When Ohio Senator JD Vance was briefing the press earlier today, he was asked about East Palestine residents being required to sign indemnity waivers, releasing Norfolk Southern Railway from legal liability, as a requirement of having their water/air tests conducted on their property.
Senator Vance said he talked to a resident about it, then reviewed the contract and confirmed the indemnity demand. Vance then immediately called Norfolk Southern Railroad officials and asked them about it. According to Vance, the response from Norfolk Southern Railway was that the liability waiver was accidentally presented. WATCH (@24:54 Prompted):

OH, YEAH, I FORGOT! I DID THAT WITH DONALD TRUMP! I thought he was a SMART A$$ for a long time, until he insulted Megyn Kelly the first time, which was 5 months or more and many times after SHE had insulted HIM and the lady that was a contender in the contest to earn an apprenticeship, and Megyn and also Max Lucado made DAMN LIES about that situation and ran them into the ground. Something about the way Megyn did it – I didn’t see Max do it ’til much further down the road – and I’d never watched The Apprentice at all, before, because I didn’t like Trump at all at that point. When I went back and watched the Episode and compared that to what Megyn was saying, and some other RELATED circumstances, that neither Megyn NOR Max cared how much they slandered the young woman who wanted the apprenticeship so badly… THAT did it. THEN I started RESEARCHING all of them who had been insulting Trump- and CLAIMING it was because HE was so snotty with everyone else.
I couldn’t find anyone he insulted AT ALL who had NOT FIRST been insulting HIM many times over from MONTHS up to a YEAR or Year and a HALF without Trump saying ONE WORD about them – AND THEM with their insults all over the PRESS at the TIME – DOCUMENTED.
So yeah, I CAN get over it and give someone another chance, because I wouldn’t have given a plug Nickle that TRUMP could ever get my vote for even Dog Catcher.
So I KNOW I can get over other people’s failings, or PERCEIVED failings, and give them a chance.
I am also proud of how Megyn has drastically changed her attitude in Life, since then, too!

It is curious why a senior Congressional Republican who claims to be MAGA can’t speak up and add his gravitas in speaking up for the ordinary citizens of East Palestine.

Scarlet, I honestly don’t think it was sabotage. Railroading is one of my hobbies, and I can confirm that the ongoing issues with brakes, wheels and axles is very real.
In days gone by, manual labor was not nearly as expensive as it is today, nor was the cost of high quality steel, materials and the fabrication of all those into the critical components of railroad freight cars. The problem is always created by management that’s trying to squeeze more profit out of their operation than would normally occur when maintenance is kept up as frequently as it should be.
So the railroads play with statistics and minimize maintenance to what they believe will be acceptable levels of failure of components of the railroad cars. They take risks; they often get by, but this time , it was a catastrophic failure.
IMHO the railroad IS responsible for this problem. They don’t maintain the track as rigorously as they should, and they don’t maintain their freight car rolling stock as frequently as they should. It’s all about money.
He’s getting ripped apart on Twitter. While most of it appears to be from the usual Leftwing diptards who would rip him anyway, many have asked why he hasn’t visited East Palestine. No replies yet.

He’s a congressman and this town is not in his district. They have their own congressman who is there. Perhaps it is polite to wait for their Congressman to invite you to his district. What is with all this vitriol towards Jim Jordan? Totally ridiculous.
It’s not vitriol, it’s disappointment. I think because Jordan has a very high national profile, people expected him to at least chime in on advocating for better responses from both the government and the railroad. The more members of Congress are publicly supportive, the more pressure is applied to the Biden Regime to get off their rear ends.
High profile Congress members have historically voiced support for U.S. victims of tragedies regardless of who’s district they’re in – Hurricanes, earthquakes, shootings, major toxic spills etc.
All that political capital can be put to productive use in more ways than just the committee.
In Jordan’s defense, he is very researched and effective in his questioning, and I can’t see how he can do that and not spend enormous amounts of TIME.
I can vouch that it is easy to get yourself spread so thin that you can’t do anything at a level of excellence.
I agree. I don’t think I am advocating he jump in and conduct research or anything that requires much more than 1/2 hour of his time, if that. He has staff – he could get one of them to run down the appropriate response from FEMA or CDC etc., then simply get on a camera somewhere and give a 5 minute speech about the railroad taking responsibility for its failure amd noting that FEMA and the Administration aren’t helping likely because the people there largely voted for Trump – and how wrong that is for the gov’t to act in such a partisan manner when lives are at high risk.
Just voice his support to the town and chastise the railroad and the govt for largely ignoring these townspeople’s plight, not to mention the dangerous toxic pollution to the air, the watershed and the Ohio River. Jordan could do that in 5 minutes in front of a camera.
And so could many more politicians of both R amd D parties. This should not be a partisan issue.

So far, I have been very impressed with Vance especially when he said that Biden needs to quit blaming President Trump; that President Trump hasn’t been in office for three years; it is the Biden administration, Biden’s Transportation Department and Biden needs to take responsibility for it. I was also impressed that Vance stood in the polluted creek and actually demonstrated that the East Palestine creek is definitely polluted; that video spoke a thousand words. Then Vance actually called Norfolk and Southern Railway and called them out on the indemnification agreement. Excellent job J.D.

NTSB investigators have identified and examined the rail car that initiated the derailment. Surveillance video from a residence showed what appears to be a wheel bearing in the final stage of overheat failure moments before the derailment. The wheelset from the suspected railcar has been collected as evidence for metallurgical examination. The suspected overheated wheel bearing has been collected and will be examined by engineers from the NTSB Materials Laboratory in Washington, D.C.

When Norfolk Southern train 32N derailed in Ohio earlier this month, it was not the first time it had experienced problems on the route.
The train, which originated from Madison, Illinois, on the evening of Feb. 1, broke down at least once before derailing in East Palestine, Ohio, on Feb. 3, according to employees familiar with the matter.
The employees say there were concerns among those working on the train over what they believed was the train’s excessive length and weight — 151 cars, 9,300 feet long, 18,000 tons — before it reached East Palestine, which contributed to both the initial breakdown and the derailment.
Whoa, isn’t that the main line between the East Coast and Chicago? Main lines used to be regularly inspected and were in first rate condition. Is big Corporation cutting corners this much? Two days to go from Illinois to the Ohio/Pa border? Dots don’t seem to want to connect here.

You would think they would have found a way to make our rails safer by now – the RR involved in this 1991 accident ended up having to pay $32 million in damaged. The 1970 Lehigh Valley RR derailment was so poorly managed it is to this day a superfund cleanup site. People wondered why residents of Nevada and Arizona were against allowing nuclear waste to be taken by train from California to a mountain in Nevada that was on the Colorado River drainage – and the trains cross the Colorado River – these are examples why. Today the unions are saying the trains are too long and too heavy – add in poorly maintained rails. Where is pothole Pete spending infrastructure to fix our rail system – after all Joe wants us all to take trains instead of driving.
The cost of paying damages is less than the cost of reinvesting in safer, newer, and more efficient technology and infrastructure. This is a principle of big business and is not unique to the railroad industry.
There is an added bonus to settlements rather than proactive investment: large percentages of settlements go to the trial lawyers, which are then funneled to politicians in the form of campaign donations, who are then in charge of enforcing safety regulation… It is a closed system which discourages innovation.

Not necessarily true. Both parties to the contract have to agree to the elimination of the removal of that part of the contract. Then both parties have to sign/initial/date their agreement at that clause.
When you sign many contracts you agree to all of it or the contract does not go into effect. For example, when you sign an agreement for a credit card, it is a “take it or leave it proposition” or a “boilerplate” contract. You do not even get to negotiate the terms of the contract.
