Veteran Daniel Penny has been found not guilty of the charge of ‘criminally negligent homicide’ by a jury in New York City. The prior charge of ‘manslaughter’ was previously dropped after the jury deadlocked on the count.
(VIA AP) – A Marine veteran who used a chokehold on an agitated subway rider was acquitted on Monday in a death that became a prism for differing views about public safety, valor and vigilantism.
A Manhattan jury cleared Daniel Penny of criminally negligent homicide in Jordan Neely’s 2023 death. A more serious manslaughter charge was dismissed earlier in deliberations because the jury deadlocked on that count.
Both charges were felonies and carried the possibility of prison time.
Penny, who had shown little expression during the trial, briefly smiled as the verdict was read. Both applause and anger erupted in the courtroom, and Neely’s father and two supporters were told to leave after making various remarks — including vulgarities from one of the supporters. Another person also left, wailing with tears.
Penny’s lawyers said he was protecting himself and other subway passengers from a volatile, mentally ill man who was making alarming remarks and gestures. (read more)
Interestingly, Ben Crump didn’t represent the Neely ‘family’ inside this case. However, that will likely not stop the grievance industry from using the not guilty verdict in an attempt to enlist chaotic support from Antifa and the remnants of BLM.

My thought too. The jury didn’t appreciate being put in the middle of the BS on Friday. So they showed up this morning & unanimously agreed to give a big middle finger to Bragg, his fugly ADA & their “restorative justice”!
It’s this kind of crap that makes people not want to serve on a jury … But juries are a very important part of our freedoms. Citizens giving up time, pay, & attention to do the right thing don’t like this crap.

The deceased was alive when taken into custody by police and emergency personnel. When that happened, he was THEIR problem. And I haven’t seen any evidence that the man died of anything other than the drugs he was taking. Under all other circumstances, he would have been alive.
The process is the punishment. And Neely’s father is still going to go after Penny for wrongful death. More punishment.
Was an autopsy ever actually performed on the poor wretch? Simple forensic gross examination would have proved that Penny’s restraining actions were not the cause of death – and a toxicology report would have further proved it.

The idea that Penny could apply enough force for 6 minutes straight to choke out Neely was preposterous. Any average MMA fighter’s arms would “gas out” after about a minute of trying to intentionally choke out another fighter. A restraint hold applied for 6 minutes is possible.

A Black Lives Matter leader who has been in the courtroom daily during the Daniel Penny subway trial called on ‘black vigilantes’ to step up after the Marine veteran was found not guilty on Monday.
Walter ‘Hawk’ Newsome, who says he is Jordan Neely’s uncle, threatened Penny inside the courtroom during the chaos which immediately followed the verdict.

While announcing CNN’s breaking coverage of the Daniel Penny acquittal, the anchor, (Pamela somebody), looks visibly angry and distressed when she asks the CNN analyst in an incredulous voice, “Were you surprised by this? What’s your reaction?”
To his credit, the analyst says he was not surprised, but the inference of the CNN anchor’s tone and expression was obvious! It said, “GUILTY! GUILTY! GUILTY!”
That disturbing fact that the jury deadlocked on the original manslaughter charge speaks volumes…and what it says is that New York can always be counted on to go out of their way to punish heroes who endanger themselves while trying protect the public!
Daniel Penny should have been given the keys to the city for his actions, but no surprise that Alvin Bragg chose to prosecute him instead!
