In an unusual twist to the strength of the multinationals, many large corporations are worried they will lose critical employees to smaller organizations with less than 100 employees who do not have to enforce the national worker vaccine mandate.
By itself the 100 worker rule, in combination with the exemptions being provided by the federal government for some politically connected union organizations, would seem to undercut the premise of the “national health emergency.” If the COVID pandemic is such a national threat, why would any groups be excluded from the mandate? However, until the Dept of Labor rule is officially registered, court cases to hear such arguments are not possible.
A recent survey by The Society for Human Resource Management, as shared by The Hill, indicates that 9 out of 10 large employers are concerned about losing significant amounts of workers due to the federal mandate:
The Hill – […] The survey reveals uneasiness among employers over the impending workplace rule, which will require employers with 100 or more employees to mandate COVID-19 vaccinations or frequent testing. They’re most concerned about losing workers amid an extremely tight labor market.
Another two-thirds of employers surveyed said that they cannot afford to pay for weekly COVID-19 testing for unvaccinated workers. It will be interesting to see if, and how quickly, a parallel economy with a vaccination option workforce, will take root.

What employer can defend the abrogation or usurpation of the physician-patient relationship?
The employer has no right to attend the employed patient medically. The employee cannot contract away unalienable rights nor can the employer lawfully contract for same.
Employers may discriminate against an employee, but not without reasonable basis. The employer is not medically attending the employee. Not medically attending the employee or being otherwise duly licensed and contracted to do so, there is no reasonable basis for the employer issuing or dictating a controlling medical opinion regarding the medical treatment of the employee.
The insipid shallowness of these narrowly-trained one trick corporate show ponies does not bode well for contemporary society or the modern economy. Today’s postmodern American executive culture appears to be an utter shambles of symbolic castration and neurotic apology.

In many “right to work” states, companies can terminate an employee for virtually any reason. My daughter’s company is now requiring all employees to be vaxxed. She’s had Covid, she’s even had 1 shot, but the company’s policy is fully vaxxed by Nov 30 or 30 days unpaid leave then possible termination. She works remote–doesn’t even go into an office.
So, what’s the legal defense? She can apply for exemption but if that’s turned down, then what? Can you sue the company if one has an adverse reaction to a mandatory shot? The Vaccine manufacturers may be immune but what about companies that mandate a shot? If they can be sued, then it might cause them to rethink their strategy?
Any legal strategies here?
This may be a big game of chicken. FEDGOV Inc may not even bother putting the enforcement mechanism in place. And if there is no enforcement, the mandate dies on the vine. Sadly though, the damage to the middle class will have been done. Millions of talented workers will have been tossed for no reason at all. The entire employer drug testing polity is stupid. There are any number of metabolic phenomena that cause inattentiveness, error, proclivity for injury and non-compliant behavior. They’re taking the cheap and easy way out. It’s an excuse to not do the hard work of managing employee productivity quality.
Proper supervision is the key. There is no substitute for proper, competent supervision.
If an employee cannot do the job correctly, reliably or safely, that is not a matter to be determined by a drug test. That is a matter to be determined and promptly interdicted by competent supervision.
Everything about the drug testing paradigm is misguided and counterproductive to employee management and the supervision culture of the work place. It removes the focus from where its most needed.
It makes more sense to test their body temperature, blood glucose, eyesight, flexibility, hearing and cognitive fitness, pulse and O2 saturation.
But these are medical procedures. Most employers are not licensed to practice medicine. Even employers with physicians on staff do so to provide intermediary emergent trauma care in the event of a medical crises in the workplace, all which greatly increases the employer liability and imperils shareholder interests.
It all just shows what massive asshats these institutional autocrats are. They shouldn’t don the sombrero if they can’t rock the mariachi… which they can’t cause they’re tone deaf and got no sense of time.

I worked for 2 large telecoms and one of the mortgage GSE’s. They all required drug testing prior to hiring.
Then I got a job as a federal contractor which required a background investigation. Part of the questions on the BI was if you had used any illegal drugs in the last 7 years. Just a question on the application form that you attest to. No drug testing required.
Not to bust your bubble, but most drug tests are performed for one of two reasons post employment:
Routine, random, for insurance breaks and
After some type of accident so the employer’s insurance is off the hook because they were “under the influence”
The concern is, large organizations losing the doers to smaller organizations, and ultimately having only non achievers left. The non existent vaccine mandate, sure as hell isn’t worth that.

Good corporate lawyers should be advising their clients to NOT comply with any “prospective” rules that have not even been finalized yet. There ain’t no employer mandate. Until there is, no employer is required to do anything regarding vaccines. Has anyone tried to use the new CDC definition of a vaccine with their employers? They changed the definition so Pfizer , Moderna and others’ product met the definition ..under the old definition they could not call it a vaccine and therefore could not refer to “have been vaccinated ” if you had been jabbed with their product.
Under the new definition a vitamin such as Vit D or Vit C could be called a vaccine ( the definition is that loose). So if you are being pushed by your employer just say “yes I vaccinate myself every morning with VitD” . LMAO! My employer (I won’t mention the name, but its initials are GE) is firing people a week before the date one must be on the payroll to be eligible for a 3% 401k match. For those whose pension was frozen last December, the company is saving an additional 2% transitional 401k match. Additionally, the company saves on involuntary separation expenses including Special Early Retirement Option (SERO) which allows long service employees to collect their full pension early and one week per year of service severance pay. For me, the company is saving about $100,000. The HR team led by $13m/year pitbull Kevin Cox is all broken up over that. I believe the expression is ‘never let a crisis go to waste. Lots of stock options for the no show execs at 5 Necco Street in 2022.
Oh employers are using this for all kinds of nefarious labor actions. There have been reports that people with the exact same religious exemption claims and wording are getting different results from the same HR department. I think employers are using this to dump older employees, more expensive employees, etc. without having to pay severance, unemployment, etc.
One would assume that since the “Covid Mandate Law” does not exist, that these activist corporations will be held liable for meddling in citizens healthcare decisions, and will be responsible for bad outcomes related to the Covid vaxx? In short they are forcing us to figure out ways to not need the medical establishment and their expensive and deadly concoctions and treatments. I suspect this process may have already been well underway because the pharmaceutical companies’ stocks were nowhere near this valuable without government-mandated customers. Of course, government-mandated Healthcare is a natural extension of Obamacare and it was only a matter of time anyway before they did something like covid.
In March 2020 it became obvious for anyone with more sentience than a rock that they – ??? – were out to crush the roaring Trump economy. Then they -??? – were allowed to nullify 85,000,000 votes and steal the presidency. Who could possibly believe at this point that their agenda could be anything but destruction and oppression?
So – why are we not being told who “they” really are?
As for the parallel economy, I think it’s already starting slowly. The 4.5 million quits probably went to somewhere under 100 or started their own venture. Others may have decided to get training to enter a new field.
This genie ain’t going back in the bottle. I’m happy employees who can’t quit just yet are probably getting their ducks lined up in order to transition out and I think it’ll probably occur regardless if a mandate goes through or not.

When word of this mysterious disease started to fill Social Media with dread at the beginning of 2020, I always thought that the streets of San Francisco would be littered with Dead Homeless! As the Homeless exposed to the elements and many with compromised immune systems from Substance Abuse would be very susceptible to Covid.
During the Shut Downs, I did not see that, though the Shut Downs did kept people and their pets from taking a Crap on the streets. In the now almost 2 years since the news of the Wuhan Flu, the tsunami of dead Homeless NEVER HAPPENED.
So I don’t believe there will ever be a mass die off, at least not by Covid. I would expect people in cities to start dying from Police and First Responders quitting in mass, but in enough number to cause 911 calls to take hours to respond. Or Truck Drivers quitting, which would cause Grocery Market’s “Just In Time” Inventory Management to collapse causing Food Shortages and hording that would make the Great Toilet Paper Run of last year seem like Christmas shopping in October!
Yes, the mass die off, if it happens, will be from the stuff you mentioned plus the clot shots taking effect. Some people died right away, others will die as their bodies can’t fight off other viruses and bacterium it was created to fight off because the shot ruined what was created to be perfect. Cancer and stroke will continue to claim victims, of course much younger on average than typical. Will the world connect these ailments and deaths to the shots? I’m not saying I’m the only reason or even a reason at all, but Southwest airlines seems to have caved on their vaccine mandate policy. I wrote to them the following:
“I’m very displeased with how this non-governmental vaccine issue is being handled.
Let’s be clear: #1 There is no government mandate yet. It hasn’t been issued yet. So the details of compliance have not been spelled out yet. #2 The legality of the requirement is being challenged all over and acting ahead of this is a dangerous position to take as the chances of the challenges winning at the federal level are very good and various states are firmly against them. #3 The legality of the “vaccines” themselves are in question because the FDA approved vaccine is NOT available in the USA at all. Instead the EUA EXPERIMENTAL vaccine is the only one available. This action requiring “informed consent” combined with coercion puts Southwest Airlines into a VERY sticky situation. Think in terms of the countless legal losses where sexual harassment suits have been lost. The company can SAY it was consented to, but given the position of power the employer has over the employee? It’s safe to say it’s NOT consented to.

I pointed out that they have a LOT to lose even if they get the bailouts and continued access to government contracts. Their once faithful and loyal employees will be no more and their once faithful and loyal customers will be no more. And the legal suits over “vaccine harassment” will surely throw them so deep into the red end of the pool that it will look black.
I think it’s a highly effective approach to these companies to remind them that there IS no government mandate until there is a government mandate. For them to try to force this on people the way a dirty boss forces himself onto a female employee while calling it “consent” isn’t going to end well for them at all.

Southwest most probably has contracts with the federal government, and therefore falls under the EO issued on 9/9 for federal contractors. So yes, they are under that mandate (not the >100 employee non-mandate).

It’s already happening albeit for a different reason. Just look at the ranchers building their own meat processing plants. Any large company that fires good employees because of this press release are going to find themselves up against stiff competition from firms/companies that are under the 100 employee limit – so arbitrary that. It’s almost like they’ve spent the last two years destroying small businesses and now they are giving them a life line. The American spirit is alive and well in the business world. Start-ups and small companies are going to crush the big guy. There will be a parallel everything. Even police and fire departments – we’re going to see more private and volunteer forces. We’re reaching a tipping point if NYC is any indication. BLM and Trump supporters coming together by the thousands to protest the vax passport. It needs to start happening in LA, but the only people left in LA are illegals, homeless, and very rich people. (I exaggerate, but that’s what if feels like nowadays.)

My Dad (1925-2020) told me after they had his Infantry Platoon walk through the Ohrdruf subcamp of Buchenwald concentration camp after it’s liberation on April 4, 1945 he couldn’t figure out what kind of person could do what he saw there to other people.
