Consider this sketchy right now. Politico is reporting they have “obtained” a draft copy of the Supreme Court majority opinion which would reverse Roe -v- Wade federal abortion law and return the decisions on abortion law to the individual states. {Uploaded Draft pdf Here}
While it is 98-pages, it is only a draft opinion. The decision of the individual judges could change at any time based on their view of the severity of the outcome, wording and other inputs that would be provided. A draft opinion from internal deliberations has never, ever, been leaked before from inside the supreme court; and that alone should send warning flags to everyone.
Personally, I doubt any draft from February would be pertinent today. This entire scenario just sounds massively sketchy.
“POLITICO received a copy of the draft opinion from a person familiar with the court’s proceedings in the Mississippi case along with other details supporting the authenticity of the document. The draft opinion runs 98 pages, including a 31-page appendix of historical state abortion laws. The document is replete with citations to previous court decisions, books and other authorities, and includes 118 footnotes. According to the draft, written by Justice Alito after the February oral arguments in the Dobbs -vs- Jackson’s Women’s Health case, five justices are aligned to overturn the 1973 ruling (Alito, Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett); three justices are in dissent (Stephen Breyer, Sonia Sotomayor and Elena Kagan); and Chief Justice John Robert’s position is undetermined.

I doubt it. Despite the sharp criticism of a justice’s reasoning by another justice in an opinion, they really are a collegial group. Before every argument, they shake hands all around. Outside the Court, they are friends despite differences in judicial philosophy. The Ginsbergs and Scalias used to vacation together.
They all have lifetime appointments, so a justice who did this would damage a trusting working relationship for the rest of his/her judicial career.

If a clerk leaked it because the justice gave a wink-wink to do it, that justice would have a hard time maintaining ignorance to his/her colleagues. I expect Roberts will call the justices into conference tomorrow.
I doubt someone like Kagan or Sotomayor could fake innocence for very long, anyway. It Supreme Court security interviews each person with access to the draft, that person would have to be an accomplished actor or a sociopath to fake it. And then there’s the possibility of lie detector test. Just announcing that might cause the leaker to give himself away.

Keep in mind, Roe v Wade was never based on abortion. It was a decision based on the “privacy issue”. Repealing Roe v Wade does not ban abortions. It simply returns the issue to the states and it allows people in each state to decide how they want the abortion issue handled.
This purported leak could be fake for just the purpose you mention.
If the draft is from February, it is likely that the other 4 votes to reverse Roe have already either joined in the reasoning or finished drafting concurring opinions (with the passage now of at least 4 weeks).
A vote was taken at conference, Alito was selected to write. That means the other 4 were on board with an Alito approach, that is to say, to overturn a right to abortion, not just further limit it.
At 15 weeks, the prohibition of abortion past that point is certainly completely contrary to the Roe trimester scheme, which held that the state could only go so far in limiting second trimester abortions. Further, a 15 week old fetus certainly cannot survive outside the womb, so the arguments tying the right to abortion to viability cannot be relevant here. Even under the O’Connor “undue burden ” test, it is impossible to reconcile a 15 week limit with that test.
Bottom line: to uphold the law at issue is to overturn the “right” because whatever “right” would be left would be almost illusory.

I guess you can argue that should Roe be tossed, pro-lifers can organize state by state to protect the baby, but in reality, I doubt that will actually be the outcome.

You don’t have to be admitted to the bar to be a law clerk. Usually, a SCOTUS clerk will have done a prior appellate court clerkship, so would probably have been admitted, but not required. They are working under the supervision of a Justice, not practicing law.
There will be a legal consequence for the leaker, who will briefly experience mild discomfort in carpus regions.

Reads like an Alito opinion. If a first draft, then definitely subject to give and take modifications to maintain majority vote. Casey plurality ended up being a nightmare. But very unlikely the other side would be able to fake a draft like this.
Plus, viability has always been the Achilles heel of Roe and Casey. Blackmon didn’t even try to explain why an unborn child who reaches the last day of the second trimester is not entitled to the protection afforded to the very same child who lives one additional day and reaches the third trimester in doing so. There is no rational basis for treating those two children differently, the very definition of arbitrary law.
Recall Hellerstadt struck down key portions of HB 2 in Texas, but the ban on 20-week postfertilization abortions, which admittedly included some pre-viability abortions protected by Roe, was never addressed because the Clinic didn’t challenge it, either facially or as applied. They knew they would lose a viability argument because the distinction Roe and Casey make is rationally untenable. So best let sleeping dogs lie.
This opinion overrules Roe root and branch for that very reason, which is why it reads as legit.
And there is no rational difference that stops that viability argument from slipping through partial birth abortion straight on to infanticide and euthanasia of all sorts.
Similarly, there will be no end of technological improvements that push viability to ever earlier beginnings of viability.
And, if ESC ever pans out, they will be growing humans for spare parts. No ‘it’s my body’ privacy argument will allow women to keep their eggs. (Needed to make lots of mini-Schwabs and mini-Pelosis so those creeps can live forever with ‘spare’ parts.) And they will develop the technology to be ‘viable’ from a single cloned cell. (PS. If the draft was prepared back in February, it may have been leaked earlier to DNC leadership or the Biden administration with the release to the press being timed for optimal effect.

What if the powers that be allowed a massive crowd to gather outside the Supreme Court Building, then removed the barriers to allow the crowd to approach the building, then lobbed flash bang grenades into the crowd, then opened the doors to allow the protestors into the building, then shot and killed one of them and beat another one to death?
All this while having federal agents disbursed throughout the crowd to agitate and encourage entry into the building.

And if the underlying reason is to distract us from all the other problems they’ve created in our country in the last year and a half, as usual, they’re tone deaf. Most of the country is trying to figure out how to pay for gas and groceries, rent and mortgages. They’re worried about food shortages and how far behind their kids have slipped over the last 2 years.
