Yeah sure. The Supreme Court of the United States asserts today that after a nine-month investigation [SEE HERE] they just cannot find the person who leaked the draft of Justice Samuel Alito’s opinion in Dobbs v. Jackson Women’s Health Organization.
The draft opinion on the abortion issue was leaked to Politico from inside the court in May 2022 in what the court calls “one of the worst breaches of trust in its history.” However, despite their efforts to get to the bottom of the leak and find the leaker, they cannot find out who it was.
The court then delivers a two-page memo explaining the situation, and a 23-page report from former Secretary of Homeland Security, Michael Chertoff.

This reminds me of the Carter Page FISA leak on March 17, 2017, when the FBI investigator found the leaker, James Wolfe, but when push came to shove into court the DOJ official position evolved into the FISA was never leaked. Obviously, Senate Intelligence Committee (SSCI) Vice-Chair Mark Warner (D-VA) breathed a sigh of relief. Similarly, whoever the leaker of the Dobbs decision was/is also safe now.
It’s odd how DC always finds a way to protect itself. Something akin to “prosecution was declined” whenever FBI unlawful conduct is discovered.
In the SCOTUS leak example, we are supposed to pretend every possible avenue of investigation was exhausted and yet the rascal leaker couldn’t be found. The “Marshal of the Supreme Court” did her earnest best but came up empty. Probably because the leaker is hiding with the January 6th pipe bomber. Yeah, gottabe.
Maybe the Chief Justice, as supervisor over the FISA Court and Judges can consider investigating the so called applications and their “irregularities?

Hmmm,… seems Chief Justice Roberts couldn’t find the Dobbs leaker for one reason (IMHO)… cuz our Chief Justice, Pontius Pilate Roberts, didn’t want the Cassius culprit found.
Had the targeted Justice been assassinated, due to the leaker’s treachery, Roberts would have had to wash the blood from his hands, like Pilate before him. Near hit, Roberts?
Stop appealing to the crowd’s demands, like Pilate and do your job as the Oath you swore to uphold demands, Chief Justice.
They could do what they’ve done before, many times. Threaten or jail the writers at Politico until they divulge their source.

So if Roberts knows (assuming it’s not him), doesn’t that leave that guilty justice vulnerable to future extortion? Oh wait, that’s how it’s always worked.

It was one of the judges which I believe was Justice Sonia Sotomayor.
Her reputation as an impartial judge would have been trashed completely by the revelation she leaked the opinion just so activists could demonstrate/riot/assemble to dissuade the court from repealing Roe v Wade.
Typical liberal behavior. Argue the facts. If that doesn’t work, argue the law. If both don’t work, pound the table.
the issue here is this, so lets get the situation clear:
there is no criminal violation for a supreme court justice to leak information out. It’s a “rule”. There is also the other rules: we don’t incriminate one of our own. It’s a club, like an organized crime gang.
the “investigations” were conducted to give the illusion that the black robes institution is some venerable establishment that is “serious” about it’s duties.
we know this is not true. the leaks prove this to be untrue.
the “investigations” are simply to create case closed and move on and protecting the so called sanctity of the institution.
here is how you solve this crime (is it even a crime? or just a rule and agreement?):
what media PERSON received the leak?
start there.
then subpoena that person before A COURT (sealed of course to protect the illusion of some 1st amendment security)…and compel under threat of obstruction. It really IS that simple.
If the person continues to refuse to answer, go to jail…and they can wait until they do cooperate.
It’s been done before.
Surely the supreme court must be aware of the violation and what legal tools can be used lawfully to prosecute a violation OF THE COURT.

I think it is at a minimum: removal from practice…perhaps even jail depending on the significance of the violation.
Are scotus judges not also attorney’s who have a primary duty UNDER THE LAW that forbids them from sharing sensitive inner communications about ongoing cases ?

An intelligence agency has a backdoor into SCOTUS computers, found it and leaked it.
That’s a novel theory.
The truth has no agenda.
The supreme court does.
It has now been proven to be compromised.
If Inspector Clouseau cannot identify the leaker(s), then every member of SCOTUS staff except the Justices should be threatened with firing unless the leaker comes forward within 14 days. Then if nobody comes forward, everybody gets fired.
It would take a really really far left brand new justice or member of staff or something to disrespect such an established and inviolate confidence up until this point. Someone not there before that really hates the United States or something. But, since nothing large and blatant like that happened, then it must be the mice or something. Although given the fact that leftists view abortion on demand and federally funded to be some sort of sacrament or something, any of the lefties on the court could have been responsible. Perhaps the empathy so cherished by another fairly recent member made her do it. Where is Holmes when we need him? Perhaps the investigation easily turned up the culprit but, decorum requires they not be held accountable. It wouldn’t look good to have one of their precious jurists to have their character so impugned and not have to step down or diminish the credibility of future decisions.
Or the leaker was one of the Justices on the Supreme Court. I could name 4 who would make worthy candidates for investigation. The Marshal of the Supreme Court may have failed in her mission, but SCOTUS justices know.
1) The Opinion was leaked to the leftwing MSM reporters who cover the court. The Leftwing MSM reporters know who leaked it. And have protected their source.
2) Therefore, it was NOT one of the conservative judges. The MSM reporters are leftists who hate them, and would revel they were the leakers to damage/destroy them.
3) No clerk of any justice would leak without the knowledge/approval of THEIR justice.
4) Roberts and the other justices know who leaked. And which SCOTUS justice approved leak.
5) It was either Breyer, who has left the SCOTUS and is the obvious suspect. Or its one of the leftists.
6) Roberts has zero desire to harm any of the Leftwing justices. So, he ordered this lame, bogus, “investigation”.
Its funny that former Bushie, Never-trumper, probably a liberal Democrat, Chernoff was selected by Roberts to comment on the investigation. Just more confirmation that Roberts is a uniparty hack of the highest order.

I understand that this leak was against the law and was done to hurt the pro-life cause, which is a cause that I support, but with that said, I oppose government secrecy and think that this sort of information should be public by default.
Supreme Court justices are public officials deciding issues of public importance and the public is expected to oblige by their rulings. Therefore, everything that the Supreme Court does should be public.
There is no need or justification for hiding the business of the public from the public.
It was already known that the Supreme Court was hearing the issue of abortion and it was already possible to accurately guess how each Supreme Court justice would rule on this particular issue, so this leak didn’t even bring out any surprising revelations.
It just provided a pretext for some radical pro-abortion supporters to violently protest, which is something that they would have done anyway.
My main concern here isn’t the leak, it’s that the leaker supposedly wasn’t found. This is concerning because the leaker is likely known, but is being protected by their fellow political insiders. It’s a typical case of the “elites” protecting their own which is disgusting.
If a regular member of the public leaked a document like this, they would be publicly outed, socially ostracized, and legally punished to the max.

Is that the real takeaway? That the document was obtained and leaked by electronic means rather than a person within the Supreme Court building? That the supreme court is always under surveillance?
