Virginia voters passed the measure last month. But the state’s top court ruled that legislative Democrats did not follow the proper procedure when rushing the referendum to the ballot.

The dissenters viewed the current election to have occurred on election day (disregarding entirely the early voting perood), which would have satisfied the 90-day separation from the prior election.
(Note that the elections here refer to the votes on the constitutional amendment referendum, not the election of candidates.)
Right. However, since VA has early voting, thousands of voters had already voted for certain candidates before the Dems sprung this. IIRC, the GOP had affidavits from voters who voted early in the general election, and said that if they had know about this scam, it would have changed their vote.

The first legislative resolution occurred in Oct., 2025 — prior to the Nov. date of that election.
The second legislative resolution occurred in 2026.
At issue was whether the 2025 election was intervening the two legislative resolutions.
The court held that the 2025 general election began when early voting began, well before the first legislative resolution, and not on the Nov. date.
Therefore, the 2025 election effectively preceded or ran concurrently with the first resolution, and did not intervene the two.
Thus, there was no intervening election as the VA Constitution required.

After SCOVA, in a 4-3 ruling, nullified the 51.7-48.3 (+ 105-K votes) results of the state’s constitutional redistricting referendum, the 6 DEM – 5 GOP will be used in 11/26. That’s after the state spent $ 5.2M for the special election, and outside groups raised nearly $ 100M to sway voters.
Outgoing Governor Brian Kemp (GA-R): As voting is already underway, no redistricting before midterms.
