. That said, his statements today on this abomination of justice are on target. The office of Texas Governor is weak by design – it is one of the weakest offices in the country (not a comment on the incumbent but the constitutional authority). That was done on purpose during reconstruction. His pardon powers are established in Chapter 48 of the Code of Criminal Procedure, and do require concurrence or recommendation from the Board of Pardons and Paroles. So his communication today is in line with the statutory requirement. The board are all his appointees, so he damn sure better exhibit influence to correct this travesty of justice. I expect there will be a quick response.
If the board doesn’t respond appropriately what can be done. One thing possible is to the change the statute to remove them from making a recommendation. Our legislature is in session and the Governor could lead legislation to change the statute and give him unlimited authority to pardon. The Senate would do this in a heartbeat. The House, that is another question. Our Republican speaker is a about as close to a RINO as you can get. And even with a majority, they put a ban on using state funds for school vouchers in their version of the state budget last week. 34 Rs did not vote to stop that amendment. That said, it is likely that amendment will be pulled during the negotiations between the House and Senate.
This trial and verdict may be the bridge too far. Removing a DA in Texas is not easy. The Attorney General does not have the power to do so, nor does the Governor (again, the office by design is not strong). In addition, the AG does not have the ability to be a criminal prosecutor – that is reserved for local DA’s. In the current session, there are a number of bills introduced to address these rogue, corrupt, Soros DAs.
This travesty of a prosecution is probably the bridge too far. I am seeing and hearing total disbelief at the miscarriage of justice in this case and it is getting normally quiet people really pissed. Many of us have already communicated our outrage to the Governor and AG.
Lastly, Austin is quickly on its way to being San Fransisco, Portland and Seattle. It is not surprising that a jury of Austinites would let their politics and corruption be swayed by a crook of a DA. He is a crook in my opinion – he compelled the lead investigator to remove all information that exonerated Perry from his presentation to the grand jury.
Public outrage at these courtroom travesties finally scores a victory…we think.
