Secretary Clinton Email Scandal – Lewis Lukens Deposition (Transcript pdf)…

clinton emailslewis lukens 1Last Thursday Judicial Watch released the deposition transcript of Ambassador Lewis Lukens, former deputy assistant secretary of state and executive director of the State Department’s executive secretariat.

The transcript pdf is embedded below.

Lukens was deposed last week as part of the discovery granted to Judicial Watch by U.S. District Court Judge Emmet G. Sullivan in response to its Freedom of Information Act (FOIA) lawsuit involving former Secretary of State Hillary Clinton’s unsecured, non-government email system (Judicial Watch v. U.S. Department of State (No. 1:13-cv-01363)).

Lewis Lukens is the first of seven depositions of former Clinton top aides and State Department officials that Judicial Watch has scheduled over the next four weeks.  Also to be deposed are Cheryl Mills and Huma Abedin, as well as top State Department official Patrick Kennedy, and former State IT employee Bryan Pagliano.

    • It’s been pointed out, the lack of a password is further proof that this whole server thing is a deliberate sale of secrets by the clintons. Donations come in to their vile “charidee” foundation, in return for access to whatever was put on the server.

Make a payment, the witch puts your requested items on the server for your convenient theft.

hillary clinton is a traitor and should be tried and executed as one. After the treason laws are restored.

For some odd reason, right across the anglosphere, treason laws were quietly abolished a little while ago…

That begs the question as to what our vaunted Intelligence services are doing. Didn’t Snowden reveal that the NSA is monitoring everything? How did they miss the State Leak Department? And, what is the new SoS doing? Anything? Why do the taxpayers keep funding intelligence services when they can not even nail a public official in a security position who has breached every security protocol?

Why must we depend on Judicial Watch for answers and not those we fund, at a very high cost to keep us safe from enemies domestic and foreign?

          • nimrodman says:

“Why must we depend on Judicial Watch …”

Because government does not want it known. Even if NSA has recorded what was what with Clintons’ server, they don’t have authority to release that info willy nilly. Not without clearance from high up.

Now leaks – that’s another matter. The prevailing wisdom is that if Comey drags his feet about indicting Hillary, that underlings will start leaking findings intensely this summer.

One might expect the same from NSA, but they may differ enough in their security “culture” that they’d never or almost never leak. I suspect their culture is “hyper-secure”, maybe on a par with CIA or tighter, just due to their mission, which is supposed to be secret, secret surveillance.

Hence, it takes a non-government 3rd party like Judicial Watch to spring information loose by using the courts (the Judicial Branch).

All rank speculation on my part, tho perhaps those with experience in these agencies might comment.

My theroy from the beginning is Hillary may have done this on purpose.

This guy Lukens certainly isn’t the closer. A pretty vanilla transcript, but a couple of times he seemed rattled or too helpful, which may have been why the first 5 minute – 10 minute break lasted more like 40 minutes. AC privilege: Government lawyer asserts AC privilege to avoid answering questions from government investigator. The privilege belongs to the client, not the lawyer. The Clintons should know that by now.

“In these expedited appeals, the principal question is whether an attorney in the Office of the President, having been called before a federal grand jury, may refuse, on the basis of a government attorney-client privilege, to answer questions about possible criminal conduct by government officials and others. To state the question is to suggest the answer, for the Office of the President is a part of the federal government, consisting of government employees doing government business, and neither legal authority nor policy nor experience suggests that a federal government entity can maintain the ordinary common law attorney-client privilege to withhold information relating to a federal criminal offense.”

      • Chewbarkah says:

You can bet she will TRY to evoke attorney-client privilege. These depos were allowed by a federal judge who already sees substantial evidence that the cabal orchestrated a massive scheme to violate FOIA. Clinton’s side pretty much has to prove they did not (this is a civil case — beyond a reasonable doubt does not apply). Continued stonewalling in a case where Clinton has no credibility is going to be a sticky strategy. Also — a-c-p might apply to legal advice or services Mills rendered as an attorney in fact, but not to things she did or witnessed herself. The publicized a-c-p in Mill’s FBI interview involved her legal advice regarding which e-mails Hillary’s minions could delete. The corrupt DoJ let Mills invoke a-c-p so she wouldn’t embarrass Hillary by pleading the fifth, since Mill’s “advice” was to commit a crime.

        • John Galt says:

Mills is a government attorney. The attorney client privilege facade goes away if the government compels her testimony.

I think it is very clear that the setup was to specifically avoid FOIA requests (amongst the other nefarious reasons) – and that clarity is provided in the very last email (from Steve Mull to Huma) of the document above where they are discussing giving her a state dept blackberry/email…(would be subject to FOIA) because her personal server was down! HER PERSONAL SERVER WAS DOWN. They knew exactly what was going on.

Also, it is very scary to think that documents from emails were being sent to Yahoo accounts in order to PRINT documents by many in the State Dept. It is “routine” apparently. THIS IS NOT GOOD!

I think complete overhaul of IT systems/management is in order for the entire government, tbqh.

Of course she knows how to send and receive emails. She did it over 30,000 times. The desktop computer set up is only being used as THE EXCUSE for why she wanted to keep her email unavailable for FOIA and so she could sell information via her money laundering foundation unburdened by

Surprised she even did that since the everyone in government covers up her crimes with regularity anyway.

Two staffers asked about her email set up and were rebuked and lied to by their supervisor, John Bentel.

Ambassador Lewis Lukens, whose deposition is above, is the boss of John Bentel. So Bentel knows about Clinton’s set and is tell staffers to shut up. Why then does Lukens, his boss, not know?

      From the article linked below:

“In testimony in the Judicial Watch lawsuit that was released late Thursday, Bentel’s boss, Lewis Lukens, the director of the Executive Secretariat, was asked directly if he had ever communicated with Bentel about Clinton’s email. Lukens replied: “Not that I remember, no.”

Senate sleuths focus on ex-State Department aide in Clinton email ‘cover-up’

“…Bentel’s role, saying that statements in the inspector general’s report show he “muzzled” staffers who warned that Clinton’s exclusive use of a private email system might be in violation of federal record-keeping laws.”

“One of the staffers told the inspector general that Bentel responded that Clinton’s private email account had been “reviewed and approved by Department legal staff” and “that the matter was not to be discussed any further.”

The second staffer who raised concerns told the inspector general that Bentel responded that the mission of the office “is to support the Secretary and instructed the staff never to speak of the Secretary’s personal email system again.”

Donald Trump Campaign: Clinton Cash Formula: ‘Give Money to Bill, Get Favors from Hill’

For the second time this week, presumptive GOP presidential nominee Donald Trump’s senior policy adviser, Stephen Miller, read straight from the pages of Peter Schweizer’s book, Clinton Cash, at a Trump campaign rally.

Miller told the packed crowd that Bill and Hillary Clinton’s long-established global scheme of trading political favors for financial kickbacks is “documented in Clinton Cash—which everybody should get a copy of–and it documents a simple premiss of how government operates under Hillary.”

More than 1 million subpoenaed e-mails were mysteriously “lost” due to a “glitch” in a West Wing computer server in 1999.
Clinton has been burying emails since she was First Lady

While the State Department’s own internal probe found former Secretary Hillary Clinton violated federal recordkeeping laws, it’s not the first time she and her top aides shielded her e-mail from public disclosure while serving in a government position.

As first lady, Hillary was embroiled in another scheme to bury sensitive White House e-mails, known internally as “Project X.”

In 1999, as investigators looked into Whitewater, Travelgate, Filegate and other scandals involving the then-first lady, it was discovered that more than 1 million subpoenaed e-mails were mysteriously “lost” due to a “glitch” in a West Wing computer server.

The massive hole in White House archives covered a critical two-year period — 1996 to 1998 — when Republicans and special prosecutor Ken Starr were subpoenaing White House e-mails.

Despite separate congressional investigations and a federal lawsuit over Project X, high-level e-mails dealing with several scandals were never turned over. And the full scope of Bill and Hillary Clintons’ culpability in the parade of scandals was never known.

To those well-versed in Clinton shenanigans, this all sounds distressingly familiar.

“This Clinton e-mail scandal is nothing new,” Judicial Watch President Tom Fitton told me. “There were previous efforts to hide e-mails in the Clinton White House.”
