In an interview this morning on ABC, the Republican senator from South Dakota said President Trump has the right to nominate Mr Patel, and the Senate will consider the “consent” from there. WATCH:
Several people are wondering if current FBI Director Chris Wray will resign. It’s a very unusual dynamic and the internal pressure will likely be on Director Wray to force President Trump to fire him, especially if the House and Senate are in session and there’s no possibility at the time for President Trump to appoint an “acting” replacement.
A lot can happen with President Trump announcing Kash Patel “will serve as” FBI Director, while a current FBI Director is still in place. Without the ability to appoint an “acting” replacement, the Deputy FBI director would take Wray’s place even if Wray was fired. Unlike officials at federal agencies, lawmakers do not have security clearances per se. They are presumed trust worthy by being elected — same as the President and Vice President.
House and Senate staff members with a need to access classified information are required to obtain security clearances. The Office of Senate Security and Office of House Security, respectively, have oversight over the security clearance process for congressional staffers, and background investigations are conducted by the FBI.
Since security clearances are processed by and awarded by officials of the Executive Branch, Trump could, I presume, deny or pull all clearances from every House and Senate staff employee he deems unworthy to possess one.
Love it. I didn’t even think about that aspect to use security clearances as a negotiating tool for the President to get his appointees approved.
I have for years contended that the President is the walking/talking Executive Branch and can hire and fire at-will the FBI director or any employee of the Executive Branch including the FED director.

As to whether Wray will resign or not, (a) Trump, his incoming boss, sent a very strong signal for Wray to pack it in honorably or (b) Trump is about to pink slip him. It’s not up to Wray to decide whether or not to resign. He “serves at the pleasure of the President” as Comey famously put it after being fired.
