District Judges are actually very independent. In other words, retention of their appointment to the judgeship is not dependent upon declining such a request. Were all such judges, ones who follow the rules and the law, it would go a long way towards repairing our federal judiciary. The Rhinos who recently failed to show up for the vote on the Biden/Obama et al. regimes’ appointment of a large number of judges to the bench, missed the opportunity to fight for reformation of our judicial system. This is a legally conservative decision. Trump is still a private citizen, and this is a state-court case. Remedies available for appeal have not yet been initiated or finalized in state court. Relax, everyone.

You can pretend or choose not to know things, but from a legal standpoint, the decision is correct. The case should not have been brought, but state courts have their own appellate procedures. Failing that, if there are any federal rights that have been breached, they can be brought in federal court after the state court remedies have been exhausted. That’s how the judicial system works.
The Constitution requires that all states provide a republican form of government. Lawfare is clearly an attempt to exclude that. The feds must uphold the Constitution. They didn’t.
Same with election theft. The SC has an oath obligation to uphold the Constitution.
In both cases, organized efforts to undermine the Constitution are underway. The SC is obligated to recognize this and address it. One case, one trial, maybe. A dozen? It’s a conspiracy.
It’s called exhausting your remedies. You work through the tiers of the state appellate system, and when you have not received a legal remedy in the state system, then you can move to the federal system.

The decision completely avoids the Constitutional issues that are fundamentally the problem with what Bragg and Merchan have done.
The Supreme Court is pathetically weak thanks to Roberts and Barrett; if it had been this court in 2000, Gore would have been president by judicial fiat.
The appeal was only to suspend the sentencing. It did not raise the constitutional issues that are certainly fundamental. (State court prosecuting violation of federal campaign finance laws?).
Appeals courts only address the specific issue in the appeal papers.
I think it’s better this way. SCOTUS stays out of a clearly political lawfare suit. it ruled in favor of Trump would only avert a lawfare stain on Trump’s bio. which and when the corrupt NY judge sentences Trump, it will hopefully cause the beginning of the end of NY Dem Stazzi’s control.

The acts accused of were allegedly committed when Trump was out of office. That’s how Merchan denied immunity.
As if the office of the President is no more important than any single criminal court defendant.

To get to root cause, Trump must demand Roberts’ resignation. He’s broken the law and violated the Constitution in the running of that FISA court. Trump needs to take 10 minutes laying out the charges, with facts, pronounce sentence and demand he go.
Even if he refuses, he should carry that stigma forever.
I think Trump’s DOJ can reveal what’s been going on in the FISA court by revealing the search warrants requested by the Obama and Biden administration. That might be embarrassing enough.
Roberts can only be removed through impeachment. He’ll never leave, and he’d never be impeached.
Trump is the President. He can call out anybody he wants, and speak with the full weight of the Executive.
The DoJ is compromised. This is above them anyway. Roberts is a miscreant and the President must call him out as a duty of the office, no matter the outcome.
Barrett went from law professor to appellate judge without any other experience as a lower court judge. Then, after a very short time on the 7th Circuit, was appointed to the Supreme Court. Make it make sense why we outsource vetting to the libertarians who are not even fully conservatives.
If Chief Justice Roberts was concerned about justice in this important matter, he could have told the Supreme Court that because there had been plenty of time to bring these charges and go through the process long before the election but this is all happening at the last minute, it is clearly motivated by politics.
For the sake of justice he could have demanded a unanimous decision or else ruling against those seeking to prosecute the President. The Supreme Court has in the past made bad decisions but by the time these have been reversed much damage has been caused that could not be undone. Justice demanded that the benefit of the doubt be given to Trump not to politics.
Biblical Law – which is foundational in on the formulation of law in the West – demands tested evidence for someone to be found guilty. That is why the following instruction was given in Deuteronomy 19:15
“A single witness shall not suffice against a person for any crime or for any wrong in connection with any offence that he has committed. Only on the evidence of two witnesses or of three witnesses shall a charge be established.”
While Justice Amy Coney Barrett professes to be a devout Catholic she appears ignorant both of the Scriptures and lacks a proper understanding of fallen human nature. These would have helped her recognize the lies and deceit in this whole case and changed her vote.

Could this be the court stepping out of an obvious (to any rational person) lawfare mess in order to retain a sense of independence?
They expect this to get fixed in appeal, so why step on a landmine now? They can avoid an appearance of impropriety perhaps.
I’m getting a vibe that since the opinion contains the language that SCOTUS expects the ‘ruling’ to not interfere with the President’s activities, that anything beyond what judge Morchan (moron-Merchan) already stated about this being some sort of deferred adjudication would bring swift and harsh action from SCOTUS (or that the avenue to seek them for such would thereby be ‘open’).
Or maybe/additionally, this is a distancing step by the ‘conservative’ court members because they expect Trump will get to choose another judge in the next couple of years and they want to assuage any fears that current ‘Trump judges’ are independent thinkers and not under his thrall? (unlike the lefty nut-jobs currently enthroned). In so doing, expect to avoid any crazy nomination antics by the left?

Roberts “joined the court’s 3 democratic appointees” long before this ruling and Coney Barrett is well on her way to doing the same. “6-3 conservative majority” is a fiction pushed by the dems.
I may be wrong, but this is this quickest route to appeal and get it all over with. If not, it’s hanging over his head for 4 years and then sentence to jail.

In a way it’s a positive. The appeals process can only take place after he is sentenced. On January 20th Trump can appoint a special counsel to investigate all the people involved in lawfare. I would not want to be Judge Merchan or his daughter. They have a blatant conflict of interest.

Wait, the order seems to claim that regular appeals are not yet completed. Sorry, I do not suffer from TDS, but I also do not suffer from other many derangements. SCOTUS seems to have deferred any action on this until lower court appeals are exhausted. Do you think Ney York State Troopers are going to show up at 1600 with a warrant?

And just nearly like clockwork we can count on one of the three, Barrett, Kavanaugh or Roberts, two of which Trump himself appointed to the bench and the other one, which is always called a “Conservative”, stab the President in the back. This one to me though is the most grievous of all. With this one, we have a Totally Conflicted Judge that should never have been allowed to even preside over this case. I think the immunity argument is the weakest. There are a great many grounds for appeal based in established law and precedent which would apply to any defendant, not just to a President.

True. The statute of limitations had run on most charges. The charges were all misdemeanors under NY law that Bragg elevated to felonies with some pretzel logic.
And a state court has no jurisdiction over violations of federal campaign reporting laws.
The supreme justices don’ seem either supreme to me or fitting to be called justices. So annoying to always read ‘the lower courts can take care of it’. even though it has been sought with nothing but bias rulings. Why have a supreme court if, a case of this importance, isn’t enough to actually do your duty.
