Two days ago Attorney General Eric Holder protested leaks from within the investigation of Ferguson; he said “they need to shut up“.  {{*nudge, nudge, wink, wink*}}
Following Holder’s protestations, less than a few hours passed before Trymaine Lee was the recipient of more DOJ leaks saying the DOJ intended to “shake up” the Ferguson Police Department.
This ‘do-as-we-say’ approach follows the New York Times outlining DOJ leaks showcasing a non-existent case, and aligned with CNN outlining more DOJ leaks claiming the intention of Eric Holder to deconstruct the entire Police Department.

Of course all of this conflicting DOJ-led reporting is annoying for the police chief, mayor, city council and government officials in and around Ferguson Missouri, and prosecutors in Saint Louis who have retained security of the evidence and have NOT been leaking information to the media.
As Police Chief Thomas Jackson told CNN yesterday, Eric Holder -or any representative acting on his behalf- has not talked to a single person in government of Ferguson, nor conducted a single interview.  Quite the opposite, neither he, the major, city council, nor anyone from any agency have talked to these mysterious federal officials that Eric Holder is now claiming are making decisions about what is to take place.

FERGUSON • If a behind-the-scenes effort is afoot to force out Chief Thomas Jackson and disband his police force, neither he nor his department is going quietly — nor quickly.

A series of stories in national and local media have reported about an “extremely delicate” plan for Jackson to resign and for his department to be disbanded. The plan has been billed as a way of reducing tension as the region braces for the potential of more civil unrest.

While Jackson’s resignation could occur with the stroke of a pen, dismantling Ferguson’s 53-member police department is a process fraught with legal uncertainty. It could take months — and a public vote — because of the city’s charter.

On Wednesday, U.S. Attorney General Eric Holder called for “wholesale changes” within the Ferguson Police Department, while speaking at a public forum in Washington. He declined to offer any specific recommendations, noting that Ferguson police were still under a U.S. Department of Justice investigation.

Jackson said of Holder, “I think he’s about to leave office and needs to say he accomplished something in Ferguson.” He said in an interview Thursday, “Right now, I’m low-hanging fruit.”

Jackson called it “irresponsible” for Holder to comment about conclusions Justice Department investigators analyzing his department have made while their investigation is ongoing, especially while “he is telling others to ‘shut up’ about leaks.”  (read more)

So one can imagine the angst when today yet another leak from inside the DOJ is talking to the Washington Post and claiming there is no basis for civil rights violations or charges from federal government.

SO, WHAT’S GOING ON ?  The obvious answer to what is taking place is that Eric Holder is making claims and accusations not supported by factual evidence, even within his own department.
This might seem odd were Eric Holder not factually one of the most corrupt and political Attorney Generals’ ever in the history of the DOJ who is making these claims.
Not only is this AG the only attorney general ever held in contempt of congress, but people tend to forget it was under Holder’s tenure that an independent inspector general’s report (2013) slammed the race-based politicization of the DOJ in a massive 250 page scathing report of the Civil Rights Division.
The report included evidence of widespread intimidation, racial abuse, DOJ attacks based on racial ideology and numerous accounts of targeting groups and individuals based on their race:

THIS IS HOW HOLDER ROLLS – It was only last week than a circuit court judge had to recuse an entire federal district because of gross abuses of DOJ prosecutorial conduct.  In an extraordinary development, Judge England, Chief Judge of the United States District Court for the Eastern District of California, ordered the recusal of all the Eastern District judges from the case because of serious allegations that the Court itself was defrauded by the government in the original prosecution.

In 2013 the same Eric Holder DOJ -civil rights division- was smacked down by another judge in another district for gross abuses of DOJ conduct in Louisiana:

Judge Engelhardt […] The case started as one featuring allegations of brazen abuse of authority, violation of the law, and corruption of the criminal justice system. Unfortunately, though the focus has switched from the accused to the accusors, it has continued to be about those very issues. After much reflection,the court cannot journey as far as it has in this case only to ironically accept grotesque prosecutorial misconduct in the end.  (link)

So does it really come as a surprise when the facts of an investigation do not support the preconceived ideological position of Eric Holder, yet he demands destructive action despite them?

Washington Post – Justice Department investigators have all but concluded they do not have a strong enough case to bring civil rights charges against Darren Wilson, the white police officer who shot and killed an unarmed black teenager in Ferguson, Mo., according to law enforcement officials.

When racial tension boiled over in Ferguson after the Aug. 9 shooting, Attorney General Eric H. Holder Jr. traveled to the St. Louis suburb to meet with city leaders and protest organizers in an effort to bring calm. He assured them that the federal government would open a civil rights investigation into the fatal shooting of Michael Brown, but that investigation now seems unlikely to result in any charges.

“The evidence at this point does not support civil rights charges against Officer Wilson,” said one person briefed on the investigation, who spoke on condition of anonymity because of the sensitivity of the case.

Justice Department officials are loath to acknowledge publicly that their case cannot now meet the high legal threshold for a successful civil rights prosecution. The timing is sensitive: Tensions are high in greater St. Louis as people await the results of a grand jury’s review of the case.

Many supporters of Brown say they are already convinced there will be no state-level indictment of the officer. Federal officials have wanted to show that they are conducting a full and fair review of the case.

Justice spokesman Brian Fallon said the case remains open and any discussion of its results is premature. “This is an irresponsible report by The Washington Post that is based on idle speculation,” Fallon said in a statement.  (read more)

Just because the evidence does not support his desires, don’t expect Holder to give up on his goal of prosecuting Officer Darren Wilson.
Just like the George Zimmerman case where the FBI conducted 250 interviews and determined there was no cause for any civil rights charges, yet Eric Holder would not close the case despite the lack of evidence; and has recently sent subpoenas for additional federal inquiry almost 3 years later.
