President Donald Trump is once again asking Republicans in the senate to terminate or suspend the filibuster, get tough, and reopen government.
Trump notes a point CTH has emphasized, Joe Manchin and Krysten Sinema were the only thing that stopped the Democrats from terminating the filibuster in the last congress. Both Manchin and Sinema are gone. If Democrats retake the majority of the Senate, they will terminate the filibuster.

No. If the Senate ends the filibuster, the only branch of government with the filibuster will be the executive branch. Trump filibusters all the time.

The Senate is no longer a rational deliberative body that tries to compromise on legislation to help solve problems. Maybe it really never was, but in today’s world it’s just a body driving leftist ideology.
There is no doubt that our country is in a free fall mess heading toward socialism. It has only been somewhat slowed in the past, but not in today’s world. The left want power and control and they will do everything to get it. Just look at the corruption in our elections that have occurred and continue to occur yet Congress has little interest in stopping the corruption.
So maybe the Filibuster was ok when you had most of the Senators at least cared about our Constitutional Republic. That has long since past, IMO.

It is not even tradition. The current rules have only existed since the Democrats effectively got rid of the filibuster in the 1970s and replaced it with the super-majority 60-vote requirement, which is what cloture is now called.
What people think of when the word filibuster comes up, that of one or more senators starting a non-stop talking session, as in the classic 1939 Jimmy Stewart movie “Mr. Smith Goes to Washington”, doesn’t happen any more. Cloture was adopted in 1917 to enable forcing such a filibuster to be halted with at least 60 votes in favor. Pretty much everything else was passed with only a simple majority. That all ended in the 1970s when the Democrats controlled Congress and rewrite the cloture rule to be a super-majority requirement for almost everything. It was a new invention that had the effect of putting both the House of Representatives and White House in a subordinate position to the Senate by requiring both to come groveling to the Senate if they wanted anything passed.
The 1970s “cloture” rule should be eliminated, but the Uniparty in the Senate won’t do it because too much of their power over the rest of government depends upon maintaining it, and that is why enough of the RINOs are willing to let the shutdown continue in order to preserve it.
Don’t believe that is correct. Rule XXII on cloture was amended to require 2/3rds of senators duly sworn, then amended later to 2/3rds present and voting before coming to its current 3/5ths senators duly sworn.
But much of the real battle was over whether changes to Rule XXII were themselves subject to cloture or not.
The so-called “nuclear option” is based on the idea that the President of the Senate can issue a ruling that changes to Rule XXII do not require cloture. That ruling can be appealed but a majority vote in the Senate can sustain the ruling. I’m not 100% sure if the appeal is debatable.
Note that a cloture motion if passed does not end debate, but sets a timetable for debate to end.

If the Dems pack the court, they’ll immediately add enough Ketanji-Brown types to ensure all future cases go the Dems way. Even if the R’s get back in power, they will have only a few opportunities to appoint SC Justices as they retire. And each one will have far less decision-making power if the SC holds 21 Justices instead of 9.
That’s why I think getting rid of the filibuster is more important than whether the federal govt pays for ObamaCare subsidies another year.

The states were sovereign when they gained independence from the British Empire. All the states separately voted to form a Republic.

If the current Senate gets rid of the filibuster, can’t they add it back when a new Senate is sworn in? My understanding is the filibuster was added many years ago, not part of the Constitution. So, why shouldn’t the party in power use it (or remove it) to their benefit?
It is part of the body’s operating rules but it is not set in stone, it can be suspended or ditched entirely.

True, our Founders’ original design and intent was both to give Senators “a more pragmatic and measured outlook” and more importantly,… wedded to the interests and concerns of their respective state leaders who elected them, not their state’s general populace,… nor to a national political party or Big Wig donors, foreign or domestic,…. as they have devolved into now.
Once elected now, their campaign war chest filled with donor funds makes it extremely difficult to defeat them via election or remove them from their exalted positions,… and all by their design.

The filibuster as was used originally was essentially debating a bill to death, keeping it from being voted on and also keeping the body from adjournment by lengthy speeches and grandstanding. They had to stay there and outlast the filibusterer.
The more recent innovation is literally just saying “filibuster” without all the rest of that business being done. It is nonsensical. Things might be a little different if Congressmen actually had to suffer the extended company of their own who invoke the filibuster.

I appreciate the frustrations of the stalemate, but if the judicial branch shouldn’t be telling the executive branch how to exercise (or not) its powers, then the executive branch should not be telling the legislative branch how to pass legislation.

Given that at least five Republican Senators (Thune, McConnell, Cruz, Tillis and Murkowski) are firmly against the move, the math currently does not add up.
If the Democrat politicians think that they will have the next term at majority people should not be surprised if there becomes a majority of Democrats that say yes, it’s time to end the filibuster, so those five Republican Senators might not be needed.

Mixed feelings about this and as some have pointed out, it’s really the silent filibuster that should be canned. That said, if the Demonrats are fixing to axe it next time they are in power, it would better to axe it now and pass some things. Terminate the filibuster and pass election reforms immediately. Prove that your an American citizen, Photo ID, paper ballots, voting in person on 1 day with hand counting the ballots with the winners announced before midnight.

But, with the filibuster rule, the blue slip rule and who knows what other archaic rules the two houses of congress have piled onto their work – those were never in the Constitution, they were simply rules politicians created over 100 years ago that are weighing down the work that needs to be done in the now by this country, this President, and this Administration if we really are going to have a chance to restore this republic.
McConnell ended the blue slip rule for circuit court nominees. The appeals circuits each encompasses several states (except for the DC Circuit and the Federal Circuit – the latter hears patent, trademark, contract, SS benefits and other federal benefits cases), and the old blue slip rule let any senator in any circuit blue slip a nominee, not just nominees from the senator’s home state. Now the senators can only blue slip a district court nominee who will sit in the USDC in the senator’s state.

If the household’s income is 400% of FPL, the percentage difference is 310% and increase would typically be capped at $465/month.
If the household’s income is 300% of FPL, the percentage difference is 210% and increase would typically be capped at $315/month.
FAIR SHARE PPACA PREMIUM MINIMUMS
I would impose premium minimums of the higher of:
1. 1/65th of the Medicare Part B premium amount per insured year of age as of the start of coverage
2. one-tenth the percentage of the policy premium of the household income as a percentage of FPL.
For a 5-year-old, 7-year-old, 32-year-old and 34-year-old, the ages would sum to 88 and the monthly absolute minimum premium amount would be a (88/65)*$185 or $250.46.
For a 5-year-old kid and a 27-year-old mom the ages would sum to 32 and the monthly absolute minimum premium amount would be (32/65)*$185 or $91.07.
For the second minimum, a family whose income is 300% of FPL would have to pay at least 30% (one-tenth of 300%) of the cost of the policy.
[NOTE: About half the premium is to subsidize unhealthy people. Paying 30% is covering well over 60% of true risks of most insureds.]

The argument repeated often by those still clinging to the filibuster is that it protects the rights of the minority from the passions of the majority. In the Constitution, that concern was addressed by the invention of a bicameral legislature. Thus each house checks and balances the other. Also, the President is given the veto, the exercise thereof specifically calls for supermajorities to override. That is where the 2/3 majority requirement to pass legislation is found.
The Senate filibuster blocks votes and blocks legislation. It forces the government to grow by requiring continuing resolutions, given that regular spending bills can’t get through. This is a shift of power to the legislature and the bureaucracy, at the expense of the President, because the President sees the opportunity to exercise the veto effectively taken away. As continuing resolutions grow the government, we have seen how money is redirected from appropriated purposes to other uses (USAID).
President Trump is right. Republicans have an opportunity to wield power, and yet they recoil from it out of unfounded fears. Power isn’t something you are given; power is something you take. Leadership requires taking responsibility for governing. Wringing hands and pointing fingers will not reopen the government. Doing as the President says carries risk, the risk of defeating the Democrats. What about that?

Ending the filibuster is a horrible idea. I would go so far as to argue that the Democrats are attempting to bait the Republicans into doing it. Yes, we all know the Democrats have an insatiable appetite for power. We also think we know they will terminate the filibuster if they regain control of the Senate. None of that changes the fact terminating the filibuster is a horrible idea.
As I look at the results of this latest election, one thing stands out to me: Lack of turnout on the GOP side. Turnout wins elections, hands down. Democrat voters hold their noses and vote for the (D) on the ticket, whether they think they are any good or not. Democrats, right down to the rank and file voter, understand power. Further, they understand the power of numbers.
Meanwhile, on the Republican/conservative side, we have voters who can’t be bothered to get off their keisters and go vote for someone who is 70% of what they want. Oh NOOOOOOOES … we must have 90% or better … shoot, from what I’ve seen our side demands purity. The candidate must be “America First”, or “MAGA”, or whatever other nonsense a voter may come up with. The voter pats themselves on the back for their precious “principles”, content and convinced they are sending a “message” to the party elites. They stay home, pronounce that those “stupid voters who put the socialist in office will learn their lesson as soon as they get a belly full of what they voted for.” And then, those “stupid voters” DON’T learn their lesson, and socialism marches on. And the conservative continues to beat the dead horse, and continues to not use early voting (because, of course, THAT’S a trap as well), complains when election day comes and those red voting districts mysteriously seem to be the ones with machine issues and on and on. 1) The 60 vote rule exists for all legislation except for judicial appointments, budget reconciliation, and executive branch nominees. If you would like to show me specific instances where the rules were “suspended” in other cases, that don’t fit the above definitions, I’m open to it.
2) Trump isn’t talking about “suspending” the filibuster. His Truth Social post specifically says, “Terminate the filibuster, not just for the shutdown, but for everything else,” Trump wrote Nov. 2 on Truth Social. He said Democrats would end the filibuster “immediately, as soon as they get the chance. Our doing it will not give them the chance.”
If you want to have a rational debate on the pros and cons of “eliminating the filibuster” I’m open to it. If you want to come in with ad hominem to start it off by referring to me as a “bloviated fool” when your facts are wrong, then I will take you as the simpleton you present yourself to be.

The Filibuster is not in the Constitution. The intent was to slow deliberation, and give the minority party a chance to voice dissent. Now, it’s abused. We don’t require speaking anymore, so it’s basically a veto of anything and everything by the minority.
When you consider the fact that the DEMS almost ended it previously, and also that virtually every action of the Executive Branch is tied up with BS lawfare tactics, President Trump is correct. The filibuster is an internal senate rule. It does not deserve protections NOT granted to significant constitutional protections (E.G.4th amendment).
