UPDATES AT BOTTOM: A federal trade court based out of New York has just ruled in a three-judge decision that President Trump does not have the authority within the International Emergency Economic Powers Act (IEEPA) to initiate emergency trade tariffs. [The Ruling is HERE]
WASHINGTON DC – A federal trade court ruled President Trump didn’t have the authority to impose sweeping tariffs on virtually every nation, voiding the levies that have sparked a global trade war and threatened to upend the world economy.
The decision on Wednesday from the Court of International Trade blocked one of the Trump administration’s most audacious assertions of executive power, under the International Emergency Economic Powers Act of 1977, and sets the stage for a possible appeal by the White House.
“The court does not read IEEPA to confer such unbounded authority and sets aside the challenged tariffs imposed thereunder,” a three-judge panel wrote. (link)
“The Worldwide and Retaliatory Tariff Orders exceed any authority granted to the President by IEEPA to regulate importation by means of tariffs,” the court wrote. The court also ordered that the tariffs that the Trump administration has collected so far be “vacated.”
UPDATE #1: I’m tearing through this ruling right now and I can find several structural flaws in the 3-judge panel decision.
[From Page 6, pdf] “…[…] in 1962, Congress delegated to the President the power to take action to adjust imports when the Secretary of Commerce finds that an “article is being imported into the United States in such quantities or under such circumstances as to threaten to impair the national security.” Trade Expansion Act of 1962, Pub. L. No. 87-794, § 232(b), 76 Stat. 872, 877 (codified as amended at 19 U.S.C. § 1862(c)(1)(A)). This delegation is conditioned upon an investigation and findings by the Secretary of Commerce, and agreement by the President. See id. Section 301 of the Trade Act of 1974, as amended, requires that the U.S. Trade Representative (“USTR”) take action, which may include imposing tariffs, where “the rights of the United States under any trade agreement are being denied” or “an act, policy, or practice of a foreign country” is “unjustifiable and burdens or restricts United States commerce.” 19 U.S.C. § 2411(a)(1)(A)–(B). I’ve just gotten started, but that citation is just one reason why the ruling can be overturned on appeal.
The Sec 301/302 investigation and process noted above was completed by USTR Jamieson Greer, with extensive citation. USTR Greer published a 397-page investigative outcome detailing the “unreasonable and discriminatory” burdens to United States commerce. [SEE HERE pdf]
The New York trade court literally ignored the 2025 USTR investigation, AND the 2025 Dept of Commerce review and investigation of the same based on the USTR published findings. All of those factual investigative findings underpin the Presidential actions taken pursuant to his authority under the International Emergency Economic Powers Act.
It looks like the trade court didn’t even review the USTR reports.

United States14 upheld a provision of the Tariff Act of 1922 requiring the President to increase or decrease tariff rates as necessary to “equalize . . . differences in costs of production” between articles produced in the United States and “like or similar” articles produced in foreign countries.

Well, now that you have your license, your father allowed you access to the car keys. Your family has two cars. You drive one for a while. For years. Then you start driving them both. Congress ceded that power and authority to the Executive branch decades ago. When courts have previously let the Executive make tariff decisions, they have in effect acquiesced that the Congress has allowed the Executive branch to deal in those matters.
The courts can’t now rule that the Congress can’t do that.
Franklin D. Roosevelt was granted the authority to make tariff decisions by Congress through the of 1934, also known as the Reciprocal Trade Agreements Act (RTAA). This act allowed the president to negotiate bilateral, reciprocal trade agreements with other countries and enabled Roosevelt to liberalize American trade policy around the globe. Since then, the president has mostly controlled and executed tariffs policies as defined by Congress.
Congress effectively ceded a part of its power, as authorized under the U.S. Constitution, Article I, Section VIII, to the executive branch, giving the President the authority to negotiate deals that could reduce tariffs in return for reciprocal reductions from other countries.
In Wayman v. Southard (1825), Marshall noted that Congress could not delegate powers “that are strictly and exclusively legislative.” But Congress had the ability to grant other powers as needed. “The difference between the departments undoubtedly is that the legislature makes, the executive executes, and the judiciary construes the law; but the maker of the law may commit something to the discretion of the other departments, and the precise boundary of this power is a subject of delicate and difficult inquiry, into which a court will not enter unnecessarily,” Marshall concluded.
The Court defined these boundaries regarding tariffs in a landmark decision from 1892, Field v. Clark. Marshall Field & Co. objected to tariffs placed on sugar, molasses, coffee, tea, and hides under the Tariff Act of 1890, which directed the president to place such levies when other nations used tariffs the president “may deem to be reciprocally unequal and unreasonable.” Marshall Field claimed Congress had improperly granted legislative powers to the president.
In his majority opinion, Justice John Marshall Harlan said the president was acting in his executive role executing a congressional policy. “What the president was required to do was simply in execution of the act of Congress. It was not the making of law. He was the mere agent of the lawmaking department to ascertain and declare the event upon which its expressed will was to take effect.”
So all we need is for the Congress to create and pass a similar Tariff Act of 2025 like that one in 1890 to shut these courts up.
The emergency stated by the president can be terminated at his request, or by a joint resolution of Congress, not by a court.
Ultimately, Congress can limit or expand the presidential tariffs powers through legislation, but the Congressional Research Service concludes that based on precedents dating back to the time of Chief Justice Marshall, judicial precedent “has given the President broad latitude to exercise his tariff authorities”.
Let’s get it on. Get it out of New York and to the SCOTUS. The people support the President, and the SCOTUS is compromised. Expose them! Three judges in NY mandating economic policy for the USA! Enough is enough!

It seemed a bit weird when the tariffs were announced and we saw that our proposed tariffs were only about 1/2 of what the countries were employing against us.
So this 3 panel court is saying that all the other countries can tariff us to oblivion but we can’t tariff them at 1/2 of what they are tariffing us??
Seems criminal on the part of the three person court.
And the EU, with their “give us until July 9th” BS, colluding with the Deep State.
