Speaker Pelosi Threatens Possibility of Armed Conflict Against U.S. Department of Justice…

Think about all of the media panel discussions on gun ownership you have watched; segments where second amendment advocates were ridiculed by media pundits for daring to bring up the possibility of the U.S. government using arms against U.S. citizens who hold opposing political views…  There are hundreds of recent reference points.

Now consider, earlier today U.S. House of Representatives Legal Counsel, Douglas Letter, argued in court it would be a possible remedy -for a conflict between branches of government- for Speaker Nancy Pelosi to order an armed “gun battle” between the House and the United States Department of Justice.   Yes, this actually happened.

At the same time as national Democrat political candidates are arguing to remove the constitutional rights of law-abiding gun owners, the highest ranking Democrat in the United States; a person only two succession-steps away from the presidency; is arguing in DC federal court the House could begin an armed conflict against the Dept. of Justice.

BACKGROUND – Federal appeals court judges aggressively grilled lawyers for the Justice Department and the House of Representatives Friday in a pair of intertwined cases that could have major implications for Donald Trump’s presidency and the Democrats’ ongoing efforts to remove him from office.

During back-to-back hearings spanning about three hours, the judges drilled in on the House Judiciary Committee’s dual quests to learn special counsel Robert Mueller’s grand jury secrets and to secure testimony from Don McGahn, Trump’s former top White House lawyer. The two hearings were overseen by two partially overlapping, three-judge panels. (read more)

  1. Just a complete breakdown of law in our country which is why even a other 4 years of Trump won’t be enough to solve most of these deep seeded problems.

Well, you have to admit, fascists are rather partial to a “night of the long knives” operation if that’s what it takes. Right Dougie?

Except in this case they already have the grand jury testimony in hand, they just want these judges to rubber stamp the admissible legality of using it.

    Some people just need aborting.

Agreed – this has been the case since Trump was elected, first with Sessions and then Barr who has been deep state back to Iran/Contra . He is there to make sure nothing ever happens to any of his buddies. Sessions was the same deal. When the DOJ lawyer got asked about whether this has ever happened before where the Executive Branch refused to turn over information to adversaries in Congress, no response. Don’t they remember when Eric Holder was held in Contempt of Congress for refusing to turn over documents on Fast and Furious, all to protect the backside of PINO Obama. Lois Lerner pleading the 5th! What happened then? NADA. And NADA will happen now.

That’s because her son has his tit in the wringer with this Ukraine business, and she knows Trump is going to out the whole scam, so she is freaking out. Isn’t that the way desperate people behave?

Additionally, a lot of the democrat funding she’s so proud of procuring is through monkeyshine like Ukraine and also through doing the socialist bidding of GS. Therefore she stands to lose 3 ways: 1) kid ends up in the joint with a cell mate named Bubba because he was facilitating Mama’s money laundering, 2) GS cuts her off and chooses to finance AOC instead, and 3) she loses other illegal democrat funding channels as well as her angle for insider trading.

      Oh, she’s desperate, alright!!

Strange. I cannot find anywhere in the Constitution or its amendments where any part of Congress has the power to call up an armed anything for any reason. Closest I can find is they can either thumbs up or thumbs down a call to declare war BY THE PRESIDENT, and it is then the PRESIDENT who controls the armed force.

Bingo. All Congress has is a small police force whose jurisdiction is the Capitol building, the various Congressional and Senate office buildings and their grounds, parking garages, etc. A police force, not a military/paramilitary force.

It was an Act of Parliament to create a “guard” without authorization from the King that set off the British Civil War in 1641. Parliament members who voted against the rogue Act in support of the King were then arrested by the Parliamentary “guard” and Britain quickly fell into Civil War.

Tidbit on very early American Colonial history….Mass Bay Colony sided with Cromwell and Parliament, while the Province of Maine was loyal to King Charles I. Cromwell tried and executed King Charles I in 1649 London while Maine was then dissolved and usurped by Mass Bay Colony in 1652. In other words, the Brit Civil War hit the shores of early Colonial America.

I love this Judge Rao (so far). And I don’t know where Doug Letter gets his law from, but the US Marshal service has never delivered a Congressional subpoena to the DOJ and demanded documents under threat. That would be because the US Marshals are a subagency of the DOJ, currently authorized to assist the Federal courts. The sole law enforcement agency of Congress is the Capital Police Force. A small agency with limited arms entrusted with the protection of the body and property of Congress while in session, and the property when not in session. It has a couple jail cells in the basement to hold rowdies. Maybe Mr Letter envisions them kidnapping AG Barr while he is having lunch and holding him hostage for the grand jury material. The Biden Quid Pro Quo.

The Trump-appointed judge’s questioning indicates that she might support Barr’s view of a muscular executive. She seems to point out that the House has alternatives, such as sending over the Sargent of Arms to pick up the documents. The shootout is just taking the argument to the extreme. I wouldn’t read too much into that. Letter makes the point that we are more civilized than that today and they will do whatever the courts demand. It could lead to a very important precedent, that being that the executive branch is actually a co-equal branch of government and neither the Congress nor the courts have the authority to override the executive branch. Congress has its remedy: impeachment. The courts can rule on what is constitutional or not.

I hope that most people still take “co-equal branches of government” as a given.

The REAL issue here is more about “Judicial Activism” and more about “OR” versus “AND”. So, “would Congress AND the Courts have authority to override the executive branch.”

That’s a scary concept, but that is why the Courts have “the political question doctrine.” The Courts stay out of Congress vs Executive arguments about who is more powerful. There is also a rule to skip constitutional issues if it is possible to decide the case on a narrower issue and avoid people using small-cases to bring “big questions.”

That often means “MOOT” (the House already voted for Impeachment, what are you going to do, put Trump on double-secret-impeachment?!) where the House has already acted, so deciding this isn’t going to affect an action that has already happened.
And it often means “NOT RIPE” which can also be “failure to exhaust other remidies.”
So, for example, you can’t use “prison overcrowding” to let EVERYONE out of prison, the remedy would be to ship a few prisoners to a less-crowded facility.

Speaking of alternatives, the House could have acquired the judicial authority from the beginning to subpoena what they are asking the courts to give them now. But they didn’t do that because, why? Oh yeah, purely POLITICAL reasons. In essence, they seek now seek a legal remedy for a purely political ailment. So, there’s that.

We also need a breakdown on which members of Congress are receiving mind-altering medications from that capitol pharmacy we’ve heard about. I this case the HIPPA just has to be suspended for them due to the responsibilities of their positions and the consequences of crazed actions on their part. I’m saying that while being acutely conscious that she’s – what? – third in line to the Presidency if anything bad should happen? Do we want her with her finger on the nuclear launch button???

This all began with the illegal spying on Candidate Trump among others to rig the Presidential Election in favor of the wicked witch of the west. When they couldn’t even win a totally rigged election and We elected Donald J. Trump POTUS. Their goal to knowingly conspire to overthrow a duly elected President rose to the level of treason, sedition, and/or subversion. Given that our nation has been at war since congress authorized our War on Terror (Sept 14, 2001), those particularly heinous crimes fall under the UCMJ (Uniform Code of Military Justice).
If there are ongoing investigations, netting more and more previously unknown conspirators, I would think everything President Trump does in co-operation with investigators, would all be classified. Especially to those currently under investigation. So for all of those desperately searching for a crime to justify their attempted coup d’etat, they can all;k go pound sand. The jig was up a long time ago, and nothing can stop their imminent tribunals.
    Executive Order 13825 of March 1, 2018
2018 Amendments to the Manual for Courts-Martial, United States
As of Jan 1,2019, those subject to the UCMJ have been expanded to include civilians that have been charged with treason, sedition, and crimes against humanity/children. Sure explains why the MSM, and Hollywood lunatics tied to Epstein (Child Trafficking) are totally unhinged, and in a full-blown panic. The death penalty is still very much in play for some crimes, but for the sake of secrecy within the Courts-Martial, they just pass it off as Acute Terminal Brain Cancer.

I guess Pontius Pelosi – and all those manipulating her – forget that neither she nor they have any – any – lawful authority to order the use of arms, though they themselves may deploy arms in self-defense. Which, you may recall, they want to outlaw. Of course, they will retain their armed bodyguards. But remember, contracting with others to use arms in the furtherance of unlawful activities is conspiracy to commit, among other charges.
