Acting Attorney General Todd Blanche announced today a two-count indictment against former FBI Director James Comey from the Eastern District of North Carolina for threats against President Donald Trump. [Indictment Here]
According to the Press Release: […] “The Indictment includes two counts, first in violation of 18 U.S.C. § 871, alleging that James Comey, 65, knowingly and willfully made a threat to take the life of, and to inflict bodily harm upon the President of the United States. This charge alleges that on May 15, 2025, by publicly posting an image over the internet via Instagram depicting “86 47”, which a reasonable recipient who is familiar with the circumstances would interpret as a serious expression of an intent to do harm to the President of the United States.
The Indictment also charges Comey in violation of 18 U.S.C. § 875(c), that James Comey consciously disregarded a substantial risk that his communication would be viewed as threatening violence, and that he knowingly transmitted a communication in interstate commerce that contained a threat to injure the person of another, which a reasonable recipient who is familiar with the circumstances would interpret as a serious expression of an intent to do harm to a person.” (SOURCE)
James Comey is charged with Threatening the President in violation of 18 U.S.C. § 871(a) and Transmitting a Threat in Interstate Commerce in violation of 18 U.S.C. § 875(c). If convicted, he faces a maximum penalty of 10 years in prison.
Additionally, similar to the criminal referral connected to former ICIG Michael Atkinson, today’s grand jury indictment creates a pressure point for ongoing DOJ investigations into additional related matters concerning FBI Director James Comey.

But for him to write “86 47” in the sand by using sea shells, take a photo of it, and then post that photo online was the act of a terrorist.
The left seems to think that Comey including commentary on the shells in his post — as if they just serendipitously came into spelling something out — is just peachy. We all know insanity rules the leftist collective.
For Comey to write, “Cool shell formation on my beach walk,” whether he set each shell in place or not, then send the photo and his remark out to radical socialists who have a killing field mindset, makes him a co-conspirator to every attempted murder against President Trump.
Comey thinks he is above the law. I pray the law does not prove him right.
We can hope until we are blue in the face, but fact is this will go nowhere. Only thing we can hope for is the financial hit he may take by his lawyers.

I’m pretty confident that this “shells” prosecution is just the beginning for him. The well runs deep for this traitor, and I’m guessing they will use it all. I’m so thrilled to see some aggressive action after the wasted year+ of Blondie.
Crudely put, this is a ‘hand that cradles the bollocks’ prosecution. Once he feels it, knows it won’t be slapped away by an equally corrupt judge, and knows what comes next (given it’s SOP for the DS) he’ll talk.
As for the ‘wasted years year’ I don’t think it was. I think what we’re seeing now is a wave of prosecutions produced by a diligent demolition team who’ve been working quietly away, laying the charges for a controlled cascade collapse. In fact I’d argue that some of the invective against Bondi was a classic deception ruse that convinced the DOJ stay-behind snakes that she was ‘one of them’, and had indeed ‘wasted a year’.
The change in leadership was anticipated by LawFare, but the scale of the work that her team had been doing building the foundations of the cases, and now revealed in a chain of prosecutorial detonations, must have the Eisen mob reeling.
I know some may think my take is overly-optimistic, and I’m sure in certain aspects it is, but in my defence I’ve often found that an understanding of someone’s background can be critical in giving an insight into what they’re doing and how they intend to do it. Trump’s past is construction, he knows how to build and how to demolish structures that have stood for decades, he’s also highly experienced in the world of TV that thrives on deception, and finally he’s experienced the way the DS operates.
Put all of those elements together, then allow a four year planning period and the divine element that motivates Team Trump, and you’ve created a plan with such synergistic force that it is capable of achieving a paradigm shift unequalled in modern political history. The DS could soon be literally looking at the rubble of their century old project, a tower built on hubris and taken down by their nemesis in less than a term.

This! I was saying this to my friends when this first got posted by that dingus. Comey is just dopey enough to do something like that. Those shells are not ‘random’ from the beach just due to the even coloration and similarity in size. The odds of finding those in a random pile?… gimme a break. Those indeed are some kind of decorative shells sold in all sorts of knick-knack shops in beach towns.
This fool surely bought these himself. He is surely also dumb enough to use a credit card/phone-tap. As long as the FBI/investigators don’t just half-butt the field-work, they should be able to find the store and the transaction.
Its bad enough if he did just happen to find them on the beach, I think it elevates the crime to actually go out and purchase them for the expressed purpose of making the threat. I could also argue that it would take a very deranged mind to scour the beach to find such similarly sized/colored shells if they can’t find a financial transaction for their purchase. Imagine some nutjob spending hours on the beach looking for such nicely matched shells!
That should give the prosecution two good working theories to present at trial:
1) was he dumb enough to deliberately plan, buy and execute the arrangement?
OR
2) was he obsessed enough to scour the beach for hours, maybe even days?.. to find such nicely matched shells?
Either goes a long way towards the whole mens-rea angle.
It is an interesting photo. Notice there are no animal tracks within the sea shells, which means either the animals avoided the shells or the shells were put down “recently”, after the animal tracks and before any wind could have covered the shells. It also took some intent / time to go find the different kinds / colors of shells.
Or 3) they were from a collection of memorabilia seaside vacation gifts over the years, possibly from his daughter at the SDNY.

A judge can’t easily override a grand jury’s indictment based on the judge’s idea of evidence alone. Doing so undermines the whole purpose of grand juries.
What they usually do is find a flaw in the case filing, etc. With the last Comey case, it was the interim appointment of Halligan and her lawful authority in signing the indictment. Bondi bothched that one IMO. In this case, the DOJ attorney, Ellis Boyle is also interim but it looks like they did everything correctly. He does have authority to sign the indictment and he appears to have been submitted to the Senate for confirmation within the proper time limits. My understanding (which may not be 100% correct) is that the 120 day interim clock stops once an interim DOJ attorney is submitted for confirmation. So the Senate doing its usual foot dragging should not be a factor.
It’s is a bit concerning that over 70% of these DOJ attorney positions are still interim. This is a sort of Lawfare they use now — drag out the appointments in hopes something isn’t done 100% to the letter of the interim appointment law so cases can be thrown out.
I think part of the plan here (just speculation) is to go for as many grand jury indictments against the conspirators as possible. Start weighing them down. Start creating costs and reasons for individuals to flip. Comey is certain to be indicted as part of the bigger conspiracy case(s) grand juries in Florida are supposed to be hearing — assuming those grand juries indict.
Getting these grand juries outside of DC and other heavy blue areas is a key part of this.
The other angle I heard speculated on Newsmax is, with the indictment, they can now subpoena phone records, etc. Chances are Comey, Mr. Smugness that he is, said something to someone about what he really meant.
This is the other reason to get indictments: Evidence and discovery can reveal a lot that may also help other cases. Another area where you have to do everything by the book though.
Bondi was not up to this level IMO. Blanche seems to be. It cannot be purely coincidental that with Bondi out and Blanche in, we see a number of things now moving. Trump wasted precious time appointing Bondi IMO.

My money is on the swamp finding a skell to come forward and say he was the one who placed the shells, not Comey. And the swamp will manufacture all the necessary receipts to prove the dupe was in the area at the time of the text photo from Comey.

I started to call him a weasel, but that would put Comey and a weasel on a level playing field.

Honestly, I would love to see Mr. Comey realize the error of his ways, repent, and accept Jesus as his Lord and Savior.

Whether comey gets indicted or not, he has to dig into his pockets to pay for defense attorneys. Like Michael Flynn, these cases can drag on for months and years. Comey isn’t in govt employ any longer, and AFAIK, can offer nothing in return for free legal work. The process is the punishment, and may he continue with the rest of his life broke and destitute until he no longer breathes air.
We can only hope comey goes to prison. Ex fbi, cops, etc. do not fair well in stir. If he goes to prison, I hope the inmates give him a rousing welcome and special treatment throughout his sentence.

Several Legal opinion pieces have said it’s a first amendment issue. I disagree. The first amendment doesn’t allow slander, liable, calls to violence or harm. The posting on any social media platform with hundreds of followers and re-posting of the image is in my eyes is a clear threat. I know a gentleman who was prosecuted for a chat between him and others on a facebook posting for suggesting Obama could be eliminated with a long range fire arm. He did five years for that.
