UPDATES AT BOTTOM: A federal trade court based out of New York has just ruled in a three-judge decision that President Trump does not have the authority within the International Emergency Economic Powers Act (IEEPA) to initiate emergency trade tariffs. [The Ruling is HERE]
WASHINGTON DC – A federal trade court ruled President Trump didn’t have the authority to impose sweeping tariffs on virtually every nation, voiding the levies that have sparked a global trade war and threatened to upend the world economy.
The decision on Wednesday from the Court of International Trade blocked one of the Trump administration’s most audacious assertions of executive power, under the International Emergency Economic Powers Act of 1977, and sets the stage for a possible appeal by the White House.
“The court does not read IEEPA to confer such unbounded authority and sets aside the challenged tariffs imposed thereunder,” a three-judge panel wrote. (link)
“The Worldwide and Retaliatory Tariff Orders exceed any authority granted to the President by IEEPA to regulate importation by means of tariffs,” the court wrote. The court also ordered that the tariffs that the Trump administration has collected so far be “vacated.”
UPDATE #1: I’m tearing through this ruling right now and I can find several structural flaws in the 3-judge panel decision.

L. No. 87-794, § 232(b), 76 Stat. 872, 877 (codified as amended at 19 U.S.C. § 1862(c)(1)(A)). This delegation is conditioned upon an investigation and findings by the Secretary of Commerce, and agreement by the President. See id. I’ve just gotten started, but that citation is just one reason why the ruling can be overturned on appeal.
The Sec 301/302 investigation and process noted above was completed by USTR Jamieson Greer, with extensive citation. USTR Greer published a 397-page investigative outcome detailing the “unreasonable and discriminatory” burdens to United States commerce. [SEE HERE pdf]
The New York trade court literally ignored the 2025 USTR investigation, AND the 2025 Dept of Commerce review and investigation of the same based on the USTR published findings. All of those factual investigative findings underpin the Presidential actions taken pursuant to his authority under the International Emergency Economic Powers Act.
It looks like the trade court didn’t even review the USTR reports.

Good question as it seems precious few here understand the concept the founders used when constructing the Constitution…that of “enumerated” powers. There are some here that do, but precious few. That simply means if the Constitution does not say the feds can do something, then they cannot. Very simple concept as explained over and over in the Federalist Papers by Madison, Hamilton, and Jay.
Think of the Constitution as a permission slip of the ONLY objects the federal government has the authority to address. All others are left to the States.

A majority of justices on the Supreme Court have expressed a view, through one opinion or another, that the Federal Courts are Superior to the Executive Branch IN ALL THINGS. They take an “imperial” view of Judicial authority. Imperial, as in “divine right of kings”, who they consider themselves to be. The Supreme Court has recognized NO LIMITS on their authority since Trump took office.

Like all inferior Article III courts, this one was established by Congress, most recently in 1980:

This court is unrestricted geographically, but is limited to issues involving international trade. Sounds like the three-judge panel has decided that the President exceeded his authority under the International Emergency Economic Powers Act (IEEPA). The President will of course appeal this immediately, if necessary to the Supreme Court, maybe arguing that the burgeoning Federal debt of $37 trillion constitutes a National Economic Emergency (which of course it does!).
The Congress could clarify and expand the President’s tariff power under the IEEPA, but given that the Democrats will not vote for anything that helps President Trump, there is no way to pass new legislation in the Senate (unless we get rid of the 60-vote ‘filibuster’ limit, which of course we should).
The President could find other authorities in the Law to continue his tariff initiatives. Failing this, sounds like we have to rely on the Supreme Court to nix this decision. It had better happen soon, or the whole MAGA Re-industrialization effort will collapse. It is not just trillions at stake, but the whole future of the Republic.

Technically I think the court is correct, President cannot declare an emergency instantly with every country on the planet. US Const = US Congress sets tariff policy. The other countries used their system to over decades of time to add in the tariffs, VAT’s etc to gain advantages legally through their Parliaments.
Any country however completing a bi-lateral trade agreement will be bound by that new document if it is properly signed by all authorities. Which I believe none have so far.

How can the Article 1 powers of Congress cancel out the Article 2 foreign policy powers of the President with this IEEPA law? Utterly absurd. How do the plaintiffs even have “standing”? This so-called court probably expects President Trump to spend most of his term appealing this back and forth and ultimately to the Supreme Court, which will use Article 3 powers it does not have to again cancel out his Article 2 powers. While appealing this ruling, he needs to make known that he will not obey it and cite Article 2 for his basis in doing so.

Seems President Trump has two options. Start ignoring the judges and their rulings and be president or go home and let the judges finish his term. I know President Trump wants to follow the law but what is the answer when the judges don’t.

PDJT should claim inherent emergency powers under Article II of the Constitution to suspend IEEPA, arguing it interferes with his foreign affairs authority.

The Court of international Trade is located in Lower Manhattan and has lifetime appointments made by the President with advise and consent of the Senate. The judge who is now Chief justice was appointed by Barack Obama.
The court was established in 1980 under Article III.
