The department has initiated retirement grade determination proceedings under 10 U.S.C. § 1370(f), with reduction in his retired grade resulting in a corresponding reduction in retired pay.
To ensure this action, the Secretary of War has also issued a formal Letter of Censure, which outlines the totality of Captain (for now) Kelly’s reckless misconduct. This Censure is a necessary process step and will be placed in Captain Kelly’s official and permanent military personnel file.”
“Captain Kelly has been provided notice of the basis for this action and has thirty days to submit a response. The retirement grade determination process directed by Secretary Hegseth will be completed within forty-five days.
Captain Kelly’s status as a sitting United States Senator does not exempt him from accountability, and further violations could result in further action.
These actions are based on Captain Kelly’s public statements from June through December 2025 in which he characterized lawful military operations as illegal and counseled members of the Armed Forces to refuse lawful orders. This conduct was seditious in nature and violated Articles 133 and 134 of the Uniform Code of Military Justice, to which Captain Kelly remains subject as a retired officer receiving pay.” (SOURCE)

kelly and the other five should be brought to trial for breach of their Oaths to “support and defend the Constitution”; these six are individually and collectively “enemies … domestics” (and on investigation may prove also “enemies, foreign”.
“I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. On conviction, the punishments should (if they do not) include confiscation of all ill-gotten income from government sources, and de-naturalization (make them each “stateless”) and deportation (to the middle of Indian Ocean off Antartica; if no country will claim them).
“No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.” (Amendment XIV, Sec 3 of the United States Constitution)
This was the provision they discussed using against Trump for J6, which was nonsense.
But in the case of Kelly and the other Traitorous Six, they openly called for uniformed military to turn against the lawful Government. That is about as “insurrection or rebellion” as you can get. It also gave aid and comfort to the declared enemies of the US – Tren de Aragua and other drug cartels.
The step they couldn’t establish against President Trump was to legally prove insurrection. But they couldn’t. It was never charged. But now with Kelly there is a official finding that he engaged in seditious acts “clearly intended to undermine good order and military discipline.”

An interesting option that keeps the results of this “review” out of the criminal legal systems of the US Military and US Federal Court of Appeals (where UCMJ Actions jump over to the US Federal Legal System).
Keely’s only recourse is administrative and of course he can try the political route by attempting to hold DoD Hostage to some sort of legislative retaliation (a risky move to say the least).

I know that … I was a participant administering UCMJ procedures as an adjutant as well as when a unit commander … appeals to UCMJ verdicts can go beyond the Military Justice system. Once appeals move through the entire Military Justice System, they can be brought forward to the Federal Courts via appeals to a specific the US Federal Court of Appeals.
Given the current composition and lack of trustworthiness of the Military Justice System and Federal Court of Appeals involved, this is probably the best way to punish Kelly.
I seriously believe Hegseth has what it takes and should be the next President.

His arrogance and plan to get the military to disobey the Commander in Chief’s authority is defined as sedition. His crimes as a Senator and Prior military service should be prosecuted to the furthest extent of the law. If he was just a citizen he may have gotten away with it, but he created a conspiracy among many levels that included many other lawmakers and prior military service people. His acts weren’t just criticism, and he deserves the full prosecution of violations of the Constitution and Military law. Other lawmakers and ex military that engaged, should also be highlighted and exposed as traitors to the U.S. If not revealed and exposed, illegal acts will continue.
I come from a multi-generational military family, so I probably see things differently than all of you.
As disgraceful as this is, I have to believe it only further illuminates for active duty members just how compromised and politicized the military leadership at the top has become.
And certainly any legitimate proceedings will establish that further still.
As many have pointed out, the message in question only reiterates what is made abundantly clear to our military from day one, what is in their sworn oath.

They inferred that things were bad for military members under trump and how they understood what a terrible situation they were in. Then went on to say to ignore unlawful orders, intimatingTrump had already given them.. They were attempting to sew dissent and it is exactly what the UCMJ described as a crime.
I agree but that wasn’t my point. My point was he is not charged with or being tried for sedition. He is not being court martialed he is receiving non judicial punishment. No trial, no lawyers. He can appeal by demanding a court martial, which would be extremely stupid on his part.
I don’t think a lot of non military understand under UCMJ that court martials are somewhat uncommon. Most discipline is by non judicial punishment. I think the Army and Air Force call them an Article 15, but we called them a Captains Mast (Navy, Marines and Coast Guard).
He is receiving a slap on the wrist with a warning that his actions are now documented and if he continues on the will receive a real punishment. At least I would hope so.

While what he said may be technically true, the manner in which he said it would cause a reasonable person to conclude he was inciting members of the military to disobey orders. What was left unsaid is the manner in which a member can determine that an order is “illegal”. It can’t be “In my opinion, your order is illegal”.

Military tribunals are for civilians when the regular courts are impaired. There is not going to be any “military tribunal” nor “court-martial”.

This is a disciplinary action under the UCMJ being initiated by the Secretary of War, not the Secretary of the Navy. Kelly’s appeal will be heard within the military justice system. I would be very surprised if a future Democrat President took action to reverse Hegseth’s decision. It’s too useful a precedent.
