In the 1866 Supreme Court case “Ex parte Milligan,” the court ruled that military tribunals cannot try civilians if civilian courts are open and functioning. The Court decided that using military commissions to try citizens, even during wartime, violates the Constitution when federal courts are operational.
Interestingly (to me) the case stemmed from a military tribunal convened in Indianapolis.
Lambdin Milligan (among others) was tried by a military tribunal in 1864. The charges were inciting rebellion, offering aid and comfort to the Confederacy and conspiracy against the U.S. government.
Milligan and two other defendants were found guilty and sentenced to hang. President Andrew Johnson commuted the death sentences for all three to life in prison.
Milligan’s lawyer filed a petition for a writ of habeus corpus in the U.S. District Court, asking for the legal justification for the original arrest.
During the case the issue of whether or not the trial by a military tribunal was even legal in the first place arose.
The Supreme Court ruled in April of 1866 that “martial rule can never exist when the courts are open.”
Military tribunals are illegal and unconstitutional for the purposes being discussed here.

I do not trust military tribunals alone would deliver justice as much as others may. The politics of the officers selected to serve on any tribunal needs to be screened just as much as the politics of any judge in civilian courts.
The uniform, tradition and oath alone are no guarantee that tribunals would deliver justice.

The middle path is ruling that that even at the Fed “for cause” applies, and that it is a very broad standard mostly determined by the President.
