WASHINGTON DC – A federal trade court ruled President Trump didn’t have the authority to impose sweeping tariffs on virtually every nation, voiding the levies that have sparked a global trade war and threatened to upend the world economy.
The decision on Wednesday from the Court of International Trade blocked one of the Trump administration’s most audacious assertions of executive power, under the International Emergency Economic Powers Act of 1977, and sets the stage for a possible appeal by the White House.
“The court does not read IEEPA to confer such unbounded authority and sets aside the challenged tariffs imposed thereunder,” a three-judge panel wrote. (link)
“The Worldwide and Retaliatory Tariff Orders exceed any authority granted to the President by IEEPA to regulate importation by means of tariffs,” the court wrote. The court also ordered that the tariffs that the Trump administration has collected so far be “vacated.”
UPDATE #1: I’m tearing through this ruling right now and I can find several structural flaws in the 3-judge panel decision.

I’ve just gotten started, but that citation is just one reason why the ruling can be overturned on appeal.
The Sec 301/302 investigation and process noted above was completed by USTR Jamieson Greer, with extensive citation. USTR Greer published a 397-page investigative outcome detailing the “unreasonable and discriminatory” burdens to United States commerce. [SEE HERE pdf]
The New York trade court literally ignored the 2025 USTR investigation, AND the 2025 Dept of Commerce review and investigation of the same based on the USTR published findings. All of those factual investigative findings underpin the Presidential actions taken pursuant to his authority under the International Emergency Economic Powers Act.
It looks like the trade court didn’t even review the USTR reports.

The Supreme Court’s 1936 Curtiss-Wright decision affirmed that the President has vast foreign affairs powers independent of Congress that are only subject to any restrictions contained in the Constitution itself. The decision said the President’s authority over foreign affairs are the “plenary and exclusive power of the President as the sole organ of the federal government in the field of international relations–a power which does not require as a basis for its exercise an act of Congress“. It sounds like the IEEPA should be interpreted much more narrowly than this court did today, and maybe even should be more narrow to the point the IEEPA should not have been enacted in the first place.

I think too many miss the irony and brilliance of Trump’s approach. It’s not about tariffs. It’s about reciprocity.
Through the lens of the Trump approach, the counterparties have control of what tariffs they will pay. By applying a general doctrine of reciprocity to these complex dynamics, the countries who remove tariffs on the USA also remove our tariffs upon themselves by doing so, unless there is a profound strategic interest to defend. Not all tariffs are the same and many are of shallow purpose, parochial and political; not strategic.
Under the Trump doctrine, only the most essential interests remain protected by tariffs and only when the benefits of reciprocity tariffs outweigh the formidable direct and indirect costs of doing so. Reducing these costs and bureaucratic burdens seem to have disappeared from the public debate.
It puts the counterparties in control of the tariffs they pay and automates the process by fiat of policy… and does so without layers of consultants, agents, bureaucracy and contravening institutional parasitic structures like interloping NGOs serving global government establishment schemes.
It’s a brilliant approach. Replace a complexity-burdened, indolent mechanism with a self-regulating liberating structure that rebalances dynamically. This creates a new species of counterparty contracts and commerce balancing.
We don’t appreciate the massive costs in time, capacity, talent and capital the current global approach to tariffs requires to operate as a system. So, this was a simple Board then in 1926 is was renamed Custom Court, then in 1980 renamed what it is today, seems they thought maybe they had to head off Reagan, but never needed to. Congress gave the President this power, and thus it will take a 2/3 vote to take it away. So, how can Congress then in 1980, set up what amounts to a Board who can overrule the President, but set it up with only 51 votes, or even 60, but not the 67 needed? So, can Congress take away the Presidents Authority over the Military by setting up a Military board with 51 votes? If you need 67 votes but set up a board (call it a Court) which needs only 51 votes, imho, that an illegal thwarting of the Presidents authority, granted unto him by Congress. This is more Lawfare, if this was a real authority, they would have ruled against Trump in 2016/17. This is more BS Lawfare.

There is an interesting constitutional issue. All federal Judges “… shall hold their Offices during good Behaviour …” which implies they cannot and do not hold office when not in good Behavior. This further implies no ruling or action shall result from less-than good Behavior and would therefore be void and without lawful effect.
This does not appear to be a simple matter of judicial error. The misconduct and gross negligence demonstrated by these judges seem to be conclusive evidence the court’s judges in this case did not hold their office during good Behavior. This appears to be self-evident. If so, the action is void.
If so, Trump could proceed unburdened by corrupt judicial process.

While Article I, Section 8 of the Constitution gives Congress the power to “lay and collect Taxes, Duties, Imposts and Excises” & to regulate commerce with foreign nations,
Congress has historically delegated some of its tariff authority to POTUS, particularly in situations related to national security or trade disputes.
As examples: Sections 232 & 301 of the Trade Act of 1962, and the International Emergency Economic Powers Act (IEEPA), authorize POTUS to take certain actions, including imposing tariffs, under specific circumstances. Basically:
Sec. 232 allows POTUS to impose tariffs on imports, if they’re deemed to threaten national security;
Sec. 301 authorizes POTUS to retaliate against unfair trade practices by imposing tariffs on imports from other countries;
And, the IEEPA grants POTUS the power to impose economic sanctions, including tariffs, in response to national emergencies.

What would happen if the Executive just ignored what lower courts demanded? Initially, I thought that much of this was a ‘set up’ in order to have Trump held in contempt, by not following a ruling, which would allow impeachment #3 to begin in Congress. We learn about ‘checks and balances’…where is the ‘check’ on rogue inferior courts? If such a court demanded that President Trump wear red socks daily, must he do so as his appeal on this ruling begins? It appears to me that, for some reason, it is far easier to ‘check’ the President, than it is to ‘check’ inferior courts….???

Trump should issue his own restriction, by executive order, that the trade court be ignored until they comply with federal law. He needs to do the same with the other activists who violated immigration laws that preclude judicial review. What really needs to happen is for the DOJ to arrest these judges who violate federal law instead of appealing their lawlessness to a higher court. If the courts break the law they need to be immediately held accountable.

Reports, schmreports – the Court is just re-establishing the status quo because reasons. Like Sundance says “there are trillions at stake”. It’s also a ploy to get the Trump administration to just forge ahead and ignore the courts so that the Dems can claim that Trump is “acting like a dictator”, even though it appears his administration has jumped through all of the hoops required to apply the punitive tariffs. The Dems are now in the “we have to ignore the law to uphold the law” phase of their devolution.
Just call the tariffs sanctions, all fixed.

I’m waiting to read the new Constitution, because we the people see that judges, all over the country, are now in charge over the Executive Branch and the Supreme(?) Court. The corporate Democrat Media are their enforcers and promoters. Universities, governors, state legislators, bureaucrats are openly defying President Trump’s Executive Orders, so that they mean nothing, and nothing has been done towards enforcement except threats of withholding funds, which has prompted never ending law suits. Congress could remedy this mess, but they apparently refuse to, like usual. With the Republican’ts in the majority refusing to act, I foresee a big Democrat win at the 2026 mid-term elections.

It is clear that the Judiciary is working against the USA and the Executive Branch. In many cases the Judiciary has issued rulings without time to actually read the case before them and to allow members of the Executive Branch to respond to what they say so the Judiciary is acting as a block.
This will ultimately make people’s view of the Judiciary drop low. Further the Executive Branch controls actions to and from the Judiciary with the Marshalls, Prisons, DOJ, and other groups, which can be used to limit the Judiciary if they wanted to. It is clear that all countries have tariffs on the USA and we did not on other countries.
COVID showed the China produced the virus and Big Pharma vaccines for COVID were produced in China so there was a National Security issue. Industries are gone from the USA due to costs and tariffs will bring them back. Industry is a National Security issue. President Trump realizes this for our country.
