If you listened to Ed Martin naming the people within the lawfare community of DC operatives who are actively working to weaponize the legal system to block and attack reform efforts within the DOJ, then you likely understand the origin of these latest maneuvers.
Outgoing USAO Ed Martin, and current head of the DOJ ‘weaponization working group’ has revealed that Lawfare operators have filed ethics complaints in an effort to challenge his legal license. This is what happens when the U.S. Attorney General, Pam Bondi, doesn’t face down the internal lawfare operation within Main Justice severely enough.
(VIA REUTERS) – The lawyer President Donald Trump tapped to serve as Washington, D.C.’s top prosecutor and then dropped in the face of Senate opposition, said on Wednesday he is facing a professional ethics investigation, according to a letter seen by Reuters.
Interim Washington U.S. Attorney Ed Martin said in the letter sent to his staff on his last day on the job that he is under investigation by the D.C. Office of Disciplinary Counsel. The office is in charge of investigating and bringing misconduct proceedings against attorneys in the district.
Martin alleged that Hamilton “Phil” Fox, the attorney investigating his conduct, had breached the confidentiality of the investigation by sharing a copy of the complaint with the department’s Civil Division.
“It is an outrage how they treat us and I will continue the fight against the weaponization of our law licenses against us,” Martin wrote in an email.
“I am taking on Mr. Fox head on. His conduct is personally insulting and professionally unacceptable.”
Fox declined to comment on Martin’s claims, citing confidentiality rules.
In the email, Martin attached a copy of a May 9 letter he sent to Chief Judge Anna Blackburne-Rigsby of the District of Columbia Court of Appeals asking her to investigate and suspend Fox, and to dismiss the complaint filed against him. Martin’s letter did not specify the nature of the ethics allegations filed against him.
There have been at least five formal ethics complaints filed against Martin that were made public by nonprofit watchdog groups, ethics experts and members of Congress during his brief tenure as interim U.S. attorney.
At least one of those complaints has since been closed, after Fox concluded that Martin did not technically violate disciplinary rules when he filed a motion to dismiss a case against a person charged with taking part in the January 6, 2021, assault on the U.S. Capitol whom he had previously represented in private practice. The Office of Disciplinary Counsel is tasked with reviewing any ethics complaint filed by anyone at all against a member of the DC Bar.
It appears the ethics complaints at issue here were filed by nonprofit leftist groups and members of Congress, not by the currently serving bar counsel acting on its own.
Those complaints would need to cite specific breaches of the Rules of Professional Conduct, and support the allegations with some actual evidence in order to survive a preliminary review.
This is normal. FWIW, the DC Bar magazine has an entire section every month setting out disciplinary actions taken against attorneys who have fallen afoul of the ethics rules. By name, and spelling out the breach. It is a public action, and a public humiliation.

Without diving into this in great depth, it appears that Mr. Martin’s complaint is not that ethics complaints were filed – there is no stopping that – but that bar counsel breached the confidentiality that is absolutely necessary to the performance of its work to prevent putting an imprimatur of truth on often scurrilous and inaccurate allegations by everyone from dissatisfied clients to unhappy opposing clients.
If the attorney in question deliberately and without some sort of legal authority did publicize an ethics complaint in such a way as to undermine Mr. Martin’s ability to perform his job, that would indeed be a very, very serious matter that might well result in a suspension of that person’s license to practice law, or even possible disbarment.

The Board’s options are: Private Reprimand (a confidential letter to the lawyer), a Public Reprimand, which is posted on the website and cited in the bar magazine, Suspension (which is for a term of years, and reinstatement is not automatic – one must petition for it), and Disbarment.
The filing of the complaint and the Board’s investigation are confidential, mostly for the reason Alex1689 give: a lot of dissatisfied clients file complaints that don’t raise a violation of the Code of Ethics.
I knew one lawyer who was reported to our Board (by judge, yet), and got a private reprimand. He retired with a spotless record. Most of the lawyers in his firm never knew of the complaint and private reprimand.
The ethics investigator in Martin’s case should be removed from his post for violating confidentiality of disciplinary proceedings.
These people are deliberately acting against the constitutional power of the President of the United States to appoint people in the executive branch. The President should order the Department of Justice to arrest anyone making such false claims against his appointees. Make them defend themselves in both federal civil and criminal court proceedings. Bankrupt them and put them behind bars.

What no one asks: where the hell do the DC courts, DC belonging to every citizen of the United States, and not itself a sovereign state, get off making up their own rules regarding how or when lawyers who otherwise are duly licensed in good standing in one of the 50 states are entitled to practice before them.
The District of Columbia is not a state, and notwithstanding the federal government allowing it to have a modicum of “home rule” for stuff like city ordinances, traffic violations, and the like, managed by the D.C. Superior Court, by definition, it is essentially a federal government jurisdiction. And the D.C. District court, and appellate court, handle federal cases.
And for that matter, a secondary and similar issue is the various different rules for admission to practice before other federal courts. Admission to one should be admission into all, albeit sometimes issues particular to a state spill over into the local federal court, so at least here there is some rational argument (the counter-argument being that no federal court is given this right under the U.S. Constitution.) But D.C. doesn’t even have this one argument; it is not a sovereign state.

– The process is not the problem
– Bar disciplinary action resides in the highest court to which an attorney is admitted in that state or jurisdiction. In this case, that is the local, not federal, DC Court of Appeals. The Disciplinary Office does the investigation when a complaint is filed, screens out the obvious crazy ones, fully investigates the real ones, and makes recommendations to the Court of Appeals about whether a breach occurred and what disciplinary measure it recommends. Any action taken against an attorney is by the DC Court of Appeals itself.
– The Attorney General of the United States has zero input and zero role in a DC Court of Appeals bar disciplinary matter. Her interjecting herself here would be extremely inappropriate. People who used this post to launch into anti-Bondi tirades about this particular matter with Mr. Fox are either ignorant of the process or have an obvious agenda of circular firing squad.
– in general, disciplinary investigations in most States are undertaken by local attorneys who volunteer for the task, as a matter of the bar as a group helping to discipline itself. I do not know whether Mr. Fox is a paid staffer or a volunteer, but I do know staff and panels are sworn to absolute confidentiality until and unless the Court of Appeals takes action.
Might there be a violation of criminal law for disclosing internal documents in a disciplinary matter? I don’t know. I doubt it. The remedies are probably civil (cause of action for defamation or tortious interference somehow) and

If releasing this prevents Ed from doing his job, which it is, then, it’s not far fetched to say they are obstructing justice.
