After two days of testimony in Maricopa County, Arizona, Superior Court Judge Peter Thompson is preparing to deliver his ruling on the two legal challenges. A decision could be announced as early as today. Kari Lake is asking for the judge to declare her the winner or establish a new election.
The trial circled on two specific points of Kari Lake’s legal claims. One point alleges intentional misconduct with ballot printers, paper stock and tabulators. The second point on intentional subversion of required chain of custody processes for ballots.
On the merits of the two points, Kari Lake’s legal team did seem to prove that election officials intentionally and purposefully created a problem by generating a ballot that required 20-inch paper stock, then electronically modifying the ballot image (shrink to print) to a 19-inch standard. This caused tabulators to reject the ballots. There was also convincing testimony the chain of custody was intentionally violated.

My own review of two days of testimony and court action is not optimistic toward Kari Lake’s challenge.
Yes, there is no doubt the election was intentionally screwed up by officials in Maricopa County who are transparently averse to the interests of Kari Lake. The bias and opposition expressed by the election officials is visible, palpable and substantive. These are activists within the county election system.
As a result, it’s clear the election officials did everything to influence or tilt the election outcome. Very clear. However, short of them taking the stand, taking an oath, and stating they cheated and broke the law, the value of plausible deniability protects them. It’s almost impossible to prove election fraud and tampering without an admission by those who did the fraud and tampering.
Lake had a steep uphill climb, and unfortunately one of the larger weaknesses carried by all MAGA candidates (in a general sense) is the low quality of their lawyers. I know each candidate cannot say it themselves, and I am aware it is not the popular thing to say out loud, but the quality of the lawyer is critical when the election challenge issues finally reach the courtroom.
There is a big difference between filing motions, writing legal opinions, and being able to structure questions in real time with witnesses under oath. Lakes legal team is very competent on the written legal analysis, but inside the court, where telling your story and winning your arguments through the testimony of the witnesses becomes important, Lakes legal team was weak. The questions were worded with unnecessary complexity and often missed the core truths.
The biggest example of the weak courtroom skill came when co-Elections Director for Maricopa County Robert Scott Jarrett perjured himself on the witness stand. The Lake team completely missed the moment, fumbled, spoke in circles and did a terrible job pointing out the brutal nature of the falsehoods Jarrett delivered. The defense lawyers breathed a sigh of relief.
Court cases are about telling the story of the truth, and getting the truthful story told through the testimony of others is a skill. There is a reason why top-notch courtroom lawyers are paid a great deal of money; the client is purchasing a skillset only held by a small segment of lawyers. Mrs. Lake had adequate representation, but the legal team was not up to the challenge of telling a compelling story in court in a manner that could climb the legal mountain they faced.

Hamadehs lawyers were embarrassing.
Abraham Hamadeh’s lawyer just conceded their lawsuit. They argued that a review of the provisional ballots would show they won, but that review only revealed 6 extra votes for Hamadeh. They did not argue on the chain of custody, tabulator/printer issues, etc
How in the hell we have an election with 17,117 votes between two candidates with undeniable proof of a fraudulent outcome presented in a court in corrupt Maricopa County, but not one with 511 votes between candidates, is beyond me.

Consider who exactly controls the licensing of lawyers in this country. As with doctors, those that control their licenses and the flow of income dictate what cases will be taken and how ably the legal arguments will be put forth.

This is a state court, not the feds.
My understanding is that they are currently at a district court level.
Arizona does have a State Supreme Court located in Phoenix.
Only if there can be a case made involving “civil rights” being violated. Even if that were case, a civil rights related challenge would still have to start at Local and state Levels.
Notice how there is a lack of civil rights issues in the 2 remaining charges the Judge allowed to be brought to trial.
Can possibly appeal to State Supreme Court, but I think it would be a fruitless gesture.
Much of the battle was lost, when 8 of 10 counts were dismissed.
In particular, the Judge not allowing evidence to be heard, regarding the AI sig verification which is only used in Maracopa County, and which is not allowed by Az law, was a big blow to the Claiments case.
I think the Az Supreme Court is unlikely to overturn the Judges decision, assuming he rules against KL.
She can also appeal all the counts ruled out.
With having only 2 days to prepare for the 2 out of 10 claims I thought the Lake lawyers told the story. The Judge seemed to not allow the court room theatrics and warned the attorneys on day 1 based on what I saw in the trial. Honey (plaintiffs witness) schooled the defense attorney on the law, I was embarrased for him.

A ruling by this judge in Lake’s favor would bring a wrath of evil down on him that would be unbearable. Even with top quality lawyers representing her in the courtroom, the real question would be if the judge himself was man enough to rule the way he should. A good guess would be unlikely

Over and over again, the GOP hires lawyers who may know the law, and may even have a good case, but are simply unable to persuade a judge/jury to agree with their contentions. I am not sure if Democrat leaning lawyers have no souls, and that is why they are able to lie so well, or if there is just a shortage of competent lawyers on the Republican side, due to the Left leaning bent of law schools over the past 50 years, but either way, I am also not optimistic that the judge will rule in Lake’s favor, as there was a high bar set to prove the charges, and it doesn’t appear that her lawyers were able to reach it, unfortunately!
They say the hi-bar is that it must change the election. So do a hand recount with witnesses, throw out the mismatched signatures etc, and see what the totals become. I know this can’t account for them already destroying Repub votes, but atleast we would not see “programing” manipulation of the machines.

I watched (and recorded) EVERY minute of that trial. I believe the verdict to be correct.
Did you know that Goldman was killed in the yard. He had defensive wounds including on the BOTTOM of his shoes, where he kicked out at one of the attackers. His shirt was pulled up beneath his armpits. Likely because he was being held from behind around the chest beneath the arms. No one has ever explained the problem with the time line of the blood and the container switch. Much more. As SD has pointed out, the era of the voter is coming to an end. All that matters now is ballots and those apparently no longer require voters to generate them. Until elections return to a focus on eligible voters casting a single ballot there will not be any need to campaign or for elected officials to have a care in the world about what the ‘base’ thinks about anything.

I watched a good portion of the trial. Kari’s lawyers were not all-stars, but they were capable; however, her witnesses were excellent.

In contrast, I tuned into Abe Hamadeh’s trial, which seemed to be in some sort of final, summary phase, and Hamadeh’s lawyer seemed like a complete boob.
Judges classify vote stealing as political activity and judges don’t want to be perceived as getting involved in politickig… it’s berween the parties. They are partly right in light of the fact that Republicans seem to be the last to be concerned.
Unless the challenger can prove both the misfeasance and, more important still, that without the proven misfeasance, the outcome would have been reversed, the election challenge fails. There can be tons of evidence of the first, but without adequate proof of the second part, the court will rule against the challenge, because it requires speculation. It’s called the “problem of proving a case within a case.”
Like in a medical malpractice claim, it is not enough to show that the defendant doctor screwed up, but you must show that without that screw-up, the case would have come out the other way. That is extremely hard to do in those cases, and in elections, the actual ballots are anonymous so it virtually impossible to prove the opposite outcome would have occurred.
The way to fix this is to change the law so that once the initial misfeasance is shown, the burden shifts to the election officials to prove that despite the screw-ups, the right outcome did in fact occur; otherwise, invalidate the result and start over.
If she wins DeSantis is the loser.
If she loses, DeSantis is the loser, cause either way, KL has earned the titles of “Trump in a skirt” AND “The Future of the MAGA movement.”

Earlier this month, the U.S Interior and Agriculture departments filed suit to stop the construction of the makeshift wall, seeking “a declaration that Arizona’s use and occupancy of lands owned by the United States without the required permits or other authorization constitutes unlawful trespasses.”
In its filing, the government said the “hundreds of double-stacked, multi-ton shipping ontainers…damage federal lands, threaten public safety, and impede the ability of federal agencies and officials, including law enforcement personnel, to perform their official duties.”
They folded as soon as the lawsuit was filed. The federal government has unlimited funds. A mere state has limited funds.
If entire states can’t or won’t fund constitutional or court challenges, who can or will?
States don’t have the right to defend their citizens at an international border if the feds don’t do so as they are obligated to do?
That is just one of the bazillion reasons we are absolutely, positively doomed – no one will challenge anything that should be challenged and that mistake has built up over 100 years and more to get us where we’re at.
The Dems have a corrupt, illegitimate strategy for every conservative challenge to their destruction of America; meanwhile, Republicans have no game.

Remember that our justice system stopped being impartial (“blind”) several years ago. So yes some fraud is prosecuted but not Democrat or Swamp Establishment fraud if it affects their grip on power.

The ease with which the judge swatted away much of the complaint says to me that he will just swat this away as well.
When the time comes to be on the right side of history, it is nearly always easier to be on the easy side of history.
AZ attorney Robert Gouveia has two videos up on Rumble for the two days of the trial. He gives more details as to why he believes Kari will lose this case and it’s consistent with Sundance’s more general summation. The Kari team was given very high criteria/standards to meet which were probably unattainable. But on the second day the attorney who cross-examined Jarrett really blew it in not aggressively pursuing a line of questioning to determine how, why and who was specifically involved with the printers. He was so very close but then backed off and changed the focus. Even if they had actually named a tech(s) and getting them to say they did it to help Hobbs win is ridiculously unlikely, but that seemed to be the judge’s expectations in his instructions to prove malfeasance.
This trial is a good time to remind everyone of the carnage in Maricopa in 2020.

When people tell us who they are we should believe them.
Unfortunately, Sundance is correct about the quality of Lake’s lawyers. I found myself screaming at the screen when they were questioning people on the stand. Their lack of follow-up was most glaring. I’m hopeful that despite their shortcomings the evidence is clear enough for Lake to win, but as with all these cases I don’t see it ending well for her. And I say that seeing the judge seems like he wants to judge in her favor. Perhaps Hamadeh’s lawyers don’t have the same problem. It just takes one to upturn the entire cart of spoiled apples.
The pool from which lawyers are drawn that will fight for the Republican side is much smaller than the Democrats’ pool. This includes all of the big firms that handle election law and certainly civil rights. Political contributions by lawyers of all types skew roughly 80/20 towards Democrats and their causes. As we know, the dynamic is similar (worse actually) in corporate media, universities and entertainment. Very difficult to see how our side can ever win…seems an outright miracle when we do. This is what Kari Lake (and us) need right now.
Hoping for an honest judge with a moral centre.

Attorneys like David Bois or Bush’s attorney during Bush v Gore should’ve been pursued.
It’s a slam dunk win for Lake … … … if the judge has integrity.
But given what America has become, what are the chances of that?
I continue to maintain that this is our only chance to reform our fraudulent, fake elections.
We need to leverage the hammer and scorecard technology to clandestinely steal every single election across the entire country 72.8% to 27.2%. EVERY SINGLE ELECTION stolen by the exact same ridiculous margin. Of course, this will have to be done without getting caught; yes, that’s a tall order.
When this is pulled off, the Left will scream, and we can then say, “but there is no such thing as election fraud.” And then it will be obvious to all that we will have to go to paper ballots, and we can be in a position to demand same-day voting.
So I want to really know – we supposedly lawyer up, conservative media sings their praises because they were the president’s lawyers, or RNC lawyers, or this or that constitutionalist lawyer and on and on, AND THEN we hear about how these different groups basically fumble or don’t anticipate or whatever. And it isn’t because these different ones aren’t patriotic, honest, serious Americans. So then just who ARE WE SUPPOSED TO HIRE? I’m watching the Abe H. thing, that’s Harmeet Dillon’s group. It was claimed that her group pulled out of other places. And again she’s supposed to be so great, and now she wants to run the RNC? So again, just WHO are the magical lawyers we should be hiring?? I can’t recall any online article anywhere that even mildly suggests names of so called conservative super lawyers.
You know what they say- a good lawyer knows the law.
A great lawyer knows the judge.

Yes, a relatively small percentage of Lawyers are LITIGATORS, it IS a specialised “skill set” requiring mental and verbal agility, to be “fast on their feet”, etc.
Another frustration is the extremely short window for “discovery”; as the Judge in the Hamedeh case in Mohave County court pointed out, in a ‘typical’ Civil case filed in Dec 2022, the case would actually be heard in Jan 2025, with the interim time taken up by discovery.
And this issue is compounded by concerns and legislative requirements to preserve the voters privacy of their vote.
The erroneous ruling to NOT allow the claimant to question the AI signature verification process used exclusively in Maracopa County, BECAUSE Az. statute assure voters VOTES will be kept ‘anonymous’ was WRONG.
I agree I find it unlikely that KL’s team will prevail.
Doesn’t mean the case wasn’t worth bringing.
There are some fights you fight, without regard to your chances of winning.
If KL chooses to appeal, I will continue my donations to her legal fund.
If she chooses to NOT pursue it further, I will look forward to donating to her LAKE for VP, in 2024 campaign fund.
I know she said she WANTS to serve Az., would hate to live in D.C. and has no interest in the VP position.
Sometimes GOD has other plans, given how little time Joe spends in DC, not a problem, and I feel just as strongly that KL is THE ONLY candidate for VP , in 2024, as I do that PDJT is THE ONLY Candidate for POTUS, in 2024.
As an Az’n, the only consolation is that the State Legislature will be majority MAGA, and so hopefully will be able to thwart Hobbs &co. efforts to Califorinicate Az.
There is no lawyer on this planet put forward by the dems that could lose this case.
While I felt that one of Lake’s lawyers was reasonable as a trail attorney, I must say I was disconcerted by the lawyer with the unkempt hair, as well as his questioning of witnesses. I imagine it is obvious to the judge that there was election ‘tampering’ and perhaps his job is as difficult as the job of the judge in Miracle on 34th Street. Sadly, I suspect that the US Postal Service will not come in to save this judge from his ultimate ruling. It will be interesting to see if Lake goes forward with an appeal.
At least she’s a fighter. We have another true hero and God’s blessings will be upon her.
It’s stunning that the Demons know they cheated and can live with themselves. The only explanation is they have some kind of absolute mental illness. There’s no conscience active in them whatsoever. They know the people voted for Kari in droves.

Common Sense
Do you recall the comment made by one of Kari Lake’s attorneys, to use our common sense.
Maricopa County OBSERVERS or should I say Runbeck OBSERVERS were reportedly provided by Maricopa County, Arizona leadership. But what about those other voting centers for witch Runbeck provides thousands of ballots during the 2020, 2022 election. Are Runbeck systems throughout the United States repeating the Maricopa process? And are these same locations protected by the government Cybersecurity and Infrastructure Security Agency’s (CISA) contractor too?
The standard for calling a new election is not criminal malfeasance, or “intentionality”, but whether *election protocols were violated in such a way to throw the outcome in doubt*.
That is the sole case they were trying.
