“Another coworker immediately started lecturing me in front of everyone about how this was grossly cis-heteronormative and that rather than forcing an identity on my child because of genitals, I should cultivate an environment in which the child would be able to flourish and explore the play of gender,” he continued. “This went on for fifteen minutes.”
A prime example of why Dr. Michael Savage calls liberalism a mental disorder. I don’t think many Treepers would last too long on one of today’s college campuses, except Hillsdale and a few others.

The video, seen here:
OMG – that was a wake up call.
Spooky.
Time to turn them all out into the streets.
We HAVE to stop this now.
That video is a clarion call.
LikeLiked by 2 people
With all respect, if this video is a wake-up call then you haven’t been paying attention. You are forgiven if you are, say in your 20s. Welcome aboard. The task at hand is large. It is tough and you sometimes you will want to bow out and take a breather. That is understandable. But stay the course. Use that passion implied in your all caps OMG to unseat the corrupt uniparty.
Which of us, when we vote, vote for the party? I surely don’t. I vote for the candidate. (That does not mean I would vote for a D, I surely do not.) Perhaps you will like to know more about what they in the video only touched on; to sit on a committee – divided in ‘A’ list, ‘B’ list, ‘C’ list – the Congresscritter buys his seat, payable to the party. One million dollars is the starting point. It goes up from there. The Chair of an A list committee, such as House Oversight goes for Ten million.
That means they have to pick up the phone to call donors to ask for even more money. So Congress spends a lot of time asking donors to step up. And they must attend fund raisers and and actively campaign for others in their party and other such party business.
Perhaps we should be thankful so little official business gets done. When the Congressman in the video shows his calendar and squawks about his long work days, does he mention what he actually does during those hours? Well, I just gave a glimpse of that.
What if they say no to the party? The party will make sure they are not invited to social gatherings and dinners where the real dealings are done. Their wives will be blackballed at social functions. They will be denied benefits to Congress bathrooms, exercise equipment, parking privileges, apartment rentals, and so on.

“how ‘the swamp’ works,”
We kind of had the same setup here in NY state for years, we call it “three men in a room”. The Governor, the state senate leader and state leader of the assembly. They make ALL the decisions on even what gets out of committee or comes to floor for a vote. Everyone else that is elected is just there for state constitution “window dressing”.
Not really surprised that Washington is three men in a room and one woman. It is why the donor class gets their legislation, but the voters do not get theirs, such as concealed carry reciprocity and the Second Amendment Guarantee Act.

I think the easier question is who didn’t know? As I said yesterday on this post, who didn’t see this coming? Maybe I am surprised that it happened so soon, I thought at least by summer. But surely it would happen.
A pure stroke of genius, President Trump offered tariff exemptions to those countries which made concessions to the USA. South Korea did and that put them at a competitive advantage. China had to follow suit.
It is interesting that President XI did this immediately following President Trump’s tweet saying that no matter what happens they will always be friends. Veiled threat? Connection? Maybe/maybe not.

“Check out RR’s wife.”
I did and I am glad that you asked:
Lisa H Barsoomian a US Attorney that graduated from Georgetown Law she’s a protege of James Comey and Robert Muller
Barsoomian with her boss R Craig Lawrence represented Bill Clinton in 1998 Lawrence also represented
Robert Muller three times
James Comey five times
Barack Obama 45 times
Kathleen Sebelius 56 times
Bill Clinton 40 times and
Hillary Clinton 17 times
between 1998 and 2017
Barsoomian herself represented the FBI at least five times
You may be saying to yourself, okay who cares, who cares about the work history of this Barsoomian woman.
Apparently someone does.
Someone out there cares so much that they’ve purged all Barsoomian court documents for her Clinton representation in Hamburg vs. Clinton in 1998 and its appeal in 1999 from the DC District and Appeals court dockets
Someone out there cares so much that the internet has been purged of all information pertaining to Barsoomian.
Historically this indicates that the individual is a protected CIA operative.
Additionally Lisa Barsoomian has specialized in opposing Freedom of Information Act requests on behalf of the intelligence community
And although Barsoomian has been involved in hundreds of cases representing the DC Office of the US Attorney her email address is Lisa Barsoomian at NIH gov.
The NIH stands for National Institutes of Health.
This is a tactic routinely used by the CIA to protect an operative by using another government organization to shield their activities.
It’s a cover, so big deal right, I mean what does one more attorney with ties to the US intelligence community really matter.
I mean with Trump and his
recent tariffs on Chinese steel and aluminum imports,
the border wall,
DACA,
everything coming out of California,
the Uniparty unrelenting opposition to President Trump,
the Clapper leaks,
the Comey leaks,
Attorney General Jeff Sessions recusal and subsequent 14 month nap with occasional forays into the marijuana legalization mix,
and last but not least Muller’s never-ending investigation into collusion between the Trump team and the Russians
Why does Barsoomian, CIA operative, merit any mention
BECAUSE
she is Assistant Attorney General Rod Rosenstein’s WIFE
That’s why.
Barsoomian’s loyalties are tainted.
How could this not have influenced Rosenstein?
This clearly violates the appearance of impropriety attorney’s rules?
Both owe their careers as US attorneys to Muller, Obama, Bush, and the Clintons.
impartiality? that’s impossible.
Rod Rosenstein has no business involving himself in the Hillary Clinton-DNC funded Steel dossier, and the ongoing Russia investigation.
Much less the selection of his mentor and his wife’s mentor Robert Muller as Special Counsel.
The rules of ethics, funny, required his refusal.

lawrencepaul1, I think they are only using McCain’s name to rubber stamp it as bipartisan “concern”. If I recall, McCain’s name pop’s up as handing the Clinton dossier / document to Comey in Dec’16 (post President Trump’s victory) whereas FBI used it for FISA warrant in Oct’16 and they started investigation just before or immediately after RNC convention in Jul’16.
Is my understanding incorrect? Just honestly asking for clarity.

It was McCain who gave the FBI the British intel file and first brought them into the mix.
LikeLike
lawrencepaul1, is British intel that you are referring different than the Clinton dossier?
A quick search on “McCain’s link to clinton dossier” indicates that it was Clinton dossier that McCain handed to FBI (Comey?). If it was Clinton Dossier then I believe that was used to secure FISA warrant. If it was used to secure FISA warrant then Clinton dossier was with FBI (FBI was working with Steele because of his impeccable reputation in the past) much before McCain gave it to FBI. Then before McCain it was Reid / Brennan who were also in the mix.
I am not trying to confuse anybody but more like trying to untangle my understanding if it is incorrect. I do not want to end up being a fool when I argue with someone anti-Trump with my understanding – oh and I argue a lot with these folks since I am surrounded by anti-trumpers and have to preserve my reputation of never losing a logical, fact-based argument(s) :).

Many so called investigations into the DOJ/FBI/Deep state/Clintons/Obama WH that have been ongoing for over a year. Not a single search warrant has been issued or early morning raids of swamp critter’s homes and offices have taken place. Not a single indictment or arrest. Only one person even teminated from employment and that was a clown show at the last min. McCabe should have been fired 17 months ago.
One investigation on going to bring Trump down. Only persons arrested and residences searched in the pre-dawn hours have been close Trump advisors. Facts speak for themselves. This is a witch hunt to bring down Trump. Everything else IMO is kabuki theater that will lead to nothing. Results so far speak for themselves.
It will just be a matter of time, days, weeks at the most, until Trump’s personal attorney is indicted. You don’t execute 4 search warrants and seize evidence w/o indicting the target.
Who’s next? It will be someone close to Trump. Count on it.
Mueller and his goon squad are wasting no time while the so called swamp critter hunters are taking their own good time putting out the fire while the house is ablaze.

McCain LIED to get sympathy OR The elite have health care WE DO NOT.
NYT 2017/07/20 “Senator John McCain has glioblastoma, an aggressive type of brain cancer, his doctors said on Wednesday.”
Mayo Clinic College of Medicine and Science – “Glioblastoma can occur at any age, but tends to occur more often in older adults. It can cause worsening headaches, nausea, vomiting and seizures.
Glioblastoma, also known as glioblastoma multiforme, can be very difficult to treat and a cure is often not possible. Treatments may slow progression of the cancer and reduce signs and symptoms…..”
Cancer Survival Rate Information
“…Glioblastoma brain cancer is an advanced cancer form that claims many lives each year….
Glioblastoma brain cancer is among the most severe forms of that dreaded condition known as brain cancer…
The glioblastoma brain cancer prognosis is traditionally a grim one, as this form of cancer is generally associated with glioblastoma brain cancer stage 4. At this stage of the disease, tumors are growing rapidly and invading organs and tissues that surround the brain.
Symptoms of glioblastoma brain cancer can include physical symptoms such as severe headaches, vomiting, and seizures, as well as significant memory loss and personality change.
Sadly, the glioblastoma brain cancer survival rate is not optimistic, with the average survival rate for this condition standing at a maximum of 14 months.[…]
That means McCain should have LESS THAN 6 months to live with rapidly worsening symptoms.

Our worst enemies are the right-wing virtue signallers who can’t vote for the Republican candidate because he/she isn’t good enough for their imagined “principles.” Or their lame excuse that a swampy candidate won’t cooperate with the President. The President is doing very well at getting things done when you consider the total opposition he faces, that’s his job to twist arms. No excuse to let a Dem in.

Ok, let me get this straight: if I don’t want to vote for a rino that means my principals are “imagined” and my virtue must be too. And knowing that a rino will be as much help to PT as a democrat is a ” lame excuse”? So I should abandon my imagined principals, because holding my nose is the real virtue, and vote for the communist from column A instead of the communist from column B, because that’ll be so much better for everyone, and at least I won’t be a snowflake? Good try at taking an orange, twisting it into a pretzel, and selling it as an apple. No thanks, I’ll take the “failure with honor” option because it’s really the only outcome either way until we fix voter fraud and get better candidates.

I do think the Judiciary can be petitioned to screen the documents and decide what is allowed to be public, and what must be protected under attorney-client privilege. There is a great deal we don’t know about this warrant, ie. How broad it was? What did they actually take out of the office? Paper files? Computers? Cell phones? Associates’ records?
The media: if personal information of other clients is released – could the MSM be subject to legal action?
Regardless. As the story currently stands, it sounds like jackboot action undertaken by the FBI. Frightening for its implications…

I hit the wrong channel, and caught a segment on MSNBC just now. They seem to have sources saying this stems from a Russia businessman that has given money to Trump, that they are trying to tie to campaign funds. Remember Cohen is Trumps attorney for all his businesses as well as personal finances. This has to be still trying to dig up connection to illegal campaign donations from a foreign source. It’s more than enough to get a judge to look into it, it is just wrong to expect fairness here.

Court filing by MuellerUNITED STATES OF AMERICA v. PAUL J. MANAFORT, JR.,
Defendant.
No. 17-cr-201-1 (ABJ)
Mueller’s filing includes a quotation from DOJ’s discussion of special counsels making it clear that it’s normal to investigate crimes that might lead someone to flip.
“[I]n deciding when additional jurisdiction is needed, the Special Counsel can draw guidance from the Department’s discussion accompanying the issuance of the Special Counsel regulations. That discussion illustrated the type of “adjustments to jurisdiction” that fall within Section 600.4(b). “For example,” the discussion stated, “a Special Counsel assigned responsibility for an alleged false statement about a government program may request additional jurisdiction to investigate allegations of misconduct with respect to the administration of that program; [or] a Special Counsel may conclude that investigating otherwise unrelated allegations against a central witness in the matter is necessary to obtain cooperation.”
Remember this phrase…it expands Mueller reach exponentially to infinity:
“investigating otherwise unrelated allegations against a central witness” if it’s “necessary to obtain cooperation.”
Anyone who did anything with Trump is now a target. They are not safe in their home, office or workplace.
Who will ever sign on to defend Trump?
We must now wait for Judge Jackson’s ruling to see if the courts bless Mueller’s self expanded authority

Mueller requested info on 5 of Manafort’s cell phones:
“They may be seeking “historical cell site information,” which helps investigators determine when people were near each other at a particular time, said Rodgers, a former federal prosecutor. They may have subpoenaed phone service providers to obtain the contents of a phone, such as emails and texts, she said.”

This has to stop. These investigations must have clear and defined limits. Otherwise, the Deep State will continue to destroy us and subvert our will. No future “outsiders” will ever run for office (and yeah, I know that’s THE desired outcome of the cabal.)
This is one time when I wish we could have an emergency national referendum on specific legislative action-similar to the propositions we sometimes vote on at local and state levels. Congress won’t do it for us and POTUS is one man. Has there ever been ANY kind of national referendum -where the people voted directly to pass specific laws? We don’t want to change the constitution—we want to bring accountability and limits to agencies who no longer adhere to it. I didn’t realize how dire the situation is until I realized that we don’t have any options If Congress won’t take action.
The colonists presented their grievances to the British Parliament and asked for redress before any shots were fired. They did everything they could to avoid bloodshed. Their premier issue was taxation without representation. Besides POTUS and a handful of Congressional members, where is OUR representation in Washington, DC? We didn’t elect the people who are trying to take out our president. How is this not tyranny?
It’s time for us to organize and petition Congress. The historical record needs to show that they were given opportunity to redress our grievances. I don’t know how to go about doing this but I intend to find out.

“He can use his pardon power to shut down Mueller’s prosecutions and leave him on board to continue his collusion investigation. He could use it to pardon all of Mueller’s cases that extend beyond the collusion investigation. At this point, that is all of them. He could pardon Flynn. He could pardon Manafort. If Mueller is a threat, he has now given the President grounds to fire him — remember his comment not long ago: nothing in this investigation has led back to any wrong doing by the President.
If Mueller is not a threat, then he will not be fired. At that point, one has to wonder what useful role is Mueller playing (perhaps unwittlingly)? Shed light on the campaign donations and connections between one Victor Pinchuk (involved in steel pipe, interesting) and one Hillary Clinton…
Never destroy your enemy when they are destroying themselves.
And there can be no impeachment if the House doesn’t go for it — so make sure that kangaroo court doesn’t happen. aka. get out and vote, vote wisely and well
What has happened in Asia lately to cause China to be so obliging — after of course getting to save face?
And why is it that people who are so skeptical of the white hat/black hat scenario within our government (which they should be: human nature doesn’t lend itself to such dichotomies) so willing to buy that a certain ME leader is a totally for real good guy? How can human nature work on one, but not on the other? (ps. I think he’s an opportunist…and not a very clever one at that — which is not our problem, but his, and thanks to our own band of not clever, corrupt opportunists we have to deal with him now…but the chances of war are in truth very low imohao of course).

I’m a big believer in PDJT and I wish him well. But I’m also a believer in Occam’s Razor. That’s the theory that, to understand a complex problem, choose the solution that makes the fewest assumptions.
The real debate here is whether PDJT and a carefully selected senior team are playing out a well thought out plan to drain the swamp (the often promised but still elusive BIG UGLY) or whether PDJT is surrounded by people who may appear to be White Hats but are in reality controlled by the Deep State.
Just make a list of what one has to ASSUME about key people and key activities to make the Big Ugly/Drain the Swamp multi dimensional chess game plausible. To wit:
1. You have to ASSUME Sessions is White Hat despite his recusal from campaign related issues and, more importantly, his multi month abdication of AG responsibilities in Swamp activity OUTSIDE OF HIS NARROW RECUSAL. Most of what is hamstringing our President has nothing to do with Russian collusion in the campaign and Sessions is letting it all happen. He could have tightened the leash on Mueller and Rosenstein a long time ago and he did not.
2. You have to ASSUME Mueller was hand picked by PDJT and is really going after the massive criminality of the Deep State, obvious to all who are honest, despite the staff he has hired and the actions he has taken (all against PDJT allies and ZERO against Hillary and her Swamp acolytes).
3. You have to ASSUME Rosenstein is White Hat despite all the Swamp supporting or Swamp excusing activity he is presiding over – with NO corresponding action against anything Swamp.
4. You have to ASSUME the IG is going to drop a MOAB soon (it’s always soon, never today) despite the Judicial Watch and other inputs that IG’s are where truth goes to die and no one can cite a single IG report that really led to anything meaningful ( I don’t count rearranging deck chairs or “mistakes were made, lessons were learned, and we will do better in the future”). I mean criminal referrals leading to indictments, prosecutions and jail time. It doesn’t happen in the Swamp.
5. You have to ASSUME House and Senate investigations will lead to anything. The Swamp just plays with these dopes. A teenager would love to have one of these committee chairs as a father. He/she could get away with anything. Nunes and Grassley are the only exceptions and they, too, are being hamstrung.
6. You have to ASSUME that massive DOJ investigations (run by career investigators and prosecutors) have been long underway investigating the massive criminality that is as obvious as the nose on your face (Hillary e-mailgate, Uranium 1, Clinton Foundation, FISA abuse, unmasking, lying under oath, leaking classified information, et al) and yet not one single leak or tip has come out in over a year.
Etc., etc., etc.
Unfortunately, I conclude that the simpler solution (i.e.. fewer assumptions) is that PDJT was somewhat overwhelmed early in his tenure (understandable) and took the staffing advice of closet Swampers who talked him into filling very important positions with very clever Deep State operatives (Sessions, Mueller, Rosenstein, Priebus, McMaster, Wray, etc.) who are now playing their assigned roles to basically render the Trump Presidency null and void. He now knows this, is changing what he can at this late date, but it’s too late to get back on a winning streak before the mid terms and likely House flip.
I will believe this until I see one (just one) significant action (i.e. impacting a Senior Swamper) that tells me any of PDJT’s key people are on his team and really part of the oft promised 3D chess game.
Until then, I reluctantly bow to the wisdom of Occam’s Razor. It’s the best explanation of complex human behavior known to man.

Good morning. That is pretty good, i would like to comment on:
2) “Mueller was hand picked by PDJT” – The “swamp” picked “Bumbling Bobby” Mueller – http://www.tabletmag.com/scroll/257335/robert-muellers-beltway-cover-up
4) “IG’s are where truth goes to die” – That was true under 8 years of BHO. PDJT has taken ALL 47(?) IG’s off the leash and unmuzzled them.
“indictments, prosecutions and jail time. It doesn’t happen in the Swamp.” – Which is why a team was brought in from outside the “swamp” to deal with it.
6) “yet not one single leak or tip has come out in over a year.” – That is exactly how “things used to be” 30-40 years ago, which is what AG Sessions said he wanted the DOJ to go back to.
“it’s too late to get back on a winning streak before the mid terms and likely House flip.”
If President Trump thought it was too late to save the country and stayed in cozy Trump Tower, we would not be having this discussion now, would we? I am sticking with the plan that PDJT has and he has my full support.

Your theory:
1. Assumes PDJT didn’t understand how messed up the Government is.
2. Assumes PDJT was overwhelmed.
3. Assumes PDJT was naive enough not to recognize bad advice.
4. Assumes PDJT was not able to identify Deep State operatives on his own.
5. Assumes PDJT allows people to “talk him into” decisions.
6. Assumes that every important position POTUS has filled has been a bad decision.
7. Assumes that we are not currently on a winning streak.
It’s nice that you wish POTUS well, but if you truly apply Occam’s Razor then your theory has more assumptions.

Where are they screaming about why it is okay for the Aman brothers to claim attorney client privilege?
Where are they calling for Wassermann-Schultz’s head?
Once none of these Quislings squawked when Mueller had the temerity to subpoena Paul Manafort’s former attorney it was only a matter of time before they raided Michael Cohen.
These raids would never be done to Obama or Hillary. We would hearing screams of racist and misogyny.
I’m fed up with the double standard and ashamed to be an American where there is no rule of law.
I have zero respect for clueless Sessions. I always had my doubts about him for AG. Only someone who resided in the swamp for too long would have voted to confirm RADICAL Holder for AG and make Rosenstein number 2 at the DOJ. The DOJ needed to be fumigated.
I’m also sick of hearing that Mueller was a marine. BFD, he’s also a corrupt piece of garbage.
What we are witnessing is not a coup against Trump. It is a jackboot on the throat of the citizens of the US who voted for Trump and a threat to any outsider who ever contemplates running for POTUS again.
The corrupt Uni-Party will authorize the Deep State KGB to throw the book at you. And you dumb #@%*’s who think you vote for who the president is, well, think again.

yeah. get that totally. But the rats have been inside the walls for a long time while we mostly went on with our business. I suppose you could at least say that they’ve now been exposed to the sunlight and the infestation is well-known. Even that’s an accomplishment. We’ve de-legitimized the media, the Clintons, the Obamas, Congress, etc. and now we’ve de-legitimized the security services, special prosecutors, the judiciary etc. In a long war, that’s a decent victory in an of itself. Not sure our generation will live to see the Promised Land(not sure we even should given what we allowed to happen on our watch) but your kids likely will. You’re probably right, but it shouldn’t even require proof of a negative. What it should require is proof of the allegation and any doubts whatsoever negate that allegation. Mattis supposedly said no proof from last year, and if you really listen to all these politicians they always hedge with weasel words. IMHO, after Bush43 WMD, and after Trump’s clear campaign, that is more than enough to dismiss these fools out of hand.
Trump must demand they pass a standalone declaration of war in this election year. Put their damn votes on record for all to see.

I know. But there is absolutely no reason for Trump NOT to demand Congress authorize all action. On record. Votes. It couldn’t be simpler. Just announce there will be no more action until Congress authorizes it. This requires no perfect world. Just a tweet! But better yet, a press briefing walk-in which will get televised and send shockwaves into every Congress member’s soul. Let’s see them talk their way out of it.
Point is, if Trump does not demand it, then he is actively taking part in the Constitutional destruction by letting the neocons run the show. This is an election year. There never could be a better time than right now.

Why do you thinks they make their women wear Burkas? Once again…they live in a desert…
Not many women around and men will be men…so they cover up their women to limit the temptations to other men…
Then what happens?…..Hey..check out that goat over there…looking kind of nice…or the worse case…The children did not have to cover up..

If news breaks that Trump has forced Mueller out, Wertheimer believes that “the country will explode.” For the resistance, the trick is making sure the explosion is sustained. “That means people in the streets, demonstrations, marches, folks coming to Washington, a massive lobbying effort in Congress,” he said.

3) The more explicit exponents of 4-d chess (like Wictor etc etc) are so intelligent, absorbing and persuasive, it is impossible not to consider their opinions seriously. I am just certain about two things: first, Trump is a VSG, a godsend, and the best thing to happen to America in my lifetime. Second, America is in thrall to Corrupt Evil-doers from top to bottom, in every jurisdiction, and across the fruited plain.
5) Three other things.
6) First, a poster somewhere made the comment that Trump repeats how Mueller is on a “witch hunt.” There is only one witch known to all.
7) Second, Sundance has proved that witnesses are cooperating and outside prosecutors are engaged. We know other prosecutors are busy in Arkansas and elsewhere.

I share in some of your confusion. The fury and strength of the resistance didn’t surprise me. I was even less surprised by the GOP leadership who I believe may present even more danger to the President now than the Dems.
What surprises me to this day is the near unanimous strain of hate in the media toward this President, and a total disregard for reporting any positive news whatsoever.
I believed that by this time at least in his presidency, the President expected that there’d be at least some semblance of fairness and accuracy in reporting. At least I expected it. That was not to be.

I NEVER expected anything less than total hatred and made up Fake News from the media.
After Clinton was elected a friend of mine confidently said the media would start reporting objectively on him, if only for the salacious and titillating aspect. By then, I understood the media was Fake News and just extremely sophisticated propaganda.
And the media continued to defend Clinton every day of his presidency.
I am confused as I never have been by the motives of the various news makers, and the precise details of who is doing what and why, foreign OR domestic.
I think this is in no small part exactly what Trump wants, for many reasons, not the least is to prevent Fake News from ever attaining a consistent hold on the Narrative. But as I say, for many other reasons too.
The few indisputable hard facts are all very encouraging.

… and then … one thing the raid on Cohen achieved was nobody talking about false flag chem attacks and looming Syria action. ( I checked, 2,245 comments already on the two Mueller threads last night ).
I can’t stand most conspiracy theories because they swamp the legitimate questions we have, but if there ever was a set of events that looked coordinated, I would say this is it. The day that Syria is the big topic, and Bolton’s first day also sees the raid on the President’s lawyer. Immediately every Trump supporter rallies behind Cohen and Trump ( rightly of course ) leaving no oxygen for questions about the Syria scam.
Conspiracy or not, this is a win-win for deep state actors because they might get what they want in Syria with Trump that even Obama chickened out from doing. And, Trump loses a chunk of his supporters along the way as a deep state bonus.

Most adults in the USA are well aware of this and know a criminal can talk frankly of his crime with his attorney so the attorney can then figure out a way to help his client evade the consequences of his actions. This raid on the LAW OFFICES of an attorney who HAS NOT BEEN INDICTED with any crime, is so far out of normal rule of law, it is jaw dropping.
STATE BAR OF CALIFORNIA!
“The [lawyer-client] privilege has been a hallmark of Anglo-American jurisprudence for almost 400 years … Its fundamental purpose ‘is to safeguard the confidential relationship between clients and their attorneys so as to promote full and open discussion of the facts and tactics surrounding individual legal matters … Although exercise of the privilege may occasionally result in the suppression of relevant evidence, the Legislature of this state has determined that these concerns are outweighed by the importance of preserving confidentiality in the attorney-client relationship.’” Justice Katherine Werdeger for the majority in Costco Wholesale Corp. v. Superior Ct. (2009) 47 Cal.4th 725, 740-741 (Costco)….
Any party claiming the lawyer-client privilege has a burden to establish the preliminary facts necessary to demonstrate that the communication was made in the course of an attorney-client relationship.
“Once those facts sufficient for a prima facie claim of privilege are demonstrated, the communication is presumed to have been made in confidence and the burden shifts to the opposing party to establish either that (1) the communication was not confidential or (2) the privilege does apply.” (Id., p. 741.)” https://apps.calbar.ca.gov/mcleselfstudy/mcle_home.aspx?testid=34
That article goes into the tests for attorney-client privilege.

This was a very clever move by Mueller. He can’t find anything on Trump, so he goes nuclear.
If Trump fires him, Democrats will say it’s obstruction of justice and enough Republicans could be convinced to go along with impeachment. If he doesn’t fire Mueller, the FBI now has all kinds of privileged communication to scour for anything remotely illegal, and all they need are some technicalities.
I don’t know the best response, but Horowitz and Huber should immediately assign a team to investigate this warrant and search. They should review ALL communication between the people involved.
From what I’ve read about the basis for the warrant, it is probably legal (Trump’s statement that he didn’t know about the deal Cohen made with Stormy Daniels opened the door for this), if only technically. That said, I don’t believe for a moment that anyone involved thought a decade old possible affair justifies violating the attorney-client privilege of a sitting President. The intent here was almost certainly criminal (at the very least obtaining evidence to which he otherwise would not have access under the fraudulent pretense of seeking it solely in the Daniels matter), and it’s likely there is evidence of that.
Demonstrate that intent and immediately charge Mueller, but don’t fire him. There are plenty of crimes with which he could be charged, and he could justifiably be held as his release would allow him to continue his criminal conspiracy. In the interim, additional charges could be filed.
Trump is in a very difficult spot here, and it looks like a possible Catch 22. He needs to outsmart those taking him down, and they just made a masterful move.

This is just like the Manafort case. Make up some obscure issue. Get a warrant from a compromised judge. Read through all the documents. When you find something else save it for phase 2. Indict the defendant. Make him spend millions to defend himself or break him and make him plead guilty to some bs process inflation. Rinse and repeat.

I just read the agreement between Cohen and Daniels, upon which the legal justification for the search rests.
Trump may have a very quick way out of this that would invalidate the warrant and potentially prove the actions through which the warrant was attained criminal.
Two facts would govern this.
First, what powers of attorney has Trump granted Cohen? If Cohen has powers of attorney that would allow him to enter such agreements without consulting Trump (which seems pretty likely to me), they should immediately release those publicly. This could establish both that the agreement with Daniels was valid, with Cohen signing on behalf of both Trump and himself, and it would support the fact that the agreement would remain valid even absent Trump’s knowledge of it. Nothing in the agreement would have required Trumo’s knowledge of it, and thus the default position – to believe both Cohen and Trump that Trump didn’t know about it, would have to be accepted.
Second, if the FBI did not exhaustively pursue knowledge regarding Cohen’s specific powers of attorney, including all legally available means that are less intrusive than a warrant and a search, then the warrant would be invalid. If they claimed they did exhaust all such efforts, and cannot prove that Cohen refused to provide evidence of his powers of attorney, then, just as is likely the case with the FISA warrant applications, their declaration that they pursued all other available means would constitute fraud.
If the above are true, (which seems likely, and I very much hope they are) Trump’s next move is very straightforward: release a dated (and, if needed, redacted) copy of his agreement with Cohen, and challenge Mueller to prove he attempted to acquire this agreement and was unable to do so. If Mueller didn’t, they can then immediately review the warrant application and likely charge Mueller with fraud.

You can read it here:
https://www.vox.com/2018/3/6/17088902/stormy-daniels-lawsuit-trump
Read through the obligations with respect to DD. None of them would require Trump’s knowing about this agreement. It’s also worth noting that the amount was $130,000. While that sounds like a lot of money, Trump probably make $500 million per year, or $1.3 million per day, so the amount might be the equivalent of an hour’s work.
I run a company, and if an employee of mine wasted hours of my time discussing an amount that small, I’d fire them. That leads me to believe Trump didn’t know about the agreement – dealing with pesky things like this is precisely why he has employees like Cohen in the first place. Now he needs to produce the evidence Cohen was suitably empowered to act on his behalf.

TY for this excellent legal analysis. It makes sense. I would hope immediate action would be taken by all damaged parties. In addition Cohen’s attorney Ryan’s statement indicated that their were multiple clients who documents were seized not just Trumps. Not certain if other clients docs was authorized per the warrant or inadvertently seized (which is what I would believe to e the case). After thought, I’m sure you can’t link the agrmt.

Agree. Not just Mueller, but Andrew Weissman and any others involved in the warrant process need to be included. they have violated both attorney-client privilege or work-product protection of MULTIPLE clients per Cohen’s attorney Ryan’s statement and the
A-C privilege goes beyond POTUS capacity as President but also as a private citizen since the timeframe pre-dates 1.20.

Tuesday, April 10, 2018
President Donald Trump is meeting with the Emir of Qatar today at the White House. The president said that he is looking forward to speaking with the emir concerning mutual security and economic priorities.
Since June of last year, Qatar has been under scrutiny for its suspected support of terrorist organizations and the UAE, Saudi Arabia, Bahrain, and Egypt all cut ties to the nation in response. As many of the nations involved in the regional disputes are key U.S. allies, the president is looking to bring unity to the region through a series of meetings and diplomatic summits.
Last week, President Trump urged Qatar and Saudi Arabia to end ongoing disputes with neighboring nations and lead the way in creating peace and stability in the region. In today’s meeting, the president will also likely continue to push for increased cooperation between Qatar and the United States.
As the Lord Leads, please pray:
For wisdom and discernment for President Trump during the meeting today as he navigates the complex diplomacy of a high tension region.
For God to use the meeting today to accomplish his will and that he would guide and direct the president’s words and actions.
For the president to have understanding and direction coming out of the meeting today.
