“Any system, financial, voting, or otherwise, that is not repeatable nor dependable should not be used,” officials wrote in the letter. “To demand certification of patently inaccurate results neither serves the objective of the electoral system nor satisfies the legal obligation to certify the electronic recount.”
Along with the letter, Coffee County elections officials also sent Raffenserger’s office a document that “illuminates that the electronic recount lacks credibility.”
That term “credible” is key. The electronic counts keep changing…so they used the original count instead of validate a recount.

I don’t get this. In the first sentence of their letter they say explicitly that they cannot certify the election results and in the last sentence they say they will use the election night numbers to certify the election. Is this what you could call having your cake and eating it too?
Sekulow, Levin and many other constitutional scholars are correct the court should take this up. They are correct under the law. The court also should have taken up PA Republican Party vs Boockvar in October. They should have taken up Parnell, Kelly, Et. Al vs Wolf.
A majority of the court doesn’t care about the law. The scholars and lawyers can be correct, and the court still decide not to take up what is clearly their role and responsibility.
To quote an old time judge I know, “I don’t care what the law says – do what I tell you.”

After the petitioner’s brief has been filed, the other party, known as the respondent, is given a certain amount of time to file a respondent’s brief. This brief is also not to exceed 50 pages.

Certiorari is not requested because the matter is not on appeal. It’s original jurisdiction in SC. States v states are filed in SC not lower courts.
This case — States vs. States — is within the Supreme Court’s ORIGINAL jurisdiction. This is not an appeal, which the Court has discretion to hear or not.
The Court cannot refuse to take this case. OTOH, the Court is under no obligation to place the matter on the ultra-expedited track the subject matter warrants.

What I continue to watch is Sidney Powell’s efforts on the voting machines. We need to get Dominion and any related voting software equipment absolutely banned from use in the US.

The problem is that the USA lacked the industrial capacity to produce many of the items itself ; we had no choice but to contract out to other countries. It takes time to build a factory, so we had to lie in the bed we made.
