With manipulated and selective evidence presented to the jury, Sgt Daniel Perry was found guilty on Friday. Today, with mounting pressure from an outraged public, Texas Governor Greg Abbott intervenes and says he will pardon Sgt Perry as quickly as possible through the Board of Pardons and Paroles. Let’s be clear though, justice has not been served; an injustice has been halted.

“I am working as swiftly as Texas law allows regarding the pardon of Sgt. Perry,” the Texas Republican tweeted Saturday along with a statement on how his office will go about a pardon.
Abbott said in his tweet that pardons in Texas must be recommended by the Board of Pardons and Paroles. “I have made that request and instructed the board to expedite its review,” Abbott said.

Among the protesters was 28-year-old Garrett Foster, who was carrying an AK-47. Perry’s defense team says that the demonstrators encircled and starting pounding on his vehicle and that Foster raised the firearm at Perry, prompting him to open fire with a handgun he legally carried for self-defense.
“When Garrett Foster pointed his AK-47 at Daniel Perry, Daniel had two tenths of a second to defend himself. He chose to live,” Doug O’Connell, an attorney for Perry, told Fox News Digital in a statement last year.
“It may be legal in Texas to carry an assault rifle in downtown Austin. It doesn’t make it a good idea. If you point a firearm at someone, you’re responsible for everything that happens next.”

Actually, if US law has any vestige of a basis in biblical law, he should be. The whole concept of “an eye for an eye” (lex talonis) is based on dealing the punishment to a false accuser that the accuser intended for the falsely accused. If exculpatory evidence was withheld from Defense, then the Prosecutor should be disbarred. I don’t know the laws in Texas; but in the Duke Lacrosse rape case the prosecutor was disbarred for withholding exculpatory evidence. It’s extremely serious for a prosecutor to do this.

Though before my time in Texas, I learned, commuting in and out of Austin daily in the early 2000s, that they had actually done everything they could to stave off the building of new highways, and all of that. It turned the commutes into a living nightmare. Driving unmolested and unimpeded, and at approximately the speed limits, I could make the run in 49 minutes, theoretically, or at 2am when nobody was about, but in practice, it was a nightmare, and I was spending 2-1/2 hours per drive in AND per drive out at least 3 days a week. At the first opportunity, I found a job a lot closer to home, and was infinitely happier. 15 minutes at best, 20 at worst, to get to work now, and home, on a good day, I can make it in 12 minutes.
There’s no doubt but that the people who’ve ideologically run Austin for the last 40 years have driven it into the ground, and made it impossible for working stiffs to live there.

Hood in the 90s, we decided to make a go of it here in Texas rather than going back up to the Midwest/Northeast where I had originated. Rather than seeking to turn Texas into that place I would not then willingly return, I set about the long chore of becoming a Texan. I wasn’t born here, but I got here as fast as I could. I consider myself a naturalized Texan.

About 7 or 8 years ago there were a few news articles about George Soros actively funding campaigns for leftwing DA’s, State AG’s, State Secretaries (who control elections) and similar positions that are all below Governor and thus get less national press attention (i.e., deliberately put under the radar). But not everyone was blind to what was happening.
I and others in CTH posted many times about that in 2017 and 2018 as it became clear that these positions were being flipped from Republican to Democrat in many traditionally red areas and thus were setting us up for what we have seen occurring. In criminal cases that used to be unquestionably clear cut as to guilt or innocence, indictments and trials have since resulted in outrageous decisions that run against traditional law & order and have upended the American concept of “equal justice.”
We can no longer stay uninvolved and enjoy life expecting those in power and authority to follow traditional, constitutional law & order. “They” have designed to divide and destroy this nation using Lawfare tactics and worse, simply reversing common sense and flipping the “equal justice” concept to benefit only the Left.

The guy had run his mouth on social media saying that protesters had better not try to stop him or they would regret it. The defense argued that it made no difference to the principle of self-defense, but the jury still got to see that “evidence.”
Just as urgent is an investigation by the Governor and AG into how the jury was created. Was a contractor used to create a pool based on the vast amount of personal information available on the web which enabled a foregone decision, regardless of who from the pool was selected?

You bring up an important point, jury selection in this country, or at least in my state, is an absolute joke. They should line the people up and count down the line for the number of jurors and reserves, “1, 2, 3, …”.
I have never been selected for a jury, although I have had jury duty many, many times. They have us fill out surveys and questionnaires and the defense and prosecution get to excuse jurists for “bias”. What a joke! The result is anything but a jury of your peers.
I’m always excused because of my military service. I seem to know how to follow rules and laws so one team always asks to have me removed. You’re right about it being a joke.

According to the election results of 2016, 2018, 2020, and 2022, there are still red counties in between San Antonio and the border counties. That individual had the right to carry his weapon, but he should not have been among the crowd that surrounded the car and he should not have raised his weapon. The individual’s life was not in danger, so this is clearly self defense.

You cannot be forbidden to withhold evidence. What the detective should have done is slipped a delivery driver 100 bucks to drop a packet off at defense lawyers office.
That affidavit says the evidence was withheld from the Grand Jury. That may not be criminal, since the Grand Jury is not in the role of determining guilt or innocence, only charges. (may not, not saying it shouldn’t be criminal)
The question I have is: was the evidence withheld from the defense for the actual case?

I do wonder if the officer who disclosed the withheld evidence attempted to inform the defense attorney. It seems this should not have gotten to the jury without this coming out. I hope all sides weren’t in on this.

A masked man motioned to Daniel as if to talk, and Daniel rolled down his window initially thinking he was law enforcement. The masked man was open carrying an AK-47, which is legal in Texas. But what happened next is not…The masked man who was carrying the assault rifle in the ready position, began to raise it. That’s when Daniel knew he had to act or risk being killed for being at the wrong place at the wrong time.
Daniel had a state license to carry a revolver, which he often did when he worked for Uber because some of the rides he picked up took him to bad destinations. With no time to hesitate, Daniel discharged his revolver and stopped the threat to his life. It was pure self-defense.

The Austin Police Department ruled it self defense. But the the Soros funded DA reared his ugly head, charged Daniel with murder and, by the way, withheld exculpatory evidence from the jury. Sensing a pattern here?
From what I have read, this Soros back DA Garza campaigned in 2020 that if elected in 2021, he would indict this Daniel Perry.
He did the same exact thing as Alvin Bragg did in order to get elected.
I’ve just read in the Gateway Pundit, from the commenters, that AG Paxton is involved in the investigation now since the Police Detective was not allowed to present his exculpatory evidence. The Detective did file an affidavit, which is posted along with the article.
So, it appears that in the course of a few days, much has been going on and I’m sure that AG Paxton has a handle on it and will proceed expeditiously.

I’m not going to tear into Gov. Abbot because it accomplishes nothing.
There is sunlight now; most are outraged (from what I have read) and we will see what happens.

“Prior to the grand jury presentation in this case, I had several conversations with the district attorney’s office regarding the presentation of exculpatory evidence related to Daniel Perry. It became clear to me that the District Attorney’s office did not want to present evidence to the grand jury that would be exculpatory to Daniel Perry and/or show the witnesses statements obtained by the family of Garrett Foster and/or their attorneys were inconsistent with prior interviews such witnesses gave the police and/or the video of the incident in question. I had also wanted to present previous statements from the Complainant in Count 2 where she never once suggested that Daniel Perry intentionally and knowingly threatened her with imminent bodily injury by driving a motor vehicle in her direction. The District Attorney’s Office also made me remove an animation from Daniel Perry’s driving the night of the incident coordinated with his cell phone records that would have refuted the deadly conduct charge ultimately returned by the grand jury.
On more than one occasion I was directed by the Travis County Attorney’s Office to remove exculpatory evidence that I had intended to present to the grand jury during my testimony. At that point, I specifically asked if there would be “ramifications” if I did not do so. I was told by assistant district attorney Guillermo Gonzalez that he would ask elected District Attorney, Jose Garza, what would happen if I refused to agree to the limitations I was being ordered to comply with. What a loser Abbot is – he only acts when someone of importance calls him out. He refused to go on Tucker’s show to defend himself. If, in fact, Texas has has one of the “strongest stand your ground” laws in the country that “cannot be “nullified by a jury or a progressive District Attorney,” why does he have to wait for anything?

Greg Abbott is right to initiate this pardon process, and I hope the parole board follows through and the man is pardoned, but much of this is due to the fact that in the course of his terms as governor, Abbott has been one endless series of fan-dances for conservatives. It’s like his alleged declaration of an invasion at the border. As near as I can tell, he’s done nothing but talk, and the effects of any actions have been minimal. I am beginning to think all of the establishment tied border state governments from one end to the other have something in common that their differing parties belies. I wonder about the influence of the cartels.
A pardon is not enough. There needs to be a COURT RULING that NULLIFIES the actions of this corrupt DA.
10 years ago outside Atlanta my wife’s ex-husbands grandson was helping a girlfriend move. Got into an altercation and both drivers got out of their vehicles. The grandson ,was shot and killed by the black assailent. Grandson ,after serving 2 tours in Iraq and being a marine (which was used against him at trial) had no gun . Mother spent many hours speaking to prosecutors and after 3 years of delayed trials , the assailent was found NOT Guilty. Sad but true. Pray and help others.
