The Democrats May Not Survive Callais Ruling

(The Court moves to curb race-based districts — and the political fallout could be enormous.)

If the title of this column seems to exaggerate the potential impact of last week’s Supreme Court ruling in Louisiana v. Callais, it’s probably because most political pundits have focused on its effect below the Mason-Dixon Line. But the majority-minority congressional districts that will need to be altered pursuant to the Court’s ruling are far more pervasive than most realize. Ballotpedia, using data from the U.S. Census Bureau’s 2024 American Community Survey, estimates that these racially gerrymandered districts account for 148 seats in the House of Representatives. This is about one third of the House’s 435 districts and 122 of them are held by Democrats — more than half of their 212 seats.

SCOTUS granted Louisiana’s request to immediately finalize Callais. It usual procedure is to issue one 32 days after the opinion, but given the upcoming election, it expedited the finalization by a vote of 8-1.

KBJ was livid, and filed a dissent. Alito, Thomas, and Gorsuch filed a response to her in which they noted that delaying the finalization would mean the primaries would be held with an electoral map that was unconstitutional because of the bizarre gerrymanderied “snake” district running almost the length of the state.

They said KBJ’s claim that they were being political was “baseless and insulting,” as well as “groundless and irresponsible.” That’s judicial-speak for call her a stupid jerk.
