I told my wife to ignore it.

We are told now that anything short of an N95 mask is useless, however, we are still being bombarded with “wear masks” on radio ads. I knew long ago masks were useless. I personally know MDs and they say an N95 is difficult to breathe through and even they can only wear them for short periods of time. bernie s. to the rescue, free N95s for all. Oh joy. Move on.

I understand that N95 masks MUST be fitted and tested..the test lasts about 45 minutes and involves scents..(put in a glass room and scents are fed into it..if you can smell the scent, your mask has a leak. Ask your doctor if they would care for an active TB patient with a paper mask, or a N95 that was not fitted and tested.

I suggest for all, To read OSHA standard 1910.134. Respiratory Protection. It covers required training,medical clearance,and fit testing. All employers must have a written respiratory protection plan. I was a mask worker for 35 years. I have done both type of fit tests.Qualitative and Quantitative. The Qualitative is the smell or taste test. Quantitative uses a test agent and appropriate instrumentation.
Yeah, my company definitely does not want to do N 95s for all. That’s a lot of people to fit test. They actually recommended a different medical grade mask as a slightly better option from the blue surgical. This is a company that has maybe 30% or so of employees who wear respirators, so it’s not like they don’t have a respiratory protection program. They just know employees won’t want to do it the entire day.
It’s not 45 min, more like 5. I’ve done it. But you are correct. Per OSHA regs, users must be fitted for N95s to ensure they get a good seal.

Inquiring mind would like to know, with the SC ruling on the OSHA mandate, if an employer says get the jab or take the train, does that open them up to lawsuits based on discrimination or unlawful termination? What about the employer now being on the hook for any adverse reactions or God forbid death from the jab if made as a term of employment. What I foresee is a lot of woke employers going broke from workers quitting due to them still mandating the jab.

Lawyers play both ends against the middle. If you get covid in the workplace you can find a lawyer to sue your employer for failing to safeguard the workplace by not requiring vaccination. Remember, it’s a legal argument not a medical or scientific one. Either way, it’s just another way lawyers drive up the cost of doing business.
Then one could sue for getting any communicable disease, claiming without the ability to prove it, that you contracted it at work. I doubt that would fly in court.
Since there is no external mandate, all employers should still be limited by non-discrimination for medical status by EEOC. The fact that we have a negative status is protected from retribution, which means if a company takes any ungrounded act to fire an employee, they will open themselves up for lawsuits.
Unfortunately, that means people need to be fired, sue, go to court, and set precedent. That’s what corporations really pay attention to, their legal risk, and how much it costs them.
It is a violation of INDIVIDUAL RIGHTS.

Flat wrong…the courts very clearly stated the mandate could not be issued at the FEDERAL LEVEL ONLY, this case was about Federal Mandates ONLY. It does not impact State Level Mandates where those mandates are issued with SUPPORTING Legislation from the State Legislatures…those State Mandates fall 100% under the 1905 Jacobson Precedent (which also STILL STANDS).
Private businesses can issue mandates as this is one area where a Business can CHOOSE whom they will service and the courts WILL NOT intervene.
The courts LET STAND mandates for medical professionals.
The courts left in tact Public Good & Safety over ride Individual Rights, via the mandates allowed for medical professionals.
I don’t see how they can violate religious rights under the first amendment, as is happening to me. States can enact laws, but they can’t violate the constitution. If it violates my religious rights, how can they do it? Isn’t that the supremacy argument?
First you’ll have to find a district court and an appeals court that will base their decisions on a strict reading of the Constitution. I’m not sure too many of those courts still exist (if they did exist, Trump would still be President.)
The right of states or private entities to do it was not the question before the court. Their not addressing it does not mean they would not oppose it if it was before them. More suits will be required. We’ve won a battle but the war is far from over.

I think anyone forced by their employer to get the shots could sue when and if they contract Covid AFTER getting the shots..employers “should” be confident that this vaccine IS a vaccine and works like a vaccine..or face suits.
In November, an Aldi employee told me that corporate tools them they would not enforce a vaccine mandate unless and until the SCOTUS rules it constituents. She said if that happened, she would walk and several other employees told her they would so the same. I don’t know if anything has changed since then but I believe trying to force employees at any company to get the not-a-vaccine would guarantee at least some people quitting.
