Dept of Homeland Security Secretary Kristi Noem goes straight into the heart of the operation where deported criminal gang members are being housed by an agreement with the government of El Salvador.
Homeland Security Secretary Kristi Noem sends a chilling warning to illegal criminal immigrants entering the United States. On Wednesday, Noem visited the high-security prison in El Salvador that recently received hundreds of alleged Venezuelan gang members.
Noem was given a tour of the prison by Salvadoran Minister of Justice Héctor Gustavo Villatoro during her visit. The Homeland Security Secretary then met with El Salvadorian President Nayib Bukele and is expected to visit Colombia and Mexico next.
“First of all, do not come to our country illegally. You will be removed, and you will be prosecuted. But know that this facility is one of the tools in our toolkit that we will use if you commit crimes against the American people,” she said.

I lived in that region of Central America for a number of years and I can tell you it gets brutally hot and humid during the day and it gets pretty damn chilly at night. The really mind numbing part is those MS 13 guys woke up in the United States planning on going out and raping and robbing and pillaging and by midnight that same night they were in prison in El Salvador. that is a modern marvel! I bet it took those guys a week to figure out what had happened.

Can anyone explain why the Supreme Court had upheld a district court’s verdict that landlords cannot discriminate against renting to illegal aliens? I just stumbled upon a decade’s old case of Farmers Branch, Texas that had passed an ordinance that landlords cannot rent to illegals, they tried appealing to the Supreme Court but they refused the case so the lower court’s verdict stood. So apparently, no landlord can discriminate against housing illegals and cannot ask for documentation.
So, can they call ICE on suspicion then or what? How the heck are we going to move these people out with all these obstacles and coddling them with housing?

I used to be a prison guard. One day, we were short-staffed, so they asked a female guard to monitor the men’s shower time.
No doubt, she is putting herself in the crosshairs. However, your cliff analogy doesn’t work. Cliff huggers are looking for thrills. Secretary Norm is sending an unequivocal message to the gangs that our country is no longer theirs for the taking.

One of the aspects of this that seems interesting to me in light of Boasberg case issues is whether El Salvador is acting as an agent of the U.S. government such that it could be said that those “deportees” currently being housed there are de facto still “in the custody of” the United States (like Gitmo), or whether the U.S. has completely abdicated control over them and their futures, as would be the case following a deportation to their country of origin (or elsewhere where they were just let go.)
Perhaps the biggest, and somewhat buried issue in the Boasberg thing (in addition to his inappropriate class action certification based on a dubious and muddling conflation of laws and legal concepts) is the assertion that the remedy for individuals claiming to have been mistakenly identified as TdA, is habeous corpus, and the counter by the plaintiffs’ lawyers that it either isn’t the excluave remedy or doesn’t apply at all because “confinement” wasn’t being contested.
Noem’s visiting the prison, in addition to a threatening PR message to illegals to get out or chance something worse than possible deportation, seems to add weight to the idea that El Salvador is acting as a confinement agent of the U.S. and that these individuals still are in a manner of U.S. custody.

Nayib Bukele has done a great job in eradicating his country of criminals for the betterment of his country and his people. Why are we shipping these creatures to him? Why not back to Venezuela where the belong?

Bukele has the setup. We’re paying him, both saving us money and making him money. Venezuela initially refused to take them back. And even if it does, we still run the risk that they’re free.

These are Venezuelan problems… not the USA or El Salvador.

Right, the problem isn’t going to be “fixed” until they are dead. Venezuela opened its prisons and sent them here. At least while they’re locked up there that can’t happen and there is no recidivism.

When the President published his “proclamation” according to the Alien Enemies Act, he took care to quote the exact phrasing from the text of the law. Therefore, he did declare precisely what this Act authorized and required him – and him alone – to say. “Word for word.”
It is, therefore, “more than one hundred year old ‘settled law'” that President Trump was entirely proper in doing what he chose to do, and that no court may countermand it, nor is required to approve.
So, you might not like to find yourself in that wretched prison, but you put yourself there.
Judge, you might prefer for foreign criminals to be set free until you can “get around to” hearing their cases, under a Constitution that does not apply to them. But, you have no power to do so.

Compliance with the AEA isn’t going to be the issue per se. The issue is going to be what is the remedy for someone to whom the Act doesn’t apply, who is accidentally swept up and shouldn’t have been. Maybe unlikely but still possible, and this I think is what is going to be moving the underlying arguments in the case.

Well, for me, it’s simple: are they here illegally? Did they come into this country by illegal means? Did they go to a port of entry and declare their entrance?
If the answers are yes, yes, and no, then it’s too bad. So sad; they are illegals, and the Constitution does not apply to them. Only those who grow rich off of the backs of illegals, or the illegals themselves, will say otherwise.

Who makes these determinations and documents them? Do you believe that cops never make mistakes?
Unfortunately, it’s not so “simple”. I don’t like to underestimate the opponent’s point of view. That’s a recipe for losing in court.

We don’t throw out our laws because sometimes a mistake is made. Correct the mistake when it comes to light.
Do the same thing that is done every other time an innocent person is “swept up”.
The judge cannot hear the case of any accused enemy alien unless that alien was found to be “at large” in the judges district. This should make “judge shopping” impossible, and means the aliens shipped to foreign detention facilities are NOT IN HIS JURISDICTION. The five in the ACLU case, taken off the planes in response to the judge’s order, were also likely not in his jurisdiction.
All of this can be found in Section 23 of the Alien Enemies Act statute. I have it quoted elsewhere on this article’s pages.

The jurisdiction of a federal district judge in 2025 was written into the Alien Enemies Act in 1798 in Section 23 of the statute:

“((After any such proclamation has been made))), the several courts of the United States, having criminal jurisdiction, and the several justices and judges of the courts of the United States, are authorized and it shall be their duty, (((upon complaint against any alien enemy resident and at large ***within such jurisdiction or district***, to the danger of the public peace or safety, and contrary to the tenor or intent of such proclamation, or other regulations which the President may have established))), to cause such alien to be duly apprehended and conveyed before such court, judge, or justice; and after a full examination and hearing on such complaint, and sufficient cause appearing, to order such alien to be removed out of the territory of the United States, or to give sureties for his good behavior, or to be otherwise restrained, (((conformably to the proclamation or regulations established as aforesaid)))), and to imprison, or otherwise secure such alien, until the order which may be so made shall be performed.”
Let’s break this down.
The opening words “After any such proclamation has been made” means the President has issued a proclamation invoking the ALIEN ENEMIES ACT. What follows is the description of what Congress expects judges like Boasberg to do.
“upon complaint against any alien enemy resident and at large WITHIN SUCH JURISDICTION OR DISTRICT, to the danger of the public peace or safety, and contrary to the tenor or intent of SUCH PROCLAMATION, or other regulations WHICH THE PRESIDENT MAY HAVE ESTABLISHED”
Before Boasberg can act the following must be true:
1. The President published a Proclamation invoking the Alien Enemies Act. So, the President sets everything in motion with the proclamation.
2. The judge must receive a complaint against an alien or aliens.
3. The alien(s) must be at large in the judge’s district.
4. The compliant must indicate the alien could be a danger to the public as described in the President’s proclamation and any supporting regulations. The President does not have to produce such regulations. Only the proclamation is necessary and needs to be the measure of what it means for the accused alien to be considered a threat of some kind.
5. The judge must preside over a hearing about the matter in order to determine:
a. The alien is not in bad behavior.
b. The alien is not in good behavior so must be restrained IN CONFORMITY WITH THE PRESIDENT’S PROCLAMATION and/or REGULATIONS accompanying the proclamation. The alien must be either deported ASAP, or detained until the alien can be deported.
Boasberg was in compliance with the statute when he ordered removed from the planes the five aliens named in the lawsuit claiming they are NOT Tren De Aragua members if they were “at large” in his district. Those five were removed from the planes, so the Administration is in compliance as well. Boasberg should have had the hearing to determine if the five aliens should be deported. Depending on what was discovered from the hearing, the appropriate actions, as described under Number 5 above, should have been done by Boasberg. This was the extent of what the statute sets forth as the judge’s jurisdiction. He could not demand the planes “turn around,” as those individuals were not referred to his court for a hearing to determine their status. He can make inquiries and make public recommendations about what, if anything, needs to be done in his opinion, but Congress is the determining body about how this statute is to be applied, and the only body that can change the statute.
