Veteran Daniel Penny has been found not guilty of the charge of ‘criminally negligent homicide’ by a jury in New York City. The prior charge of ‘manslaughter’ was previously dropped after the jury deadlocked on the count.
(VIA AP) – A Marine veteran who used a chokehold on an agitated subway rider was acquitted on Monday in a death that became a prism for differing views about public safety, valor and vigilantism.
A Manhattan jury cleared Daniel Penny of criminally negligent homicide in Jordan Neely’s 2023 death. A more serious manslaughter charge was dismissed earlier in deliberations because the jury deadlocked on that count.
Both charges were felonies and carried the possibility of prison time.
Penny, who had shown little expression during the trial, briefly smiled as the verdict was read. Both applause and anger erupted in the courtroom, and Neely’s father and two supporters were told to leave after making various remarks — including vulgarities from one of the supporters. Another person also left, wailing with tears.
Penny’s lawyers said he was protecting himself and other subway passengers from a volatile, mentally ill man who was making alarming remarks and gestures. (read more)
Interestingly, Ben Crump didn’t represent the Neely ‘family’ inside this case. However, that will likely not stop the grievance industry from using the not guilty verdict in an attempt to enlist chaotic support from Antifa and the remnants of BLM.

That’s an FU to the judge, who let them go through days of deliberation before they announced they couldn’t come to a verdict. Then, the judge – in view of that – said, effectively, “OK, let’s drop the more serious charge then (that’d be the one that you’ve been debating for days, but let’s just forget that..) and I’ll get you to go back in now to reconsider this lesser charge that I’m sure you’ll like better…”. Something like that?
My take. This jury worked for a week and failed to reach a unanimous verdict. Twice they went to the judge. The second time, Fat Alvin pulled a fast one and convinced the judge to allow them to consider the second, lesser charge, despite the judge’s jury instructions that they had to have a guilty verdict on the first, more serious manslaughter charge. IMO, the jury left on a Friday night having hoped they had done their job and had to come back to the dingy courtroom Monday am. I’m betting that they were pissed and the minority hanging out for guilty just capitulated. The jury didn’t even hang around for a free lunch on Monday. Heh.

I had the same question myself, but the more I thought about it, I think I figured out why this particular group of leftist jurors voted to acquit.
They just didn’t like being used by the judge like that, and since that was exactly what the judge was doing, the jury, being hard headed New Yorkers, were insulted, and refused to let the judge force them into a conviction that they didn’t believe in.
That has to be why it only took them 1 hour to make the decision.
I think they figured out what the real game was when the prosecution dropped the more serious charge just to try to get any sort of conviction on “the White Guy.” It never was about justice.

Neely kidnapped a young girl, he has a long history of arrests for crime, they put him in a mental institution and after several months he walked out. Nothing was done. His so called hurt family did nothing to help him as a homeless person. I would say he is bonafide mentally ill as opposed to an angry jerk, but I am not a doctor. …And closed long term mental health facilities…providing the patient with “The Least Restrictive Environment” or outpatient care. And if they want to leave treatment…they can appeal and then be turned loose or when out file ‘false imprisonment’ charges if discharge did not happen…so outpatient was cheaper.
Patient recidivism in what they now call “Behavioral Health Care” is very high.
The system lets these people, the mentally ill and or drug addicts, down.

The Neely person was mentally ill…the history of the types of crimes speak to that…and if under the influence of whatever drugs…made it worse…or maybe long ago, caused his mental illness OR mental illness sent him into the world of drug use/abuse. I have experience with a much loved family member with schizophrenia. When the person is an adult, there is nothing you can do. Family members do not have rights. The mentally ill person has all of the rights, and that includes the right to be mentally ill. You can report them. When law enforcement or social services comes out, if they aren’t an immediate threat, they are left to themselves. If they can wipe their own butt, they are considered competent. The person has to literally commit a crime or pose a threat in public to get them in custody. The Baker Act is just a three day hold. Mental services and social services in Florida is awful. We would contact our family member’s psychiatrist and primary doc for help, and they were useless. Basically, as a family member, you just hope the person doesn’t cause another harm while not wanting that person living with yourself for obvious reasons. It is stressful to have people calling us asking why we as a family aren’t doing anything when we tried repeatedly to get inpatient care for our loved one who went off his meds.

The real failure that no one seems to be talking about is the failure of the mental health system. I have worked in behavioral health, and schizophrenia is no joke. Where is the commentary on how dangerously mentally ill persons [to themselves and others] continuously fall through the cracks of every system.
True fact: people with serious mental illness have a lifespan 25 years shorter on average for a variety of reasons including drug abuse, suicide because the voices tell them to do it, violence, etc.
How about we investigate all the NYC institutions that failed all persons involved in the incident from the former marine to the passengers to the deceased perpetrator.
It’s a major issue, who is responsible for people with a mental issue.
They hope, families. The system views them as ‘adults’ capable of caring for themselves if they can walk and talk and does not want to care for them. Its a very sad situation out there.
If some patients are lucky, they can get into a long term group home. Others get stashed in long term nursing homes. Others end up on the streets. Think of our dear Veterans. And the homeless…they seem to get by but not in a good way… but toss in a mental illness?
The care of the mentally ill patient is often emotionally draining and challenging. Alzheimer’s patients are a good example. So are the seriously autistic. Then consider the cognitively deficient (mentally retarded).
It requires an endurance that most of us do not have. Families often start off with good intentions. I imagine like Neely’s and they may have said “No more”.

This all started when in health care, everyone was freaking out about “Baby Boomers” retiring and the alleged financial catastrophic impact that the health care industry would face. BTW, I am a baby boomer and I ain’t retiring anytime soon…but that was the start of restructuring health care.
Like Sundance’ pot of milk cooking…then all at once. And bean counters had a problem with healthy walkie talky patients being hospitalized for long periods of time…with little financial compensation for the extended hospital stays…patients would get about 2-3 hours of group therapy… and maybe individual therapy…the rest of the time…they were being ‘warehoused’. I worked psyche for a while too.
And look where we are now…
My mother, who committed suicide 33 years ago when I was 35 years old, was raised by two demons from hell. Her father sexually abused her from an extremely young age (she guessed 5 years old) and her mother tried multiple times to kill her (once by trying to push her down their basement stairs backwards).
Mom left her “family” home at 16 and 4 years later met my dad, a man raised by Godly parents. Dad’s mom was more of a mother to my mom than her mother ever was. . .
Mom fought her demons, but they seemed to catch up to her from time-to-time, so she’d go see doctors for help.
Long before covid opened many people’s eyes to the evils of big harma, I had mine opened by seeing how the medical industry failed my mother.
The only “help” they gave was prescription drugs. Drugs is right. At one point my husband poured all her prescribed pills into a big bowl; they reached the top of the bowl and looked like colorful candy.
Can’t tell you the number of holiday celebrations that were cancelled at the last moment because mom was either having an episode of bad drugs or of having an episode of failing to get herself off the bad drugs. She tried, but she truly received no help from doctors — whom she still trusted to do the right thing. My dad loved my mom, and although he knew she was truly sick, he knew, too, that she was doing the best she could.
She was very sick for most of her life. Her family, especially her devoted husband, and her children, loved her dearly. Looking back now, 20/20 vision and all, I know we failed her.
When dad died of cancer it only took 40 days for mom to take all the unused morphine that had been prescribed for dad to end her life.
25 years.
25 later she would have died 8 years ago at 84.
Wow! What a heartbreaking story. Your mom and my wife have some difficulties in common with parents so I know what your father (and you!) went through. I’m very sorry for your loss, Raven!

You didn’t fail her. There is no fix for childhood emotional damage. It’s always there, even if the individual is strong and learns to use left brain to suppress it and be functional. But then, at times when there is high emotional stress from something else…
As for psych drugs, they’re like giving novocaine to a person with a toothache and sending him on his way. Doesn’t fix the tooth, and has side effects.

What a story, Raven! You just never know the things that people grapple with behind the scenes.
My father, valedictorian at both Washington & Lee College & Harvard Law School, alcoholic, abuser, put a bullet in his head at 64. He so abused my brilliant mom that she had a breakdown & was institutionalized, had shock treatments, got her graduate degree & went into teaching after he threw her away … But she never really made it all the way back to stability. I think she was emotionally fragile all her life.
She came to Christ 3 weeks before she died of cancer, finally at peace, now & for eternity.
One brother of mine died of an accidental drug overdose, his twin committed suicide. I’m the only one that survived.
I’m so sorry you went through such tragedy. One can spend years trying to make some sense of it. It sounds as if you came to some peace about it. IMO, there are some things that only Christ can heal.

When are we going to recognize that just because someone “needs” treatment doesn’t mean that there -IS- any efficacious treatment? There isn’t even such a thing as “the mind”. All psychs have are drugs that in one way or another suppress this or that brain function.

NYC is rife with mentally ill and the criminally insane all over the city. There are hundreds/thousands of these folks. Cuomo sr closed all the mental health institutions and change Mattewean to a regular prison. He did not help the state, the bill or. their victims. Reform was needed, not 100% closures.
Neeley was arrested 42 times by the NYPD and still allowed to live on the subway and harass paying passengers!
It’s a symptom of a seriously diseased legal system in most Democrat run cities where the criminal is considered the real victim and is treated like a customer in an exclusive restaurant.
…and we know that the customer is always right!
The PD can get the perp in court and the judge can order care…if the individual is ‘not capable of compliance’…there is little follow up…we see them sleeping in the ER’s here in Chicagoland. And on the EL…
The different systems overlap but evade anything productive…social systems/advocacy groups, health care system, legal system, churches etc…and then getting patient compliance.
I did a covid nursing gig in a big county FL jail…1400 inmates…and about 1399 had drug problems and mental health issues.
I worked for several years with Prison Fellowship, trying to help the families left behind by the incarcerated.
Even with my family dysfunction as a reference point, what I saw in those families just broke me. There was NO SIMILARITY between what I considered “normal” & their life experience … NOTHING. I didn’t even know where to start, and that’s unusual for me.
And I saw it all through that group of people, over & over & over again. There was no fix. Still isn’t.

Thank God for good things. What a good man he is, stepping forward while others backed away. Justice prevailed.
Pushing the commoners down by high inflation and loss of decent paying manufacturing jobs, then drastically increasing housing costs with spiking demand by immigrants and the investor class pumped with government fiat money, pushes more through the bottom to homelessness, addiction, mental illness, and crime.
And voila! Another incident with an aggressive crazed addict on the street, fodder for another round of racist violent “protests” in response.
Look around. Do you see more destitute people these days?
Some wonder if it is all per Plan. The high inflation and spiking housing costs, drug flood, and racist programming (CRT, DEI) are all by intent, that much is evident. Merely coincidence?
Oh yes. Full spectrum warfare on our society stems from an overarching strategy, a philosophy of warfare. You see it in Syria, we’ve seen it since at least MacKinder’s geostategic premise in 1904, or you can see it in Democrat political science since JP Morgan’s bank panic in 1907.
(Not going off topic here, I’m talking about the philosophy currently taught in our law schools as well as in academy, domestic politics, and geopolitics.)
The overall strategy is not to defeat one’s enemies with a clear victory; rather, it is to sow disorder in an area, region, or culture so that one’s competitors cannot coalesce or operate.
Those competitors could be a nation, a political party, or a homogeneous society, such as a white Christian society.
Their resources are tied up in a thousand petty squabbles and rearguard actions, while one’s own resources are organized and coordinated into an effective thrust, a long march even while ‘failing up’.

Praise God that jury came to the right decision- in NYC no less!
I know people who legally conceal carry. In casual conversat8on the consensus of when to get involved is limited to the concealed carrier and their immediate family. The legal liability potential when inserting yourself into other situations is so great that the average person must think twice before doing so, and that is a shame. And Penny now faces a civil suit so he’s not out of the woods yet.
People have a very distorted idea of what the Concealed Carry coarse curriculum covers, and many were shocked that most don’t have any firearms proficiency requirements.
The main thrust is on how much you DO NOT want to use deadly force, as the statistics say you will likely have to endure 3 seperate “trials”; in Criminal Court, in Civil Court, and in the Court of Public Opinion, and your life will be forever changed, and rarely in a good way.
In NYS, unless you are in your home or on your own property, you are required to retreat, if safe to do so before using deadly physical force.

Ideally. . .
Retreat to safety, leave the ‘hot zone’ area if possible.
Take cover if a retreat is not possible.
Engage threat as a last resort.
Of course, once the proverbial shtf, keep a cool head and pray for the best.
Oh, and train as much as possible with your weapon, and keep it well maintained.

Interesting similarities in this case and the Derek Chauvin/George Floyd case. Both fentanyl laced deaths happened after the accused murderer let go and EMT’s took responsibility. Both restraint methods are not known to cause deaths, and both Neely and Floyd were out of control.
Biggest difference is Chauvin was convicted of murder for a knee restraint that is shown in the MPLS police training manual.
Chauvin was railroaded by a weak judge and DOJ LAWFARE prosecutors on loan to the Minneapolis District Attorney’s Office using a corrupt medical examiner from Chicago, Dr. Lubin, who lied in his expert testimony that “merely kneeling on someone’s back for nine minutes will cause death.” The Minneapolis ME’s report said Floyd died from a massive overdose of Fentanyl and Meth!
The defense attorney was grossly incompetent and should have simply demonstrated by having someone kneel on his back for nine minutes in the courtroom in front of the jury…and then stand up saying…IT DIDN’T HURT A BIT!
As I noted above, it was politcally timed. The Left has autists dedicated to scouring the news just for such useful cases as these to spotlight.
OTOH, was there any reason for Chauvin to continue a knee restraint for that long, police manual or not? Floyd was already restrained and no longer out of control, and wasn’t going to be able to escape or hurt anyone. Shouldn’t that have been the guiding factor?
When Floyd said he couldn’t breathe, the new younger officer suggested Chauvin let him up for air, but Chauvin refused and continued his hold. Floyd was on the ground and handcuffed — why not just sit him up as they waited for the EMTs to come? He wasn’t going anywhere. Seems like that would have been the smart and humane thing.
Floyd was sitting in the back of a police SUV and going to taken to the ER. He was starting to get violent yelling he wanted to get out of the vehicle because he couldn’t breathe! So they took him out and waited for the EMT which got lost…
Floyd was a parolee and 6’6″ and 280 pounds high on Fentanyl and meth. As a parolee on drugs and arrested he was going back to prison to serve the rest of his sentence.
He knew that and didn’t want to go back! Should the cops have just let him get in his car and drive home?
Who said anything about letting him get in his car and drive home? Please stick to the script. Yes, initially he was combative. But once they took him out and had him handcuffed and he was no longer resisting, obviously in a weakened state and saying he couldn’t breathe, why the need to lean on his neck face down on the ground for nine minutes?
I am pro-law enforcement and generally give them the benefit of the doubt. I understand that they have to make hard split second life and death decisions. But unfortunately, I’ve seen instances where they go from enforcing the law or self-protection to letting the adrenaline take over, and shifting into bullying or power-tripping. The following account lines up with what I was saying, and observed from the video of the Floyd incident:

This is great news and deserved. Unfortunately, Penny still has a Civil Trial still hanging over his head.
If someone is entitle to some damages, it would be the 42 victims of Neely. I suggest a class action suit by those that file a suit against Penny and Penny should go for everything he can get from anyone looking for a handout as being a responsible party for not looking out for the interest of a sick person. This could really get interesting.
