Whoever replaced Barr would be meet the new boss same as the old boss. In order to get approved, whoever was nominated to be the AG would have to be a protector of the swamp. That’s not ever going to change no matter how many times we go through this.
Can he appoint an interim AG? For how long? Would that person have full power to do his job as a regular AG? If so, then I say fire Barr, hire Ric as interim and keep him there for however long they can. Do it now.
If he wins (or even now) he could move Ratcliffe to AG since he already has passed the congress deal.
I’d rather have Grenell. Ratcliffe seems a bit more in the deep state mode just like Barr, but who really knows since none of us is there with them. Pray for the best outcome, I guess.

I’ll bet she does precisely that. She hinted at it in her interview with Lou Dobb last night.
SCOTUS will not take it. The en banc court zeroed in on the one weak area in Sidney’s case – the speculative nature of the harm to Flynn (legal bills don’t count), and the separation of powers. The four liberals won’t take it. Roberts would duck it, and I wouldn’t be surprised if Gorsuch or Kavanaugh refused to review based on the mandamus request was premature.
This is basically saying that even if the total case is BS, the case can’t be dropped until the judge wants to drop it.
I practiced law for 40 years and worked on two SCOTUS cases. One in which we petitioned for cert, got it and lost the case, and one in which we opposed cert, lost that, but won the case on its merits. (Go figure).
SCOTUS gets around 8000 petitions a year, that vast majority of which are habeas corpus petitions from prisoners with a lot of time on their hands. SCOTUS takes about 80. There has to be a very persuasive reasons why the Court should take this case, and why it should take it nnow.
There is a legal concept called “ripeness” that basically says the issue framed are important, but the case is not yet in the procedural and evidentiary position to be reviewed. Sometimes it is the lack of evidentiary record, which is what the en banc panel was saying such as to Sullivan’s crossing the separation of powers. How far was he going to go in second-guessing the DOJ on dismissing the prosecution? Would he ultimately grant the motion to withdraw and motion to dismiss? That was the focus of the en banc opinion.
SIdney had the options of appealing immediately without waiting for the 7/16 hearing, and waiting to see what Sullivan actually did on that date, and then asking for mandamus. There were pros and cons to each, and I won’t second guess her. No doubt she talked this over with Flynn, and they decided to go for it now.

if a judge can inject himself into proceedings in a dilatory manner, at what point is it considered unjust? can sullivan simply ask for more and more amicus briefs and take another 4 years to decide the case? another 8? 12?
obviously, there is a limit, there is a threshold.
if the justice suspects the Barr DOJ and Flynn are in cahoots, he has other measures to use besides delaying justice. He can refer the matter to the DOJ. Perhaps, he can become a whistle-blower of sorts, sending his accusation to an Inspector General. He does not have a right to prolong a proceeding. Dont forget, he can also simply reject the new plea.
Combine that with defamatory comments by Sullivan and his misunderstanding of his own role, and we have a clear case of a justice acting in bad faith. We can ascribe his actions as purposefully dilatory and harmful.
That’s the angle for Powell to use going forward.
On precedent alone, how can the Supreme Court deny cert on a case that blows the whole adversarial system out of whack, where a judge can assume one of the roles as a party to the action? This is like setting a precedent in a game where the referee can just steal a ball in play and score a basket for one of the team…i know, i know, we’re through the looking glass in the DC swamp and Roberts is the Queen of Hearts…but on precedent alone of allowing this type of situation to ever happen again where a prosecutor drops charges and the judge just says no, you have to keep going the SCOTUS should have to step in the enforce the integrity of the Federal System

Very cool they’re cleaning up! I’m about 15 miles south of Kenosha and near a small airport. Yesterday and right now all sorts of helicopters are going back and forth. I imagine they’re clearing the way for the Presidents visit.
Probably violates the Commerce Clause of the Constitution. Once a person no longer lives in a state or earns income from any employment, property or investment in the state, the state’s taxing power would be crossing state lines.
California would have to get a default judgment, and then try to enforce in the the state of new residence. The taxpayer could then challenge it on constitutional grounds – maybe even go to federal court and ask for an injunction against honoring the out-of-state judgment as a violation of the Commerce Clause.
I am reminded of the manager of the clothing store where I worked my through graduate school.
He had been stationed in Champaign, Illinois, and was hounded by the Illinois Tax Authority for assorted fees and taxes (“Personal Property Tax”) they claimed he owed before he had moved back to Ohio.
I recall him taking the letters, tearing them up into tiny pieces, and sending them back to the Illinois tax bureaucrats. 🙂

Sounds reasonable and like it is a no brainer that CA cannot do this and would be shot down in a court of law. However, we all know how the judiciary is these days about following the laws, especially if it goes against the political will of the left.
I’d be worried if I had to bring a legal case into a court asking for a ruling on how a left generated lawsuit, in violation of the Constitution, would fair. Doesn’t seem like it might be all that winnable anymore and who would be surprised if, in the end, CA is allowed to do what they want to do with this. I’m shocked that NYS and Cuomo haven’t tried this yet. Just sayin’.

We all know this Flynn case should have ended months ago and that every day it continues is a violation of his rights.
That said, I don’t get all the hand-wringing on here about it being dragged out “until after the election”. Flynn is not a factor in the election no matter when this bs is over and I don’t think the game being played is for the purpose of “keeping Flynn from talking or campaigning BEFORE the election”.
My guess is that the delays are designed to tempt Trump into a pardon. He would be a fool to issue a pardon before the election.
If Trump wins …. don’t pardon. Let Flynn have his case dismissed with a clean record.
If Trump loses, he can pardon any time before he leaves office.
Change that slightly:
They want to force Trump into a pardon no matter when it happens. Flynn will never be in a high profile position in government again if he only gets a pardon.
He will be smeared with “Trump got the crook off scot free”.
I don’t believe at all that Trump took it as an election issue. Trump is operating on all fronts to get re-elected. Anything Coup-related is bonus sunlight in terms of the election.
If he had some control over it I am sure that before the election would obvious;y be better. But we know that Trump is at the very least arms-length and hands-off because of the DeepState, Democrats, and media opposition.

The last straw! Florida has been doing great with the COVID recovery, but today DeSantis had to take action.
DeSantis just dumped Quest Labs from the labs used to test for COVID after they Quest dumped 75,000 new tests records on the dashboard, MOST OF THEM OLD TESTS, some going as far back as April and therefore insignificant to Floridians health, and possibly did this in an attempt to skew the numbers higher and damage the perception of Florida’s recovery. 7000+ new cases IN ONE DAY!

Quest kept them in their pocket to use them at the right time to have the most damaging effect on Florida’s recovery. Just as DeSantis was announcing that Florida would start reopening all commercial flights.
Florida’s is a tourism state, and is hurting badly because of the lack thereof.
I read earlier, though, that Quest was one of the companies that was reporting only positive test results and not reporting negative results, skewing the infection rate. They should have been tossed when they were caught doing that.

Mnuchin called the action a “real moratorium” and urged the U.S. Congress to provide rental assistance.

He added: “You will see rolled out … specific guidelines that I think you’ll appreciate are quite significant on allowing moratoriums for people who certify, that they can’t make their rental payments due to coronavirus related issues.”

I guess we live in different times. My great grandmother lost her home when the bank called her loan during the Great Depression. The family struggled but helped one another. My dad lost 3 tech jobs and had to work numerous part time jobs to make ends meet. If you offered him a handout he would have turned and walked away. Tough with a family of six. I could go on and on about my family but what the heck.
There was story of a group of 4 young millennials living in a 4 thousand dollars a month apartment under a Cuomo eviction moratorium. 3 out of work and the 4th working. I am sure all had $800 iphones, the latest laptops, the best clothes, $200 hairstyles, student loans, whatever.

I know all about the stories of these unemployed renters. My God, they were bartenders, amusement park personnel, cruise ship personnel, restaurant workers, dental assistants, hairstylists, barbers, owners of all of these establishments, charter boat operators . . . All of these people here in Florida were thrown out of work because somebody in charge overreacted to the flu.

Retired Magistrate here: Just got back from Plain City, Ohio a small farming community located about 18 miles West of Columbus, Ohio.
A farmer located on St. Rt. 161 is a big supporter of President Trump. He has about 70 Trump, American and Blue Lives matter flags on his fence posts. People stole the flags when he first put them up; however, residents of the community banded together and gave enough money to replace all of them and buy more. A local young woman, who is a supporter of BLM is upset at this so she has organized a protest for this Saturday. Evidently a lot of BLM and Antifa thugs are coming in to protest the flags. Trump supporters are also coming to defend the farmer and the flags.
The local police and highway patrol have been notified. I think they will probably try and block St. Rt. 161, which in this rural area, would not be a good idea. This area of Ohio is definitely Trump country.
Will keep you posted on what happens.
That will be a mess, especially for people going to Costco (my Costco). The shopping center that is home to Costco has been recently developed in that area, so I really hope they don’t destroy it. There are a few smaller businesses in that location. Columbus State and Ohio UniversIty branch buildings are in the area as well.
