This is a hot mess. Fulton County election officials were freaked out after a judge granted the plaintiffs access to review 145,000 absentee ballots. The concern is fraudulent and duplicated or double-counted ballots. The final hearing to work out the details of the inspection was to take place tomorrow. However in a last minute flurry of legal filings the county filed motions to dismiss the underlying lawsuit that initiated the ballot audit and review.
The judge has postponed the ballot examination hearing until after the county dismissal motion is considered.
EPOCH TIMES – A judge in Georgia told parties in an election integrity case on May 27 that a previously scheduled meeting at a ballot storage warehouse was canceled after officials filed a flurry of motions in the case.
Henry County Superior Court Judge Brian Amero said a May 28 meeting was no longer taking place because of motions filed by Fulton County, the county’s Board of Registration and Elections, and the county’s clerk of Superior and Magistrate Courts, a spokesperson for the court confirmed to The Epoch Times.
Amero said the motions must be heard before the plaintiffs can gain access to the absentee ballots. He proposed a June 21 hearing, but the order scheduling the hearing hasn’t yet been filed.
“It seems like a desperation move. The silver lining is that we now have more time to perfect the changes we had to make in our inspection plan,” Garland Favorito, the lead petitioner, told The Epoch Times via email. (read more)
the article I read said the premise was that Defendant was not filed as the election commission for the audit…..since the election is done would it not properly be the county clerk or SoS that has authority on the election materials AFTER an election?
That theory seems to have been distributed in the Dems’ morning talking points from Lawfare. Michigan Dems are also arguing that nothing can move forward in Antrim Co because the Board of Elections no longer has jurisdiction over the ballots. The state level Dems obviously feel better equipped to stop audits than local elections officials dealing with local judges. Hopefully, that strategy will not succeed, but I imagine most local judges want nothing than to get a National hot potato out of their own hands.

An experienced lawyer friend of mine told me many years ago that the U.S. judicial system was incredibly corrupt.
He went to tell me how a case he had going in the U.S. was a slam dunk for his client.
The U.S. lawyer assisting him informed him, that the judge that was to originally hear the case had been reassigned and new judge was to hear the case.
The U.S. lawyer advised that the new judge was corrupt, and that their case was going no where unless the client had “ deep pockets” and was prepared for a long battle.
My lawyer friend found out with a short period of time that indeed the U.S.lawyer was correct

If you read the MTD carefully, you’ll notice that the Democrats go to GREAT PAINS to avoid calling the board of elections by its formal title:

The MTD doesn’t use the name because the name demonstrates that Fulton County owns and oversees this board. They want you to believe that there’s this mystical board outside of Fulton County that controls their elections. There isn’t. It’s a county board empaneled by the County, and the County is ultimately responsible and accountable for the actions of its board.
Serving the County is an administrative fix which can no doubt be cured in days if not hours. “OK, we served the employees, but if you want us to formally serve the county, we can do that.”
If I was the plaintiff, I think I’d point out the slippery language used by the Defense to avoid calling the Fulton County Registrations and Elections Board by its full and proper legal name.

Remember when after the 2000 election, The NY Times, Washington Post and a half dozen other state-run media outlets ran down to Florida to count ballots so they could prove Al Gore really won the election, but was denied the chance. Wanted to count all the hanging chads, dimpled chads, voter intent because the Gore chad was not marked?

Hiring criminal defense attorneys indicates that there is a concern that criminal charges may be forthcoming because of this investigation. Any trial attorney can try to use delaying tactics. You wouldn’t seek out the services of expensive criminal defense attorneys if your concern was no more than running the clock.

We want to thank the Department of Homeland Security’s Cyber and Infrastructure Security Agency (CISA) for its work countering disinformation on the electoral process. Your team’s work in this space was, simply put, invaluable.
More specifically, starting in 2018 and continuing through 2020, your Countering Foreign Influence and Elections Task Forces helped states understand the disinformation threat and had the tools to counter it. These efforts included providing classified and unclassified briefings; helping states inform their residents and local media of the threat to inoculate them from it; creating rapid response plans; ensuring disinformation was part of elections exercises; and facilitating collaboration with the private sector, academia, and think tanks. We also greatly appreciated CISA’s own efforts to increase Americans’ resilience to disinformation, such as regularly engaging the public on the threat and communicating facts through Rumor Control.
There have been some good and bad days in the election community since November. On one hand, election officials successfully ran multiple elections during a pandemic. The general election was the most secure in recent history. On the other hand, because of disinformation, some Americans now lack confidence in the electoral process. This is unfortunate and extremely concerning. Elections area core pillar of our democracy. Without confidence in the system, our country faces great challenges ahead.
But these problems do not mean CISA’s counter disinformation efforts—its support for states and individual actions—were unsuccessful. In fact, the opposite is true. Without this work and state initiatives supported by CISA, we are confident significantly more Americans would doubt the electoral process. And we are confident the country would be in a significantly worse place.
We have a lot of work to do to fortify Americans’ trust in elections. This is—hands down—one of the most important issues facing our country. Doing so will require countering disinformation on the electoral process, and state election officials need CISA’s help to do so. CISA must not only continue its counter disinformation work—but increase it.
The recent Director of National Intelligence, Federal Bureau of investigation, and CISA reports highlight this need. The documents make clear how significant the disinformation threat to the electoral process was last year, noting Iran and Russia conducted sizable operations to undermine Americans’ confidence in the system. But these reports do more. They also highlight that at least Russia almost certainly will continue to use disinformation to undermine our faith in elections.
We understand there may be concerns about initiatives that counter disinformation becoming mixed up with political issues. To be clear, we are not asking CISA to address disinformation on topics such as candidate’s positions on economic or social issues. That absolutely is not CISA’s role.
However, the electoral process—the system by which Americans register to vote, cast their ballot, and results are tallied—is not a political issue. It is a pillar of our democracy and a critical infrastructure sector. And, in our view, this absolutely is CISA’s responsibility to protect. It is essential to strengthen and maintain secure, functioning, and resilient critical infrastructure. Doing so traditionally has centered on enhancing physical and cyber security. But the world has changed and so have the threats and the defenses necessary to counter them. Addressing disinformation on the electoral process and renewing confidence in it is required to ensure its security.
Again, we cannot thank your teams enough for their work to counter disinformation the past few years. It was a huge success and shining example of how CISA and states can collaborate to secure America’s elections. We hope to be able to expand these efforts moving forward.

“Misinformation Reporting Portal Pilot. CIS is currently producing a better means for 9election officials to report election infrastructure misinformation and disinformation to the social media platforms for their investigation and adjudication. Currently, a limited set of election offi-cials can report to Facebook and Twitter using the means provided directly by the social media platform. Elections officials must pre-register with the platform and report independently to each one. CIS is working to facilitate a single reporting portal where election officials can report the suspected misinformation and disinformation once, and have it distributed to the various so-cial media platforms. We have been working closely with DHS, NASS, and NASED, along with five States to vet and promote this concept to the social media platforms.
The Misinformation Reporting Portal will provide elections officials with a single place (i.e., the portal) for reporting mis- and disinformation across multiple social media platforms with a streamlined, consistent user experience. In addition, the entire elections community will have visibility of what’s going on with mis- and disinformation in the elections community with-in and outside their jurisdictions, including to see trends and be able to strategically respond. The portal will also streamline and standardize reporting for the social media organizations. In addition, voters will have the benefit of more rapid correction of erroneous information, leading to improved voter confidence.”

Dedicated, direct collaboration with private sector entities and civil society organizations can help bridge the gap and offer channels for swift response.”
“3. Increase trust in election integrity
CHALLENGE:
Strategies and structures to confront mis- and disinformation are fragmented and insufficient at the state and federal levels, and fail to hold social media platforms sufficiently accountable for protecting election integrity. Though election officials expected widespread mis- and disinformation from both foreign and domestic malicious actors—including state-sponsored efforts from Russia and Iran—domestic sources played a bigger role in sowing distrust in the 2020 election. Election officials were inundated by calls and threats regarding false claims of voter fraud both before and notably for many weeks after the election.42 On the final day of the 2020 election cycle, these threats culminated with an attack on the U.S. Capitol as Congress counted Electoral College votes—a visible manifestation of disinformation moving beyond the digital world, and a dramatic reminder that this challenge must be tackled proactively rather than reactively. In responding to mis- and disinformation, federal agencies collaborated with civil society organizations, private sector organizations, and election officials, as demonstrated by ESI’s Rumor Control initiative and the Elections Infrastructure Information Sharing and Analysis Center’s (EI-ISAC) cross-sector coordination. However, many of the collaborative efforts established to track and report issues for this election were hastily set up—and it’s unclear whether they will extend beyond the 2020 election cycle.43 Although leading social media platforms such as Twitter and Facebook introduced new policies and processes in 2020 to support election officials with addressing mis- and disinformation and collaborated with government entities to monitor and mitigate disinformation on a limited basis, they also hindered information sharing with national security stakeholders and election officials through siloed, opaque communication.44
(3a) Expand proactive state communications efforts and civil society partnerships to improve public understanding of election processes and results.
(3b) Improve federal cross-sector coordination for effectively responding to mis- and disinformation.
(3c) Increase transparency and accountability of those who traffic election-related disinformation by empowering states to take legal action.
In 2018, the Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA) carved out a new exception to Section 230—one of the most impactful clauses of the Communications Decency Act of 1996. Section 230 states that “no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.”49 This protects websites that host speech from laws that might otherwise be used to hold them legally responsible for what their users say or do online and offline—and in turn, subverts the cost-benefit analysis of actively mitigating mis- and disinformation.50 Just as FOSTA holds social media firms accountable to fighting sex trafficking by reducing their legal protections, a new carve out of Section 230 can hold platforms accountable to fighting election-related disinformation during election season. This statute could narrowly permit states’ chief election officials to sue social media firms if they don’t do enough to remove mis- or disinformation about the elections they administer. Relevant content could include false information about how to vote and the election process, but also false allegations of fraud.“

Arizona has pointed the way: any “lawsuit” can be blocked or gummed-up, but the State Legislature has “plenary” powers of its own. The voters in each state must demand that their Legislatures take action to ensure that the laws which they enacted were, or were not, faithfully carried out by their employees who were tasked with doing so “under penalty of law.” When they do this, “it is not a lawsuit” and does not concern the court system at all.

And the general public starts to notice things, once those prosecutions kick off. That’s what the Uniparty MUST avoid at all costs.
