The U.S. Supreme Court ruled today allowed Virginia to continue its purge of more than 1,600 ineligible voters from the state’s voter rolls. [pdf ruling here]
The stay was issued 6 to 3, along ideological lines, with leftist Justices Elena Kagan, Sonia Sotomayor and Ketanji Brown Jackson dissenting with the opinion that illegal aliens and ineligible voters should be permitted to cast ballots.

BACKGROUND – On August 7th, Virginia’s Governor Glenn Youngkin signed an executive order expediting the removal of noncitizens from the state’s voter rolls. The state maintained that the program followed only removed those who were ineligible to vote due to lack of citizenship. These were self-declared ineligible voters.
Earlier this month the Justice Department and advocacy groups intervened, suing the state. They contended that Virginia had purged some eligible voters and that it did so in violation of a federal law that bars removals from voting rolls in the 90 days prior to an election.
[…] A federal district court agreed, ordering Virginia to restore the approximately 1,600 voter registrations that were cancelled. The 4th Circuit Court of Appeals upheld that order. Virginia then appealed to the Supreme Court, asking the justices to allow the state to strike the voters purged in the 90 days prior to the election.
The state contended that the lower courts “misinterpreted the NVRA.” They argued that the “quiet period” cannot apply to noncitizens, since they are already ineligible to vote. Even if the “quiet period” did apply here, the state argued, the program was sufficiently individualized, not systematic.
On Wednesday, the Supreme Court sided with Virginia, leaving the purged voters off the rolls and allowing the purge to continue.
In a statement, Youngkin called the order “a victory for commonsense and election fairness.” (link)

Any illegal alien that any state is able to catch voting needs to be deported ahead of the rest. Most will never be identified but do what you can.

Federal law factually states it’s illegal. Sadly I’m unsure what REMEDIES are prescribed within federal law when it’s violated. We have too many laws like that. There’s no “or else” in the constitution and little if any in federal law regulating government behavior… civilian behavior on the other hand is always severe. Fear of punishment on both sides is necessary to secure freedom against tyranny. It’s not an accident that there’s usually no “or else” in laws limiting government.

Well one must have slipped through the cracks. My wife and I, both Virginians, received our ballots in the mail today (we’ve already voted early) and in that bundle was included a mail-in ballot for a person that hasn’t lived at this address for at least 5 years.

Applaud this decision but can’t understand why they allowed RFKJr to stay on ballot.
On a probably related note (and a heartening one), Trump is going to forgo the Penn State v. Ohio State game in order to campaign in Virginia. Personally, I think this sends a message about internal polling. Also, security at the PSU v. OS rivalry would have been a nightmare. And, like it or not, security should be a primary focus when we’re six days out.

Something tells me the Dim Govs will refuse to obey SCOTUS and remove the self admitted non-citizens from their State’s voter rolls.
The ruling is implicit, not explicit since it merely stays the lower court’s injunction against Virginia until the court decides whether to actually take the case or not. Unless the court decides not to take the case before Tuesday, however, the effect is to prohibit the self-identifying noncitizens from voting in the presidential election in Virginia on Tuesday. It may get a bit messy if any of them have already voted while the injunction was in place, but to do so they risked criminal prosecution under 18 USC 611 (Voting by Aliens) which expressly prohibits aliens, illegal or otherwise, from voting in federal elections.
This stay does NOT hold that 18 USC 611 trumps the later Motor Voter statute, but it definitely implies that, should the court ultimately take the case. Again, the Court could keep its stay in place for this election, then decline to take the case to resolve the possible conflict between the two statutes.
