No reason for asthma inhalers to be prescription.
When I worked in correctional health care, every inmate and his brother wanted an inhaler….(albuterol)…they used it to get a “buzz”…from the side effects…tachycardia and getting ramped up, especially in the gym, playing basketball. It was also a useful item to “sell” to other inmates…in exchange for commissary or whatever…A “hit from an inhaler” was a pricey and desired commodity. The potential for abuse and over use, is very high.
I would like to see it OTC behind a counter, myself…like Primatene Mist.

Well, Aggie, this is my pre-retirement professional career area – health/infectious disease, specifically foodborne illness as team member of a defense firm in the area of foodborne illness outbreaks , usually eColi, (spinach, etc.). We handled all the major outbreaks for years and there were many eColi outbreaks! I obtained thousands of claimants’ HIPPA Authorizations to obtain, receive and distribute the medical records to all parties.
I can unequivocably state that CDC would never release the name(s) of confirmed outbreak case(s). In fact, of the 50 states providers/health agencies/epidemiologists and the federal agencies, such as FDA or USDA, the worst agency which did not comply with the law governing production of FOIA documents…was CDC. They were tight fisted to release medical data even when the claimant’s HIPPA Auth designating release of same.
After retiring, I very briefly worked at CDC (database work for a lab, HHS mandated CDC get all records imaged/coded. This was 2014. It was shocking to be reviewing all that labs findings going back to records on onion skinned paper which were not imaged/coded in a searchable database, but I digress…). It just happened to be during the huge western Africa Ebola 2014 outbreak, which thus far is the largest Ebola outbreak. Ebola is not transmitted via food, but via infected blood or bodily fluids. This is what I observed as a contractor.
CDC employees VOLUNTARILY deployed to the Ebola outbreak area. Upon return, after quarantine, they debriefed any CDC employee, including contractors. I went to a debrief by 2 doctors. It was scary. I have no backgroud in health other than the legal perspective of being involved in lawsuits or claims but I read medical summary of eColi cases and heard about the Ebola symptons in real time at CDC. IMO contracting eColi or Ebola is worse than any know disease. Due to the highly infecteous nature of both diseases, CDCs protocols would be similar: to traceback any known people the infected person had contact with during the onset timeframe and interview/test them, and repeat this process if anyone of them is positive tested.
Ebola outbreaks in Africa spread like wildfire. Entire populations are at risk (same with eColi outbreaks, but death is usually for 2 years ol or youger or advanced age) where death of Ebola is with the population regrdless of age. Emory Hospital is a stones throw from CDC. They brought Ebola patients to Emory. A ripple of fear went through Atlanta, but Emory is well equipped for just such patients. We watched all this play out in real time. News coverage was constant.
You asked: Was this doctor’s HIPPA rights violated? When everyone connected to Dr. Peter Stafford in interview/tested because of their contact with him, when every CDC interviewer is wearing a Hazmat suit in this entire process, and when Dr. Peter Stafford is wearing a hazmat suit and is airlifted under strick isoation protocols with (mostlikely) CDC doctors…no one has to openly violate his HIPPA rights to conclude he is infected with Ebola BUT HIS HIPPA AUTH COULD HAVE SPECIFIED THE RELEASE OF HIS INFO TO ANYONE WHO NEEDED TO NOW, because the health of the countries population is the number one concern, his identity will be known. That’s how I would have written the HIPPA Authorization.
Also, Aggie, our HIPPA laws are for USA jurisdiction.
This will be a part of his passport data. If he ends up ultimately at Emory, a HIPPA Auth would be required for the release of his medical records, but his name as an Ebola-infected outbreak case is now known.
