The U.S. DOJ led by Attorney General Bill Barr celebrates the conviction of Bijan Rafiekian, 67, of San Juan Capistrano, CA, along with his co-conspirator, Kamil Ekim Alptekin, 42, of Istanbul, Turkey & the Michael Flynn Intelligence Group for: “conspiring to act as an agent of a foreign government, conspiring to make false statements and willful omissions in a FARA filing, and acting as an agent of a foreign government.”
Despite the incredibly sketchy nature of the case; and despite a possibility any conviction will be dismissed by presiding judge Anthony J. Trenga; a jury has convicted Rafiekian, Alptekin and the Flynn Intel Group of not filing the correct FARA paperwork and therefore evidencing a conspiratorial intention to falsify documents.
DOJ Press Announcement – After three hours of deliberations a federal jury convicted a California man today on charges of conspiring to act as an agent of a foreign government, conspiring to make false statements and willful omissions in a FARA filing, and acting as an agent of a foreign government.
John C. Demers, Assistant Attorney General for National Security, G. Zachary Terwilliger, U.S. Attorney for the Eastern District of Virginia, and John P. Selleck, Acting Assistant Director in Charge of the FBI’s Washington Field Office, made the announcement after U.S. District Judge Anthony J. Trenga accepted the verdict.
“Today’s verdict should stand as a deterrent to any malign foreign influence that undermines the integrity of our political processes,” Assistant Attorney General John Demers said. “Through misrepresentations in his FARA filing, Mr. Rafiekian attempted to deceive the public and influence key leaders on behalf of Turkey. The Department of Justice treats these crimes with the gravity that they deserve.”
“Rafiekian was held accountable for his actions and found guilty by a jury of his peers,” said G. Zachary Terwilliger, U.S. Attorney for the Eastern District of Virginia. “I want to thank the investigators and prosecutors for their thorough investigation, extensive briefing, and commitment to this case.”
[…] According to court documents, the purpose of the conspiracy was to use FIG to delegitimize the Turkish citizen in the eyes of the American public and United States politicians, with the goal of obtaining his extradition, which was meeting resistance at the U.S. Department of Justice. At the same time, the conspirators sought to conceal that the Government of Turkey was directing the work.
However, not only was Rafiekian told by Alptekin that Turkish cabinet-level officials had approved the budget for the project, but Alptekin also told Rafiekian that he provided the Turkish officials updates on the work. Rafiekian understood that Alptekin was relaying the Turkish officials’ directions on the work to Rafiekian, Flynn, and others at FIG.
According to court documents, the scheme included using a Dutch shell company, Inovo, owned by Alptekin to act as FIG’s “client.” FIG was paid $600,000 in three installments from an account in Turkey in Alptekin’s name. After Alptekin made the payments to FIG, FIG kicked back 20 percent of the payments to Alptekin’s company in the Netherlands, with two such kickbacks being made.
Rafiekian faces a maximum penalty of 15 years in prison when sentenced on October 18. Actual sentences for federal crimes are typically less than the maximum penalties. A federal district court judge will determine any sentence after taking into account the U.S. Sentencing Guidelines and other statutory factors. (DOJ LINK)

The troubling aspect of all this to me is that acting as agents of a foreign government should rightly be a violation of law if it isn’t properly reported. But in this case it appears the government cannot get a conviction on so-called ‘murky’ FARA law outside of a purely political persecution, which will surely be overturned on appeal.
To me this means that we will continue to see corrupt lobbying activity in DC on behalf of foreign governments, run amok. Certainly there’s no desire in DC to prosecute FARA or to amend the law to make it more easily enforceable. As great a President as Trump has been in these short years, one thing is becoming unfortunately clear to me – the swamp is self-sustaining and likely cannot be drained.

I may be very very wrong here, however, as I have been reading, it seemed as though Flynn’s partner knew the Turkish government was behind all of the associations, but Flynn was never told.
Flynn’s attorneys seemed to also have known but never advised Flynn. So General Flynn unknowingly filled out a FARA form incorrectly but not fraudulently.
Anyone know differently?

Yep, I voted for both McCain and Romney and both turned out to be afflicted with unsavory and unpredictable character. I don’t think Romney will be here forever. A candidate like Mike Lee would beat a traditional GOP candidate like Mitt Romney. Romney is a product of opportunity in Utah, mainly due to Romney’s alignment with Utah’s unique culture.
Romney is actually quite in alignment with most aspects of MAGA policy (except notably on the trade issue). However, Romney is really just a foil against Trump’s personality and when Trump leaves office in 2024 the wind will leave Romney’s sails.

He’s milquetoast GOP who arrived at the scene about 12 years too late – he missed the 2006 throw-the-bums-out party when RINO GOP Congresscritters were tossed out due to their utter inability to stand up for Conservative principles.

No, Democrats on the jury wanting to stick it to PDT is what did it. The common thread in General Flynn is what did it. When they looked at Kian, they saw a Trump crony and convicted him on every count they had the opportunity to.
This is why getting any convictions in the DC area against any of those involved in the Russia hoax s impossible. A DC area jury will always be tainted against VSG PDT.

Sometime I feel whole world want to advice to PTrump sometime including me. PTrump won primary, candidate, general election, deep state and PTrump knows from long time what is happening or happened. All people made bad decisions but VSG PTrump fixed them with making bold decision. He hired and fired so many folks in last 2 years from his administration. These are simply precedent rulings that will help drain the swamp and keep the career bureaucracy from using their contacts to aide and abet foreign influencers. Corporations and Private Industry should be the only entities to conduct international business. Enough of this Palace Intrigue. So you have prosecutors making it up on the fly. Then you have a judge that knows that the prosecution is making it up, but still lets it go to the jury…before he rules on a motion to dismiss. And you have a jury that convicts even though everyone in the courtroom, including themselves, are confused. Sounds about right. And we wonder why there’s an opioid crisis in this country?

I have seen this happen in lots of cases. My opinion is judges are not there to see a defendant gets a fair trial but there to make sure the trial reaches a verdict. We really got a lot of either cowardly, bias, or corrupt judges out there. You add in who the defendants are in relation to Flynn and Trump it’s going to be hard to get a fair trial. That’s just the way it is.

This all started before Barr. Does Barr stay out of of it so they can’t accuse him of helping out Trump, again? And the judge can still throw this case out, Powell says it’s ripe for appeal. Just maybe Barr said go ahead to these prosecutors, they got the referral from muellers gang, you own it. I don’t think this exposes Barrr, but exposes the people that set up Flynn. Just my observation.

Sadly it’s easy to forget these days the DOJ, and its Attorney General in particular, are duty-bound to seek justice above and before all else, including zealous prosecution or institutional norms. Meaning yes it’s on AG Barr. And what’s more, his prosecutors would know whether or not to try it, and where the line is. Clearly, none of them acts the slightest bit afraid or deterred.

Trump himself will have to issue the indictments and arrests. And he’ll have to fire Barr and appoint a real outsider like Judge Jeanine to prosecute.
Of course the Swamp Turtle will never EVER confirm an outsider as AG. That’s ok. Trump can just appoint a temporary AG long enough to get another outsider(s) hired on at the DOJ to prosecute the Obama conspirators [It’s not as if the AG himself runs the actual DOJ prosecutions). And Trump can override any AG he disagrees with. The AG is simply an advisor and works for POTUS.
Why does no one ever talk about this? It’s the only real solution. It’s simple. Trump must take full control of his DOJ. The Dems and RINOs will go nuts, but he has full authority over all law enforcement. It’s crazy how this is now somehow controversial.

What makes Barr look worse, Him intervening in this case and being being accused of interfering with something muellers gang started. Or let it go and let the courts make the final decision. Barr has been accused of being Trumps personnel lawyer, staying out of something mueller started that looks like a set up might have been his best option. Last evening, Sundance posted the defendant’s motion Motion To Dismiss. The motion is wort a read, again if you already read it. Powell’s tweets about the verdict are right in line with motion.
The next move will be the defense for motion for directed verdict, that is, ask the judge to overrule the jury verdict. The motion for directed verdict is a necessary step before an appeal can be filed.
The directed verdict motion is due in ten days, as I recall the rules of civil procedure. It should make for more good reading, if you like to read such things.

Judgement NOV, non obstante veridicto – notwithstanding the verdict. But we don’t know what those other government documents were, or what Rafiekien and Alptekin were really doing. If you’re going to advocate for foreign governments you should register, but there should not be selective enforcement for violations, And the penalties should be fines, unless real harm to the country can be shown. With guys like Weissmann around, and there are other prosecutors who lack temperament and judgement, these vague Malum prohibitum laws just empower the Deep State to intimidate those who don’t bow down to them.

It’s really hard to try to explain to anyone what’s actually going on — connecting dots, showing how the media works, the echo chamber, the projection, trillions at stake, what “fascism” actually looks like, etc. — when things like this keep continuing to happen under Trump’s own people.

I read the trial account and testimony. If I was a juror I would have voted guilty.
The only evidence entered that was favourable to Flynn is that he wanted to file a fara with the DOJ, according to one testimony, but the bozo guy didn’t want it filed. As it might have jeopardised their ‘project’. Flynn complied. Stupid move for a former Director of DIA.

Not sure, but there seems to be a hot mess of who knew what when. And including Flynn’s attorneys. Some accounts state that they created extra questions on the form itself that were not part of an official document.

I’m firmly behind innocent until proven guilty. That is the foundation of our legal constitutional system.
Therefore I have not made comments on this case, waiting for it to go to trial and jury.
As just an observer, I would say Flynn knew, faltered, and got himself in a world of trouble. His op ed on Erdogan on the day of the election does not look well for him, as some of his paying business partners were agents of the Erdogan faction and wanted Gullen extradited. One of his employees, and a witness, said that they wrote an 80 page report on Gulen (Erdogan’s target) and could find nothing that violated the law that would lead to extradition.
I have serious doubts that Flynn was incognisant of the facts. Unless we see him as an incompetent, or blinded by some ideological persuasion. Who knows? That is for Ms Powell to suss out.
What unanswered questions I have, not to stir the pot, is what was Gen Flynn’s role that led to the Benghazi debacle. After the event, he was promoted and named as director of the DIA under Obama, until that went sour.

He was promoted to head of DIA starting July 2012, several months before Benghazi.
I suggest listening to several interviews he did in 2016. One with John B Wells in August 2016 covers a broad field of topics. He begged off on Benghazi questions because it’s all classified, but said the level of deception coming from the administration was demoralizing (paraphrasing). He also was wary of both Erdogan and Gulen (who, he pointed out, started out working together, and Flynn seemed negative on both).
One thing’s certain: L’affaire Flynn is just fishy. As to whether he knew the Turkish government was funding the lobbying — I can’t believe Flynn ever would NOT know who was funding his work. So, if we take that at face value, the only plausible explanation for how he could’ve face-planted so spectacularly on FARA — while serving as an advisor to one of the major presidential campaigns, poised for a top intelligence post — is that DC is crawling with unregistered foreign lobbyists, and Flynn just never thought he’d be the one guy to get snared. But, really? I just can’t buy what’s presented so far. Unless you’re a democrat, you don’t secretly lobby for a foreign government on a sensitive foreign policy issue right before you’re about to become NSA.
Flynn’s not dumb; there’s no way he doesn’t know the “six ways from Sunday” they have to come after him, and I certainly doubt he ever believed they weren’t after him.
It’s all fishy and I hope we learn the whole story. To me it seems more plausible Flynn was working on something with DIA on the down low, and ended up the conspirators’ most-wanted list, either expectedly or unexpectedly.

What ever was planned that led to the Benghazi debacle was militarily within the purview of the Director of DIA. Or it’s staff. It didn’t happen on a whim. What was his role?

General Flynn is too knowledgeable about intelligence and the Mid East for me to believe he has bee a babe in the woods through this mess. I have floated in the Treehouse recently a theory that he may be hunting the hunters by deliberately setting himself up as bait. Time will tell if I am right or not.
The good General was furious about the Bengazi debacle, and rightly so. It was a horrific betrayal of good men in HRC’s effort to silence her gun runners. Flynn had some good things to say about Erdogan in his book, “Field of Fight”, which surprised me some after seeing him being demonized so often in the media. Gulen, not so much. As in Evil! (My word, not Flynn’s.) He’s got a wide Islamist foothold in our country, and that should creep the bravest of us out. There was also the brutal humiliation and murder of Muammar Qaddafi and the decimation of Libya that must also be reconciled. I think our good General is on a mission.

The Mueller testimony is a set up, but that tired old man, could not even read his parting statement with any vigor. He will fail and if Barr is on the wrong side of this moment in history, he will fail too. But , why.
Trump should declassify and not wait for Barr, anymore.

We are fooked. There is no law except connections and power. They are not trying to hide it any longer. Everyone is to know that if you are within the family, everything is pemitted; outside everything will be prosecuted. Pappa Barr will take care of you if you cooperate. Otherwise, you are left to the mercies of a DC jury.
Wake the f up, Donald Trump! You are our only hope.

Doesn’t precedence show that anyone that has these issues brought up, if they are brought up, are allowed to redo/backdate their paperwork, like the Podesta’s did?

We need to start taking into consideration political affiliation in the selection of jurors in politically charged cases. I am tired of all Democrat juries deciding these cases. It’s worse than the 9th Circuit, because deference is given to juries in deciding questions of fact. If the 9th Circuit botches a question of law, SCOTUS can fix it, but once an Eastern Virginia jury of DC technocrats decides a question of fact against you, you are screwed. Ask Scooter.

In this day and age in which one can’t even go out to eat at a restaurant for fear of being shown the door for one’s political views, this is just common sense. Which is probably why I’ve never heard of it being done.

Prosecutors have been lax on FARA violations because our crooked DOJ and FBI want a “legal” opening to seek FISA warrants on individuals breaking these laws so that they can spy on them. 57% of lobbyists routinely break FARA laws.

Not to worry. I know it looks gloomy and that things are getting worse not better a the DOJ but one sided justice is clearly over.
Even though 2 members of the Flynn Group got A/G Barr’s DOJ DC conviction and imprisonment book thrown at them for questionable legal reasons and will likely join Manafort for the next 20 years in prison for doing what several Dem lobbyists have done for decades, the other side also got hit equally hard today by the Trump administration.
P Trump scolded moderate FNC Host Martha McCallum on Twitter for lobbing softballs at anti Trump Rep. Swallwell and condemned FNC for not being what it once was.
