The New York Appellate Division in Manhattan had previously been skeptical of the case brought by New York AG Letitia James and the ruling by Manhattan Supreme Court Justice Arthur Engoron. There were no victims in the case.
Engoron levied a $464 million judgment against President Trump and his companies. With interest accruing, the end result was a ridiculous fine in excess of $500 million and the removal of Eric Trump and Donald Trump Jr from the company.
The appeals court in Manhattan has thrown out the $500 million punitive award, and suspended Engoron’s ruling that blocked Eric and Don Jr from the company.
NEW YORK (Reuters) – A New York state appeals court threw out on Thursday an approximately half-billion dollar penalty that Donald Trump had been ordered to pay after a judge found that the U.S. president fraudulently overstated the value of his properties and other assets to bolster his family business.
The decision by a five-judge panel of the Appellate Division in Manhattan represented a defeat for New York Attorney General Letitia James, whose office brought the civil fraud lawsuit against Trump in 2022.

As we noted in October of 2023. There are no elements to this farce of a judicial proceeding which will survive appellate court review. The entire motive and process is easily identified by any intellectually honest person as a complete sham and legal clown show, intended to advance extreme ideological Lawfare.
All the banks and lenders did their own due diligence on financing terms with Donald Trump. All operational loans and Trump Org. business loans were paid back. There were no defaults or banking interests adversely impacted. There are no victims of what the State called “fraud.”

This is from the Supreme Court-Appellate Division, which is the intermediate appellate court in NY. The highest court is the NY Court of Appeals.
Trump could appeal on the issue of fraud, because of the plurality opinion in that issue. It was just the monetary penalty that was thrown out. The restrictions on his business remain as there was no majority opinion on the issue of fraud to reverse on that issue.
Two judges wrote that they felt New York Attorney General Letitia James’ lawsuit against Trump and his companies was justifiable and that she had proven her case but the penalty was too severe. One wrote that James exceeded her legal authority in bringing the suit, saying that if any of Trump’s lenders felt cheated, they could have sued him themselves, and none did. One judge wrote that Engoron erred by ruling before the trial began that the attorney general had proved Trump engaged in fraud.
Tish could also appeal on the reversal of the penalty.

How is this different than the allegations against Leticia James for similar conduct?
While there can be disagreement on what the market value of a property is for the purposes of a loan, the owner of two properties could hardly be unable to determine which one was her primary residence. That’s what makes the case against her far stronger. She signed all the documents for both mortgages.
She also claimed a five-unit building was a four-unit building to get a lower rate. It’s not hard to go in and count the apartments. The building plans filed with the city stated five, IIRC.
She also got better insurance on a four versus a five family building.
And she also – for many years – swore on paper that her dad was her husband.
That is not a mistake; that is FRAUD.

I’ve been wondering that too. James was intentionally trying to bankrupt the Trump Organization and drive it out of business. I believe there are old clips of her publicly saying things to that effect. They should be able to recover losses and what they spent to defend themselves, and they should be able to turn around and sue James to the extent it can be shown she was operating outside of her lawful authority as AG, and the State of New York, after this case is completely thrown out.
The Trumps should also move their incorporation from New York to a friendlier state, maybe Florida. If I am not mistaken, James only had ‘authority’ to go after as much as she did because they were incorporated in New York. If incorporated somewhere else, she would have been limited to only things that were done in New York, not elsewhere.

What shows us how stupid the New York AG was is the fact that she seriously looked into charging property tax fraud based on President Trump’s stated book values of the properties not comprehending that it was New York county tax officials that independently set the appraised values without any input from the property owner!

Reading the NY statute involved, it appears to be (or have been originally) just a grant of jurisdiction to the Atty. General of NY to pursue certain fraud cases.
But in Trump’s case (and possibly in some earlier cases, though I have seen none that stretched so far) it was used (in addition) to create a new basis for “fraud” liability — in which no harm to the allegedly defrauded is needed(!).
Like in the federal prosecutors’ application of Sarbanes-Oxely offenses and penalties to J6-ers, the AG of NY seemingly searched the entire code for liabilities or offences stated so broadly that they might apply to Trump. Lawfare at its finest!
