A massive win for President Trump, DHS, ICE and all Americans who support the detention and deportation of illegal aliens. In a 10-7 full panel decision the 5th Circuit Court of Appeals has ruled that all illegal aliens can be detained while awaiting deportation and/or while their immigration proceedings are carried out. [SEE RULING HERE]
This is a critical ruling by the entire 5th CCA because it grants DHS/ICE the ability to detain all illegal aliens regardless of their length of time in country or developed connections to the U.S.

WASHINGTON – A divided federal appeals court ruled Friday that thousands of ICE detainees being held in Texas have no rights to seek release on bond — even if they’ve been held for months or years while their immigration proceedings play out.
The full bench of the 5th Circuit Court of Appeals concluded 10-7 that Congress had intended to restrict the availability of release for people facing potential deportation, even if they have lived in the U.S. for years without criminal records and had attended their Immigration and Customs Enforcement check-ins.
The decision is the most consequential ruling yet in support of the Trump administration’s unprecedented, year-old policy of mandatory detention for those who entered the country without permission — even if they had developed decades-long roots in the country, with U.S. citizen spouses and children. This ruling will put additional pressure on illegal aliens to self-deport ahead of capture.

Excellent! It’s good to find some judges who are not bent on destroying America like the #ThuneSchumer Cartel.
It was always ridiculous to legally release into the country those whose crime is entering the country illegally.
Very unusual that judges protect our society by holding bandits…bill
Federal Court Says No ‘Get Out of Jail’ Card for Illegal Aliens
https://www.thegatewaypundit.com/2026/10/ice-says-teams-houston-are-averaging-about-100/
A federal appeals court ruled Friday that illegal immigrants detained inside the United States have no constitutional right to a bond hearing, no matter how long they have lived in the country.
About time, what took as so long for a proper ruling? Illegals never had the same rights as citizens because they are not citizens.
It seems the 5th Circuit Court is suddenly making rulings on those important cases that take forever, or not-at-all, to reach the Supreme Court.
”Illegals never had the same rights as citizens because they are not citizens.”
Exactly. For too long, they’ve had MORE rights, in clown world.
Catch and release for heinous crimes (cuz <<sob!>> ICE bad!), jumping to the front of the line in the ER (cuz “language” barrier), no vax requirements for “undocumented” school kids, no COVID vax mandates, a host of legal aid “programs” the average American could never afford to tap, 5 star hotel stays while they “got settled” (smeared feces on the walls), no license/auto registration/insurance=no problemo!, interpreters in every facet of their lives (school, hospital, court system).
If these judges were held accountable for the crimes their pet illegals commit, if they were the victims, the ONLY victims, of illegal crime, the blind eyes they all possess would suddenly develop perfect sight.
DEPORT, DEPORT, DEPORT. And then, DEPORT some more.
Be sure there are lots of Somalis in that deportation process.
Let’s use any funds recovered from Somali fraud for use in building Somali Detention Senters. We could use a very large one here in the Columbus area.
No need to build a darn thing. Just detain them in all those empty Learing Centers!
Senter. I get it! HAHAHAHAHA!
With Omar (or whatever her real name is), and her extended grifter family at the head of the line.
”We need more Somalis.”
Said no one, from anywhere, since the dawn of time.
Once had an Uber driver pick me up at Columbus airport several years ago. I asked if he was Somalian since half the city is. Turns out he was Nigerian and he went on an anti Somali rant for the entire 30 minute ride home that was very unfiltered and with salty language. So you are not wrong!

Elections matter. Dann right. We need another 20 years of GOP majority to get this county and its court system back on track. Vote.
All Pres. “Autopen” Appointments should be null and void. While the Senate confirmed, they did so not knowing that the biden was not cognitively capable of making an independent, rationale, selection decision. Thus the Senate was repeatedly misled, and the “deals” struck among the demonrats and rinos were even more “corrupt” and in breach of their Oaths to support the Constitution than normal.
Congress can accomplish this by straightforward manner of “defunding” court, “defrocking” the judge (none of whom have “lifetime tenure”) and dissolving the court (What “Congress may from time to time ordain and establish”, it certainly can “defrock” and “dissolve”. No Impeachment required; no allegation of “bad Behaviour” need be the basis).
Then if Congress in the next “budget cycle” decides to “ordain and establish” select additional courts, it is free to do so observing appropriate “Executive nomination” and “Senate advice and consent” processes.
Wow thanks for posting that obvious judge’s pattern…bill
Excellent info….
Bush cabal VS Reagan Trump
Elections matter! These midterm elections matter very much. Get your ballot in and make sure your friends and family cast their ballots as well. I’m blessed with time and energy to work ballot chasing in my precinct. It is enjoyable and illuminating.
Amazing that there were 7 justices stupid enough that they ruled to let them go free.
Agree, 10 to 7 that number should be 17 to 0.
— misposted —
Stupidity doesn’t necessarily have anything to do with it.
It’s about ideology. Leftist ideology seeks the destruction of Western Civilization.
Judicial decisions by leftist judges will always side with those who seek our destruction.
Clear evidence of “politicization” and breach of their individual Oaths to support the Constitution; which does not grant any “policy” or “law” making Powers to the Article. III. courts.
Regrettable. Not amazing.
(And I wish I still had my Dad’s Corsa).
Libs tow the party line even if sitting on the bench of impartiality.
I will fix the last sentence. This will encourage illegal aliens to self deport before capture, but after voting!! This is great news and probably going to SCOTUS on appeal. They just need to do their job, which can kinda go either way with the current roster.
Can en banc decision be appealed?
Take the 3K offered and self deport.
Exactly. Only in Western countries are such generous offers made. “If you stop raping and pillaging, and sucking us dry, we’ll pay you to leave, AND provide transport.”
Imagine the self-deport rate if taxpayer funded immigration lawyers weren’t involved. Another anti-American program that should be defunded, and in fact, outlawed.
An illegal alien max household welfare program pays out 80K for doing nothing, so as long as sanctuary states keep the free spigot flowing, 3k doesn’t motivate these freeloaders to go home. I also think this Admin should be fining and/or placing severe sanctions on those countries that refuse to take back their citizens.
Probably only applies in the states in the Fifth Circuit, Louisiana, Mississippi and Texas. However, the Fifth was the first to take on this issue, and any other circuit, e.g., the Ninth [Circus] would now have to address the Fifth’s arguments.
It was an en banc (all the judges except for the senior status judges), so that carries an extra weight that the three-judge panel would not.
There was a day when all who occupied a bench in the “Judicial” would overwhelmingly and unanimously vote to remove all invaders.
Those 7 against and most ALL do not hold the law or Constitution in a way actual Judges at one time did.
B.A.R. Agent London carpetbagger have saturated the once great system we had.
Democrats: Waaah they are attacking and injuring our Capitol Police. Its insurrection!
Also Democrats: ICE are nazis! Fight! Resist.
Woot! Woot! 🇺🇸💥🇺🇸💥🇺🇸💥🇺🇸.
7 need to be removed.
MAGA
That is really going to hurt the democrat get out the vote system
This is known as a, ‘which way is the wind blowing’ ruling.
Can’t resist, sorry.
…and herein lies the crux of the whole legal argument…
“Wilson also noted that the individuals challenging their detention could end their confinement “at any moment by agreeing to leave the country.”
So, these people are voluntarily detained!
How It Can Be Challenged
• United States Supreme Court: If an en banc decision comes from a federal court of appeals (or the highest court of a state), a losing party can file a petition for a writ of certiorari asking the U.S. Supreme Court to review the case.
• Discretionary Review: The Supreme Court is not required to hear the appeal; it generally only accepts cases that involve major constitutional questions, unresolved conflicts between federal circuits, or issues of exceptional national importance
On October 1, SCOTUS agreed to hear Rhoney v. Barbosa da Cunha, involving the underlying statutory question: Does the mandatory-detention provision apply to illegal aliens already living inside the United States? Numerous other federal appeals courts have interpreted that provision differently from the 5th Circuit.
Now, the Supreme Court isn’t directly reviewing Friday’s constitutional ruling in the Rhoney case. But if the justices reject the 5th Circuit’s interpretation of the statute, that could undermine the foundation of this decision.
I have to admit that I do have some sympathy for the children of illegal parents because they had no choice in being illegal, but they are still here illegally.
It’s not the fault of the United States that young illegals are in the situation they’re in and they deserve nothing more than a chance to apply for citizenship legally.
A few may even show themselves worthy of US citizenship but asking is an important step which shows respect for the country and it’s citizens.
Without that show of respect you negate your opportunity for consideration.
America’s UniParty views “sympathy” as weakness. They will work to exploit that weakness at every opportunity.
Sympathy is a weakness we cannot afford.
Do not agree at all for numerous reasons. If I had to pick the number one reason, it’s because what I have observed during my lifetime. That is, children of parents who respect this country and follow the rules, work hard and try to assimilate are NOT the same as children who have been taught to invade America, handouts are their right and they are victims whose focus is to create chaos to CHANGE the U S.
Illegals have NO right to be in this country. End of discussion. They did this to themselves. Yet they keep trying to make this our problem ;not theirs fully using their Democrat party enablers.
As well, the Trump v Barbara Decision violated the Powers reserved by the People, as it was:
Against the Constitution and the clear, limited intent of the 14th Amendment by it framers and ratifiers;
Overreaching the Powers delegated to the Article. III. courts, which Powers did not include any “policy making” or “legislative” Powers, nor any Article. V. Power to “Amend the Constitution; and
Blatantly violated the Law of Nature, and Nature’s God which ALL PEOPLE Throughout History have Recognize: The First Duty of any “tribe” or “nation state” is to Protect Its People Against Invasion.
I will add that the “right to name a child” is known throughout all cultures as having the concomitant assignment of responsibility for that child. Thus, if the Parents are not US Citizens, their children born within US Borders are not US Citizens. … The “seditious six” should be removed from the supreme Court for “bad Behaviour”, i.e., beach of Oath to support the Constitution (there is no “lifetime” appointment). … And, the Decision made “null and void”.
Can they still collect benefits while in custody?
Can they still send money out of the country while in custody??
The disconnect between the judicial branch of typically activist leftist lords and the rule-of-law within a constitutional framework of restraint is so vast that proper, common sense, properly reasoned rulings (like this) that favor law-abiding citizens and support our suffering American republic are shocking.
HAHAHAHAHAHAHAHAAHHAHAHAHAAHA
Now get rid of every ‘foreign’ UN employee even if they hide behind Swiss so called neutrality.
Yeah… about time.. Happy Dance singing Deport, Deport, Deport as I wiggle around
Good.
They NEVER should have been set free. Such leniency has made a mockery of enforcement against illegals.
The President should immediately order NO FOREIGN WIRE TRANSFERS BY ILLEGALS TRESPASSING IN THE USA.
The President DOES have that power to prevent money being sent abroad by wire.
Don’t let them work illegally in the USA and send American dollars abroad. The U.S. economy needs the recirculation of monies EARNED HERE TO STAY HERE.
Excellent !
They need to be deported.
This is an amazing ruling and one that is almost unbelievable, considering the shameless and outrageous judicial insurrection that we have been seeing for the last two years. Kudos to the court for getting this right!
The lower courts full of liberal activists had bizzarely deemed “seeking admission to the United States” to mean seeking admission at the border point of entry ONLY. According to these completely asinine and farcial rulings, the government may have the power to detain without bond illegals who seeked to enter the US and initiate deportation proceedings against them, but it had NO right to do the same for anyone who evaded detention and made their way to the hinterland and settled here, often brazenly.
Seeking admission to the United States means seeking admission for permanent residency, no matter where a person is located – at the border or within the country. It’s a sorry state of affairs that the government had to fight tooth and nail just to get this basic and obvious principle upheld.
Not looking good for Ilhan (of WW Eleven).
If Demarxists take House, they will change the law to end all of ICE-CBP…I’m glad my POTUS has a big VETO PEN
Amazing decision but not in the context of common sense.
There were a number of “judges” that have the ability to read the text of the law regarding illegals and still some way, some how come up with a rationalization to ignore plain language.
Ppl must vote 🔴…election of judges matter
Self deportaion, one thing Mitt was right about.
