Federal Judge Reggie Walton saw an opportunity to give media (Buzzfeed and CNN) their request for all documents from the Weissmann/Mueller investigation when President Trump wrote a tweet on October 6, 2020, re-emphasizing declassification. Seemingly Judge Walton wanted to interpret the tweets as authority for the declassification of material underlying the Mueller probe. As a consequence Walton asked for clarification from White House Chief of Staff Mark Meadows.
Mr. Meadows responded to the request from the court with a one-page statement:

Meadows affirmed that President Trump was just re-authorizing AG Bill Barr to execute the same declassification authorities previously granted on May 23, 2019. The president’s tweets were not “orders”. Judge Walton has scheduled a hearing for Wednesday to address the sufficiency of the White House’s response.
Very precise language, equally precise meaning. Wish our judiciary adhered to such.

Yesterday Trump emphasized that Barr was an extremely nice guy, patient, and gentle–word to the effect that he was very, very even-handed and fair.

I’m not setting up for anything. I heard Trump make his comments, and his emphatic style made me infer the above meaning. Sure, your comment is valid as well, because Trump has made nice-guy comments about people he later turned sour on.
However, in this instance, the meaning I described would have preparatory value if indeed things played out as I describe. If not, and Barr is sacked for non-performance, then you’d be correct. Time will tell.

Since no one really knows the actual context behind the words re Barr, most of us are just commenting on how those words struck us at the time they were spoken. With that proviso I’d like to say that I concur with you, ‘evergreen.’ What carries weight for this interpretation is the significance of the President’s statement that he would only state these words ONCE!
You would only say that if something was about to drop, and once it did, the President would stay clear of the controversy and refrain from gratuitous comments because to do otherwise would be jeopardizing the presumption of innocence and the right to a fair trial Also, the defense could move to have the charges dismissed because of prejudicial comments coming from the executive branch. 4 main issues…if I may help clarify
1. authorize isn’t an order. Barr isn’t authorized by ANY law to declass AND released classmat to the public. Authorize from POTUS gives him this authority.
2. It is narrow in scope. By a strict reading of the tweets one might draw conclusion means ANY AND ALL. but in context and read in following sentences the meaning is qualified …intelligence material that shows corrupt behavior.. misconducts… nefarious intent…those materials that reveal TRUTH about how it IS a calculated and coordinated conspiracy…those materials .. apparently AG Barr has them. POTUS gives him that authority to release them.
3. its an authority but not an order to do so. its not spliting hairs
.. each carries a specific unique legal and practical force. think of it like delegating “some power”… that is authorizing…but ultimate unrestricted power remains with the principle. an order would be to delegate in theory the entirety of the power… including total discretion. POTUS wisely chooses only the lessor of the two delegated powers. and as above…its narrow in scope.
4. this one is interesting..since.the judge has.opened the door … and Meadows addresses it…it would appear both of them and potus seem to Believe the use of Twitter as medium is acceptable to communicate executive legal exchanges. years ago…the same issues were raised about “E-Mail”.. some argued that email was not a formal medium… I’m assuming the natural tendency yet to be challenged is that twitter is going to be the same. having said that…i would be interested in knowing if POTUS ALSO sent an actual traditional official letter document to AG Barr with precise language. i can’t imagine twitter replaces that … it’s very interesting how POTUS has MASTERED and gamed twitter to OUR BENEFIT..no?
Don’t know if there would be any legal ramifications to this, but if a judge ruled or allowed that Twitter CAN be used as medium acceptable to communicate executive legal exchanges… would that open up a new and different door for the Federal regulation of Twitter?
orange- one judge cannot determine whether or not Twitter can be used in the same way that other legal communications are with the force of law. There are the Rules for Civil Procedure for example, that explain how legal papers are to be served. Example- how you can serve a summons on someone when you start a lawsuit. The rules for all these procedures are laid out in all the courts..

I think by POTUS giving Barr authorization to release, but not ordering him to do so, POTUS is essentially saddling Barr with all of it.

People (MSM, Nadler, Schiff) have been trying to get all of MUELLER’s background documents released publicly for over a year now. This would include the info from the grand jury(s). They have been unsuccessful.
Those people (specifically Buzzfeed/CNN) are NOW arguing in court that Trump’s tweet of Oct 6 “authorizing” declassification…..applies to the Mueller material. The judge is considering that argument as valid.
To be specific….CNN/Buzzfeed ONLY want the MUELLER documents.
And remember….MUELLER’s investigation was a COVER-UP and FRAUD. He claims he DID NOT EVEN INVESTIGATE important issues:
The Steele Dossier, Assange, Mifsud being 3 of the most important.
Donald Trump wants ALL THE DOCUMENTS specifically those PRIOR to Mueller and including the HRC email investigation, etc.
Understanding “declassification authority”:
Many are under the impression this means “Release to the Public”
But frankly that is secondary.
It was supposed to allow Barr to personally be able to declassify documents NO MATTER WHO’S DOCUMENTS THEY WERE (CIA, State, NSA..)….bypassing a lot of red tape.
A prime example of how this is used is simply the investigation itself: investigators and their staff have to be able to look at documents from a wide range of sources.
Another example of how this can be used is the case when a witness DOES NOT have the proper or ANY SECURITY CLEARANCE.
You cannot LEGALLY show that witness CLASSIFIED DOCUMENTS without violating espionage laws (ie “mishandling of classified material”)
But with declass authority you can use that to declassify the material and present it to a witness who doesn’t have clearance.
Comey played this trick on Horowitz. He purposely DID NOT renew his security clearance limiting Horowitz’s ability to show Comey documents to refresh his memory.
(Unclear if Horowitz requested Barr to “use” his authority to get around Comey’s obstinance or he did…and Comey simply refused to meet with Horowitz further.)

Weissman et al likely threw the kitchen sink at the Grand Jury for the purposes of future smearing. Every possible accusation they could think of including treason, theft, money laundering, murder, child abuse and pet molestation. That’s why Grand Jury testimony is kept secret. Because only substantiated accusations are allowed to see the light of day. The problem with that tactic now is that so much s**t has been hurled at POTUS that only the rabid NeverTrumpers will believe it anymore.

I’m probably not the only one guilty of posting out of sheer lonliness, in the internet equivalence of a ham radio operator at midnight asking if there’s anyone out there willing to respond to my voice.
The treehouse is at its best when reasoned, considered thoughts are posted, and when knowledgeable posters share their inside technical information that illucidates the rest of us among the hoi polloi. Our passions are going to be elevated the next several weeks. It will take discipline for each of us to not post every reaction or emotion or gut prediction.
But the reward is that we won’t have to sift through nearly as much excess material to find the nuggets worth keeping.

Personally I would stall the Hunter release 3 more days and make Biden debate. And then let him artfully lie and deflect for two hours. And then the next morning drop it all on Biden. More devastating. Less recovery time. The following week you take down his replacement too.
The premise is Joe will be replaced just prior to Election Day. Do max damage to the dims before the switch.

This judge, and any judge, well knows the difference between “authorizing” and “ordering”. The judge knows that an Order would have been self-executing. Logically, by “asking” for a clarification, Judge Walton acknowledges that PDJT’s tweet was NOT a self-executing Order but merely another authorization to Barr to release that which the Executive branch has the power to release.
This judge does violence to the law and its foundation. “Logos” means both “reason” and “word” in Greek. “Thought” might be the best English translation; Logos includes “reason” (internal thought), and speech (externally expressed through language).
