The office of New York Attorney General Letitia James released footage on Tuesday of the deposition of former President Donald Trump. The video was intended to create a narrative as President Trump repeatedly invoked privileges under the fifth amendment against self-incrimination. However, if you watch the introductory part of the deposition, to include the statements from the office of the AG, you get a real sense of how this witch hunt is being conducted.
President Trump’s deposition took place on August 10, 2022. The issue is AG James using the process of a civil fraud investigation to construct a criminal case against Donald J. Trump. Unfortunately for Ms. James, you do not have to be a lawyer to see the “set up” nature of the lawfare as it is being conducted. Just listen to the qualifiers put into place by the Attorney General office.
Pay close attention to the preliminary procedural explanations and questions from state Attorney General Letitia James. That is the set up, technically and legally explained by the New York AG herself. Once you see that part, you realize no one in their right mind would answer any questions from this “investigative inquiry”. Outside of the blue cities, the rest of NY is very red. In 2016, when I was posting signs for then Candidate Trump, people came running out of their houses asking for yard signs and people driving past honked, thumbs up and waved enthusiastically. Why is Trump not allowed a copy of the transcript. Why is he not allowed to take notes of the testimony. Why is a confidential testimony released to the press.
This is does not appear to be a standard civil deposition, because in that proceeding the witness would have a right to the transcript at least. It appears to be more like grand jury testimony.

False and misleading valuations (appraisals) based on false and misleading assumptions…………..a very difficult/subjective standard to prove.
Especially when large, complex leased properties are being valued……..and ownership interests are segmented. In NY RE it isn’t unusual that the real estate interest is biforcated into more than one ownership interest.
And considering how fluid or even volatile, the real estate market can be, getting a retroactive valuation would be hard, although I assume James has an “expert” ready to swear the properties, at a particular point in time, weren’t worth what Trump said.
Cross-examination would shred such an expert, but it would have to get to that point in the proceedings, and we all know the process is the punishment.

Valuations are not a science. It is an OPINION of Value. And an apprasial based on hypothetical or extraordinary conditions is not unusual.
And the “valuation” of many of those properties, before the Trump® Companies took an interest in them and put serious money into them, would have been essentially zero.

I expect that banks and investors would be quite willing to lend money to any of the Trump® Companies because of their proven record of success. Donald Trump earned his billions by being an astute and honest player in what is usually a very crooked business. He puts his customers first, and charges them a fair price. He pours that money back into the properties.
And if you want to see that for yourself, tell the cabbie to drive the extra mile to a Trump® Hotel. You will be treated like a member of the family who also happens to be royalty – yet you will pay a competitive price for the room. Since she has released these, Trump will have a field day.
She essentially wanted to entrap him with the deposition, and when President Trump did what any of us should do under these circumstances, she violated her own conditions and released the transcript in the hopes of getting President Trump to make a comment in public, to the press about the questions put to him.
If his attorneys have counseled him properly, he’ll just not say anything, put out a generic press release pointing out that this is just another tactic the AG is using in her witch hunt and leave it at that.

No Lawyer, or even a bright law student, would ever allow his client to answer questions in this context, when the AG has repeatedly and publicly stated that she intends to criminally prosecute the president and she’ll try to come up with a reason later.
The entire point of this “civil lawsuit” was to force a deposition and then try to prosecute him for perjury and, failing that (as they must have known they would fail), leak a deposition video of him taking the fifth. I saw this coming years ago. But I don’t think it will hurt Trump because his support understands he’s being ruthlessly harassed and persecuted legally.

When Trump gave his initial statement about the NY AG running on a platform of persecuting Trump and saying the same thing with more specificity after she won the race, that guy who read the questions to Trump said that he disagreed with that characterization, which is perjury. There is ample documented evidence.
The question then becomes that Trump is under oath and no one else. This is an interesting question. Trump was sworn in by the people who conducted the inquiry. Thus, to be sworn in, the people in the proceedings must be under the same level of truthfulness. This very topic will now be hotly debated by law professors and legislators.

The NY AG can be argued as perjuring themselves to Trump’s characterization/questioning of this line of inquiry. That is, by answering Trump with knowing a false statement to the material fact, that the L. James is conducting a which hunt and stated it multiple times, they have, in fact, perjured themselves.
I am not a lawyer. I do not know law. But, this stinks. And, irrespective of the law, the NY AG office has just provide so much ammunition to those who disagree with this line of inquiry/persecution – whatever you think of calling it.

No, perjury is a generally defined as a misleading statement by a witness or party to the action as to a material fact that the investigators or prosecutors needed to prove the criminal case.
James’ statement is evidence of her bias, but does not relate to a specific fact in a particular criminal investigation. She is not a witness or party.

Although I can think of things that have disappointed me about President Trump I have to say that every time they come up with their crooked schemes against him it just makes me surer of my vote for him. Its as if their behavior reminds me each time of the main reason I voted for him in the first place: their corruption! I keep hoping for the time that they will ALL suffer the worst punishment for their crimes.
Even more curious is that when they execute their schemes I even forget about DeSantis as a future possibility. It appears that in my case their approach does the opposite.

I keep my tax returns on paper forever. I recently had the IRS inquire about a tax return from 14 years ago which they claimed they didn’t get. I sent back a copy of the return and the Certified Mail return receipt which proved that they did and when they did. (Maybe they assumed that I couldn’t do that.) I know that, six or seven years from now, they might try to pull the same stunt again. I will still have the evidence.
I will for this reason never(!) file my taxes “electronically.” I download the PDFs, complete them, save the updated files, and print them. Then I mail them, Certified. Every communication is handled in this way. The calculations are done on a simple spreadsheet that has a page for each year.
A billionaire has armies of accountants who are accountable to each other. The real estate business is financially very complex and involves very large amounts of money, much of it borrowed. An honest billionaire, like Trump, is extremely careful to ensure that everything is done properly and filed timely.

Trump’s “real estate transactions” are handled by the corporation, not the individual. And that successful corporation has zero incentive to be deceitful about anything. As I watch this video, the prosecuting team is asking reverse questions, such as “You are aware that you are a criminal and a liar and the worst person on this planet, is that correct?” Most of the subject matter so far is about the valuation of many of the Trump properties as they were, apparently listed on his tax return of one particular year. The prosecution is claiming that Trump intentionally overvalued those properties in an attempt to defraud mortgage banks. First of all, the value of a property can only be truly realized when the property is put on the open market and consequently sold. The selling price is the value in dollars, which is what they were using for valuation purposes. But beyond that are a couple of other points. These banks were not corner five and dime stores. They were huge multi, multi-billion-dollar institutions. They had departments with hundreds, if not thousands of employers, many of them lawyers, whose job was specifically to determine valuations for the purpose of making real estate loans. They accepted Trump’s evaluations and loaned money on that basis. Secondly, they were all repaid! Trump got what he wanted and the banks got what they wanted…that is a successful business deal, something Laticia James would know absolutely nothing about. I honestly do not know why Donald Trump would want to continue in politics. This country has become absolutely sick.
Because our country has gone too far off course, and he is a patriot.
