Acting Attorney General Todd Blanche announced today a two-count indictment against former FBI Director James Comey from the Eastern District of North Carolina for threats against President Donald Trump. [Indictment Here]
According to the Press Release: […] “The Indictment includes two counts, first in violation of 18 U.S.C. § 871, alleging that James Comey, 65, knowingly and willfully made a threat to take the life of, and to inflict bodily harm upon the President of the United States. This charge alleges that on May 15, 2025, by publicly posting an image over the internet via Instagram depicting “86 47”, which a reasonable recipient who is familiar with the circumstances would interpret as a serious expression of an intent to do harm to the President of the United States.
The Indictment also charges Comey in violation of 18 U.S.C. § 875(c), that James Comey consciously disregarded a substantial risk that his communication would be viewed as threatening violence, and that he knowingly transmitted a communication in interstate commerce that contained a threat to injure the person of another, which a reasonable recipient who is familiar with the circumstances would interpret as a serious expression of an intent to do harm to a person.” (SOURCE)
James Comey is charged with Threatening the President in violation of 18 U.S.C. § 871(a) and Transmitting a Threat in Interstate Commerce in violation of 18 U.S.C. § 875(c). If convicted, he faces a maximum penalty of 10 years in prison.
Additionally, similar to the criminal referral connected to former ICIG Michael Atkinson, today’s grand jury indictment creates a pressure point for ongoing DOJ investigations into additional related matters concerning FBI Director James Comey.

It would be so sweet if, like the weak sauce indictments brought by Alvin Bragg in Manhattan, that legal experts cringed at, that these charges actually end up sticking.
Anyone with an inkling of knowledge of law knows that Bragg’s 34 indictments were past the statute of limitations, not really felonies, and issued under nonexistent “novel legal theory”. Yet, a dumb, Trump hating 99% Democrat jury jumped all over that hot mess.
Hopefully the NC jury does the same. Plus, Comey *actually* is guilty of the threats.

that they are using this particular charge based on a timing element (the latest assassination attempt at the corr dinner) to provoke a more emotional response from jury. a clever gimic, but to be clear, I find it condescending. one because it is doubtful that Comey had any involvement in that assassination attempt and that will be how it will be received…as another weak play to get him in court. but secondly, the case itself …moving rocks in patterns suggesting the 86 can be read as two meaning. to get rid of, and of course to kill. Comey has already made his thoughts clear on which of the two he “meant”. And in court that is all that really matters. You can’t really win a case, when a defendant is accused of making a veiled death threat…and if there was ever a way to avoid making a death threat, and still leave that brewing, this is how you do it. Comey, again showing he isn’t a stupid person..vile, scofflaw, horrible and obviously infected with orange man bad disease, but cunning.

as much as I really don’t want to believe what I am about to write, I think there is some things to consider.
President Trump has fired many people, many attorney’s. And we know why and there is nothing wrong with this. However, what this also means is that the next tranche of attorney’s fielding “the complaints” must have some awareness that progress, any progress, is essential to staying alive…so to speak.
While I would not like to believe that is the driving force for this obvious reflexive charge against Comey…one has to clear eyed about why all the other Russia Russia conspiracies are not top priority. this one really does feel like a joke.
If I could be convinced this is some part of a larger strategy to corner Comey, I am open to those ideas, but frankly I’ve not read anything at all that give that any support. In fact, in no small way this gives comey’s defense later down the road, should that ever happened, even more ammunition to describe to jurors’ this is yet another attempt to weaponize justice and put me in jail…

Blondie is gone, and there is a noticeable uptick in activity by the DOJ and FBI in just the last few weeks. In the meantime, further charges are brought that maybe get him into prison. At the same time Brennan and others (I hope many others) are prosecuted. Some are turned, and they sing.

It seems like a fairly weak case, at least compared to the mishandling of documents and the attempted coup. However if the strategy is to pull him into court on lesser charges first, then hit him with the more serious charges to drown him in legal costs. It couldn’t happen to a more deserving person, like what the DOJ did with Mike Flynn.
