Today is the oral argument before SCOTUS on the Trump administration’s appeal of a district court order staying the Trump’s EO on birthright citizenship. The case does not just involve citizenship, but also the issue of the nationwide orders issued by federal district judges. The Court did not limit the appeal to the birthright citizenship issue, but granted cert to the whole case.
Why take the nationwide order issue, too? Maybe enough justices decided that the many appeals to the circuit courts and SCOTUS were getting to be a headache. No doubt there have been some private complaining phone calls to SCOTUS from circuit court judges about the flood of appeals, and how these appeals have clogged the appellate docket.
How could the Court vote? Roberts and Barrett are unpredictable, and so is Gorsuch at times. Roberts dislikes Trump, although his dislike is not the pathological, puts-the-deranged-in-Trump-Derangement-Syndrome loathing of Boasberg.
The Solicitor General will likely present both issues as broad constitutional issues. The respondents will probably go “Trump, Trump, Trump!” and “Think of the children!”.
I think some recent opinions on the authority of each of the three branches might help. The obvious one is Trump v. U.S. (6-3), the immunity case, in which the Court held “the Constitution vests the entirety of the executive power in the President.” (Roberts wrote that.)
The recent reversal of the district court injunction staying the removal of trans in military (6-3) recognized the president’s authority as commander-in-chief.
In Loper-Bright (6-3), the Court reversed Chevron, and ruled that judges must not defer to agency interpretation of congressional ambiguity in laws, but conduct their own judicial review. This really stuck it to the administrative state, as there can be a lot of ambiguity in those 1000+ page bills.
In Jarkesy (6-3), the Court ruled that the SEC could not bring proceedings before an SEC administrative judge against someone for offenses that were basically common law crimes like fraud. The Seventh Amendment required a jury trial in district court for common law crimes.
Roberts also wrote the Court’s opinion in Students for Fair Admissions v. Harvard (6-2), which reversed past judicial fixes to preserve affirmative action; the Fourteenth Amendment and the 1964 Civil Rights Act were clear on racial discrimination. And of course Alito’s Dobbs opinion (6-3) basically held that the Court exceeded its authority in finding a “right” to abortion.
So one might interpret these as a majority of the Court’s desire that each branch “stay in its own lane,” to use a tired phrase. This doesn’t mean that Roberts is any friendlier to the views of the Trump administration, but that both he and Barrett (and the other four) might be looking to the years after Trump’s term ends, and want to ensure the Court’s “legacy” in interpreting the Constitution, the separation of powers and the scope of each branch’s powers.
The opinion could come down quickly or it could be released some time by the first week of July. Scotusblog.com and the Volokh Conspiracy blog at reason.com will probably have the most unbiased analyses.

The Constitution assigns to Congress the matter of ‘naturalization’ (def. the conferment of citizenship).
The Constitution also elucidates, in the clause describing eligibility for President, that there will be natural born citizens.
The Supreme Court is not being asked to opine on anything to do with natural born citizens.
The Court is being asked whether Congress has passed any act which states that anyone born in this country automatically inures citizenship.
This is Congress’ responsibility to decide whether they will fulfill their Constitutional duty of making laws of naturalization, or keep the turmoil swirling because they can grift off it . . . IMO, of course.
The only limit to natural born citizenship in the Constitution is the phrase “not subject to its [the US] laws.”
This exempts children born to diplomats, as diplomats have diplomatic immunity.
Any other foreigner on US soil is subject to US laws, as many an illegal have found out.

I’d not put any ‘limit’ on what natural born citizens are subject to; they are subject to everything that any other natural born human being (everyone) is.
It is citizens whom are limited in the manner in which they accrued their naturalization, which is dependent upon Congressional action to effectuate, as has been done many times in the past 235 years.
Ellis Island is a monument to “those who played by the rules.” Their descendants today now proudly display their ancestors’ hard-earned naturalization certificates. It can be done the right way.
My wife’s grandparents came in through Ellis Island and we found their documents online. It showed how much money they had and where there they going, who they would be staying with. They came here to become American citizens not haters of America trying to take it down!!! I met both of them and they had become Americans who could speak two languages but only English in public because they had become Americans!
Of course it can be done the “right” way….but we all know, beyond a shadow of a doubt at this point, this has been about creating a new Demonrat voting block – for the final, on-going one party rule – as the previous ‘reliable’ concentric circles have been steadfastly falling away. Its the Dims’ own version of their ‘final solution’.

The Fourteenth Amendment, Section 1, says that anyone born in the US “and subject to its jurisdiction,” is a citizen. (Sorry for the misquote.)
There have been cases over the years about people who claimed US citizenship because they were born here when their foreign parents were here working for the parents’ native country. If the parents had diplomatic status, citizenship has been denied. Today’s case is about children born to ordinary foreigners who did not have diplomatic status.
This case also addresses people inside the US who are here ILLEGALLY per the Immigration Laws passed by congress, which makes technically not subject to US Jurisdiction … but subject to actions of US Immigration Authorities to be deported or granted legal resident status.

” privileges ” as provided under citizenship / non- citizen doctrine.

Tourists and temporary foreigners of all stripes do not, e.g. have to pay income taxes in the United States, or file on their foreign holdings. They don’t register for Selective Service. Etc. They are not permanent residents or fully subject to U.S. jurisdiction or loyal to the United States.

Chief Justice John Roberts spent a week living at Norm Eisen’s 150-room palace in the Czech Republic where they “worked on American and European Rule of Law issues together.” Roberts became Chief Justice in 2005. This was while Roberts ran SCOTUS.
Neither the SCOTUS or any other court has demanded THIS which is NOT an OPTION.
That should tell you how hopelessly corrupt and rigged the judicial branch is when required things are simply ignored wholesale.

Under Federal Rule of Civil Procedure 65(c), judges can issue injunctions “ONLY IF” the suing party posts a bond to cover potential damages if they’re wrong. But guess what? This rule is hardly used!
When I was in the White House, in Trump’s first term, I suggested this, but DOJ didn’t make it happen. Imagine if we had applied this to the travel ban – activists would think twice before blocking policies with potentially billions at stake.
For national injunctions, we’re talking bonds in the hundreds of millions or even billions. It will become prohibitive unless the activists have a slam dunk case.

Trump’s Administration has finally taken notice of Rule 65(c) when it comes to Federal Courts:
(c) Security. The court may issue a preliminary injunction or a temporary restraining order only if the movant gives security in an amount that the court considers proper to pay the costs and damages sustained by any party found to have been wrongfully enjoined or restrained. The United States, its officers, and its agencies are not required to give security.
This is not discretionary and the court cannot assess a “de-minimus” security amount either; it must be defensible predicated on the costs and damages that the other party may or will suffer with the evidence of same in the order itself if the injunction or TRO issues until disposition of the case and the posting of said security has to be completed before the TRO or injunction is valid.

Thus where is Pam Bondi with immediate emergency filings against all of the existing injunctions already issued demanding that security be posted up and computed in said public filing and, if there is any delay or refusal by the judges involved to do so taking an immediate emergency appeal as far as necessary including to the Supreme Court which, given the actual language in the Rules of Civil Procedure is a slam-dunk and immediate win? No, demanding this only on a forward basis for future filings is not enough — force the movants in all the existing injunctions to either post up security or dissolve the injunctions and TROs.

A law that is not enforced is, well, not a law. So very third-world.
When those demoncrats line up in front of the gates of that detention center, they are making america LOOK like a third world country.

A key problem is that the Judiciary is out(!) of its lane. “Article 3” purposely does not grant any power of “review and consent” to the Courts. The scope of the Branch was limited to “cases and controversies.”
One day, in Marbury, the Courts simply assumed these greater powers to themselves, and no one at the time told them to go to hell. Only Presidents Jackson and Lincoln, so far, have done so.
Eventually, Trump will probably be forced to do so. But right now he is “playing nice,” and giving them plenty of rope with which to hang themselves. Playing by their rules, he is showing the absurdity and unsustainability of their position – and their lack of enforcement power.
On its face, there is no Judicial power to issue a “ruling” in a district Court and to declare that it has national binding. Let alone upon the “Article 2” or “Article 1” Branches. The word, “unconstitutional,” does not appear in the text. Nor is it even contemplated.
Oh yes. Marbury was a power grab.
POTUS plays “nice” to avoid impeachment.
If the midterms keep the current House and Senate, and perhaps improve the margins a bit, President Trump can go full honey badger on the lawless courts.
As I recall, Jefferson didn’t even send a lawyer to argue before the Supreme Court in Marbury v. Madison, and the Supreme Court knew if it ruled against Jefferson, he’d ignore them. So the determination that the judiciary could review actions of Congress and the Executive was dicta not really addressing any case or controversy. I’m kind of surprised no president since then has pushed this issue, but then again, courts haven’t gone off the rails in abusing their authority and intruding on the Executive Branch prior to Trump.
If the public knew that the Constitution does not provide for judicial review and that it doesn’t require judges be impeached for “high crimes and misdemeanors” to be removed from office (courts just made up judicial review and the impeachment “requirement” for federal judges to be removed), I think it would see the judiciary in a very different light. Roberts knows this. If he’s smart, he’ll reign in these courts. No president is going to let a court decide whether or not an invasion has occurred, nor should he.

Pundits have suggested today’s ruling may address the validity of district/regional Federal judges making nationwide rulings. At stake is the diminishing legitimacy of the legal system. We shall see

Here is the game plan that the forces against Trump will be using for the foreseeable future.
They will attempt to get you to make the perfect the enemy of the good.
Be it the freedom clowns and spending, the immigration hawks with H1B visas, the peace doves with timing, the cultural warriors with total bans of DEI/CRT, the neocons with war fighting, or the swamp dwellers with draining the swamp.
All of them will attempt to get you to believe on whatever issue is the issue of the day that it doesn’t go far enough or do enough.
They will try to make you think that some sub issue of that issue is more important and should be handled first, that since the issue hasn’t been handled yet it won’t be, that we can’t do more than one thing, that so and so is a plant to stop the draining of the swamp, or that because it wasn’t 100% Trump lied. On every single issue, one or more groups will attempt this strategy.
You can’t allow them that power over you. If Trump secures the border and deports 2 million, don’t allow them to reduce that good by them saying well he didn’t deport 2.5 million, so he failed or lied.
You can’t allow them to use the perfect to void out the good in the coming months.
They will try. They already have with the CR and the H1b visa debates. It works, that is why they use it.
You have to keep it in the front of your head on everything about to occur that half a loaf or hopefully in most cases 7/8ths a loaf is better than no loaf.

You can see the birth of a huge Colonia that has virtually doubled the size of Liberty County, in the last five years.
The lots are approximately 0.25 acres. Housing varies from tents to portable storage buildings to RV’s to single wide to double wides. Very few stick built homes.
Packed in like sardines. Every street has a Spanish name.
I just represented a land owner in the same county. A development is being put in adjacent to his farm that will have over 100 lots that vary from an eighth to a tenth acre in size. These will not be high end zero-lot line homes or condos.
It will be the start of another Colonia.
County officials have been virtually bought-off to allow this kind of growth. They have no infrastructure to support this growth and the socio-economic level of the people moving into these Colonias will not support enough ad valorem taxation to build the required infrastructure.
Additionally, the legal citizenship status of these new people is questionable.

Born and raised on the souther border betwee Arizoan and Mexico I have been seeing illegals jumpig the border for about 65 years.
They use to come here during our harvest and became so intrinsic in this process that the farmers screamed bloddy murder when our gov tried to crack down on the illegals.
Over the decades I now see that the illega border jumpers seemed to have made themselves indespensable to so many of our American businessses.
Not just farmers but every single aspect of our construction business and so very many others.
This must end or America is over.

President Trump is transparent in his words and actions. He is consistent in what he says, what he does, and what he asks/demands of others. His promises are bold and he keeps them like no other president has. He is making massive, nearly overnight changes, not only in the country, but in the world. It is amazing that he is able to accomplish so much when there are so many snakes in the grass This term, he is weeding them out faster.
The purpose of President Trump is plainly visible and consistent: He is for the benefit first of the common PEOPLE of this country, then of the PEOPLE in the rest of the world. It is validating, even to our battered conservative skepticism.
The methods of his leadership are amazing. I still don’t get HOW he does it, or HOW he is able to get so much momentum going, but every day the momentum is growing. Everyone and every organization has their eyes opened every day — just by watching him. Even those who hate him, are biased against him, and want to see him gone — cannot ignore him. He lives rent free in their head, and they come around to seeing the universal principles by which he is operating. He hammers actions based on truth from one direction, then another, and they cannot mount an organized opposition against him.
He has chosen to use his intellect and every skill he has to do what is right. He has tremendous faith that he can make a difference in this world. He has a confidence and courage such that he doesn’t care what others think, yet a humility to know he has to do it with the help of like minded people. Those people are the “common” people, and he ridicules those who think they are not common.
He believes people are basically good. He believes that God is real. He believes that healthy people are happy people, and they need to be able to create wealth freely for their labor, and have the freedom to spend their money on what is good for them.
He believes the United States, with its Constitutional Republic, is the best environment in the world to enable and give opportunity for people to be happy and prosperous.
He believes that we can be a light for the world, but we must demand that the rest of the world respect us and our right to life, Liberty, and the Pursuit of happiness.
He believes the enemy of our country are the stupid, greedy American people who have been selfishly taking advantage of this country; who betrayed the trust and obedience of its people; and who diverted the people’s wealth for their own selfish gain, at the expense of the principles of this country. He’s not going to allow that anymore.
He has cultivated and focused the family of MAGA. Identifying those people whose goodness, industriousness, trust, and obedience have been taken advantage of and abused. He has opened our eyes to this abuse, and the rights of freedom and self determination that have been quietly stolen from us.
He has rekindled the healthy distrust of government and men with too much power held by our founders. He has recultivated the desire to reclaim our freedoms and rights, and is empowering us with a hope and pathway to reclaim our spiritual and economic freedom.
He wants the US to be a light of hope on the hill for all people. He will negotiate win/win agreements with those nations and countries who respect us; who respect the principles and intent of our Constitution. If you do not respect us, however, we are not going to let you take advantage of our goodness, or share in our wealth at our expense. If you as a nation are treating your people badly, you are going to be treated less favorably by us, until you show that you value your people as much as we value ours.
He is convincing those who are very wealthy (most of whom truly earned their money), that the best economic soil in which to build wealth is in a constitutional republic, which supports the ability of the common man to earn wealth in proportion to his efforts. The economic engine of the United States is the human spirit freed to enjoy the fruits of honest labor, and that engine has more natural and raw horsepower than any other governed economy.
The Trump Train seems to be remarkably aligned with universal principles of Truth, which reflect the will and design of our Creator, and are the best standard by which we should live. These same principles were what our country’s founders used to declare independence, and framed into the Constitution of this nation.
Our founders believed that a nation should preserve the right and freedom of an individual to seek, understand, and live by God’s principles. They believed that free individuals working together in humility would make a stronger nation than a government which dictates its will on the people. President Trump professes and seeks to lead and restore this nation back to these same principles.
These principles resonate deeply within all human beings, down to our DNA in every cell, in our spirits, and produce fruit that “miraculously” multiplies. Because we follow universal principles, we see the snowballing acceleration of momentum on day 116 of the 2nd term of this very stable genius in the history of the kingdoms of this world in the year of our Lord 2025.

But, representatives from those States are what define those Federal laws, and can change them.
A Judge, sitting in her own courtroom, cannot defy these Federal laws, nor obstruct enforcement agents who are seeking to enforce them. Just because “she doesn’t agree.” This person unquestionably did use her position to try to lead the offender to a back-door exit, not realizing that Federal agents were also guarding it. There is no “10th Amendment” angle to this criminal act.

The reason why is simple: The issue before the Supreme Court is narrow and does not concern the propriety of nationwide injunctions in cases brought under the Administrative Procedure Act (APA). And the majority of nationwide injunctions entered against the Trump Administration since the president returned to Washington came in cases challenging decisions under the APA.
In his application for a stay, the president stressed he had but “a ‘modest’ request” for the Supreme Court: Rather than request a stay of the injunction in total, to allow the president’s EO to take effect, the Trump Administration sought only to “restrict the scope” of the preliminary injunctions “to the parties actually within the courts’ power.” In other words, the Trump Administration attacked only the “nationwide” scope of the injunction.
That the Supreme Court scheduled oral argument on the nationwide injunction issue, while the underlying question of the constitutionality of the president’s EO continues to percolate in the lower courts, suggests several of the justices have grave concerns over nationwide injunctions. Further, as the Trump Administration’s brief highlights, five justices — Justices Alito, Barrett, Thomas, Kavanaugh, and Gorsuch — at different times and in various concurrences or dissents, have criticized the use of nationwide injunctions.
Taken in tandem these facts suggest the Trump Administration will prevail in its challenge to the nationwide application of the injunctions.
This sounds like the Lawfare crowd using the Federalist to pre-position its messaging, assuming a defeat on the birthright citizenship issue.

about a police officer who was trying to stop a driver who incurred a toll booth violation, which ended in the death of the driver who evaded the officer. Complicated situation as the officer’s life ended up being in danger so he shot the driver who was dragging him after the officer somehow got stuck on the floorboard or something of the vehicle. The case has to do with some fine points of when a court needs to consider the entirety of the situation which caused the death or if the court only needs to consider the immediate (less than 6 seconds) situation which the officer felt the need to respond the way he did. (the family of the deceased had sued for compensation.)
The case was sent back to the lower court with instructions to that lower court which of the two (entirety of incident or immediate, less than 6 seconds to make a decision, reason) to consider when it determines the case before it.

In general, Trump does not view foreign countries in terms of good guys and bad guys. We should all stop doing so, as that is a deep state ploy to justify actions that are unjustifiable.
Trump is a businessman. He correctly views foreign affairs through that lens. Each business/CEO is looking out for its own interests. When those interests overlap a deal can be made. Another time, the two may be in opposition. The question for him is whether an arrangement can be made that is favorable to the US.

Ryan Hinton was an 18-year-old black man living in Cincinnati, Ohio. On May 1, 2025, he and three friends were pulled over by the police in a vehicle the police officers believed was stolen. The four youths took off running. The two police officers who had made the stop pursued on foot.

The father, Rodney Hinton, Jr., was upset. So, later that day, he got in his car and ran over a sheriff’s deputy directing traffic outside a University of Cincinnati graduation event. The officer was killed.

U.S. energy officials are reassessing the risk posed by Chinese-made devices that play a critical role in renewable energy infrastructure after unexplained communication equipment was found inside some of them, two people familiar with the matter said.
Power inverters, which are predominantly produced in China, are used throughout the world to connect solar panels and wind turbines to electricity grids. They are also found in batteries, heat pumps and electric vehicle chargers.
While inverters are built to allow remote access for updates and maintenance, the utility companies that use them typically install firewalls to prevent direct communication back to China.
However, rogue communication devices not listed in product documents have been found in some Chinese solar power inverters by U.S experts who strip down equipment hooked up to grids to check for security issues, the two people said.
Over the past nine months, undocumented communication devices, including cellular radios, have also been found in some batteries from multiple Chinese suppliers, one of them said.
Reuters was unable to determine how many solar power inverters and batteries they have looked at.
The rogue components provide additional, undocumented communication channels that could allow firewalls to be circumvented remotely, with potentially catastrophic consequences, the two people said.
Both declined to be named because they did not have permission to speak to the media.
“We know that China believes there is value in placing at least some elements of our core infrastructure at risk of destruction or disruption,” said Mike Rogers, a former director of the U.S. National Security Agency. “I think that the Chinese are, in part, hoping that the widespread use of inverters limits the options that the West has to deal with the security issue.”
