DENVER (KDVR) — A patient on the kidney transplant list was moved to inactive status by UCHealth for not receiving a COVID-19 vaccine. Her living donor is also unvaccinated and UCHealth said both need to be vaccinated for the transplant process to continue.
The letter Leilani Lutali received states: “The transplant team at University of Colorado Hospital has determined that it is necessary to place you inactive on the waiting list. You will be inactivated on the list for non-compliance by not receiving the COVID vaccine. You will have 30 days to begin the vaccination series. If your decision is to refuse COVID vaccination you will be removed from the kidney transplant list. You will continue to accrue waiting time, but you will not receive a kidney offer while listed inactive. Once you complete the COVID vaccination series you will be reactivated on the kidney transplant list pending any other changes in your health condition.”
Lutali said she has religious concerns with the vaccines, as well as concerns that the vaccine would not be effective after receiving immunosuppressant drugs post-surgery.
“Both from a religious standpoint, and from doing some reading, I’m not certain that this is the right way to go,” she said. “The shot’s relatively new, and as a consumer, I’m not an early adopter, I wait and see what’s going on. I feel like I’m being coerced into not being able to wait and see, and that I have to take the shot if I want this life-saving transplant.”
Lutali’s potential donor, Jaimee Fougner, said she was also told she would not be eligible for the surgery since she is unvaccinated as well.
“When I explained that no, I wouldn’t be able to take the COVID shot, then the comment was, well your journey ends here, because we require all of our donors and recipients to have the COVID-19 vaccine,” Fougner said. (read more)

A university hospital is a public hospital, and there are legal rules as to who may / may not be turned away from such…this should be referred to legal counsel (although even if UC could be compelled to provide treatment, at this point the patient probably prefers to go elsewhere anyway…)

Looking at some of the places like the Patients Rights Council who track how such things are handled as well as how the hospital bureaucracies may handle patients, one definitely has to be very careful about how many patient rights are automatically ceded, especially given who are the decision-makers on the other side.
Being registered or not isn’t a big deal…in China, they are very helpful. They do all the registering for you, and bring you into prison and test you free of charge and take your organs out free of charge too. And your family isn’t allowed to see your body just in case they might think that the donation might not have been entirely voluntary.

Cornea, yes. But they can’t use hearts from a dead body. (Maybe a donor can survive one lung transplant? Kidneys work that way. So actually you aren’t dead until your heart is removed.
Hearts and lungs are not removed until expiration. Consent to do so, needed by family is done prior to expiration. No one living donates one lung. Kidney, yes, partial liver yes.

As an RN after having read that letter and took in the abject horror that that penned letter expressed by clearly a puppet who truly has negated her oath, her professionalism or lack Theron. I wrote to this nurse and asked what type of training she had because clearly she either skipped class especially the ethics class and has lost her way as it relates to her professional responsibility to protect the patient as it relates to patient rights as well as the legal obligations an RN has to provide informed consent. As an RN any actions we take we are responsible for. The fact that she penned such propaganda doesn’t reflect well on her training nor her compliance to her licensure obligations. Everyday my mouth drops lower aghast at a profession I use to be proud to be a part of. What happened to the ‘heroes?’
Elsewhere I opined the heroes, real or potential, are either being weeded out or have their heads down, doing their best to be invisible and survive. All parties involved should be able to sign a waiver of immunity for the hospital involving anything covid-related. Of course they would respond that a healthy organ should go to a person that is more unlikely to reject it, to which I would answer that unvaxxed are a much better bet.
