It’s really not Jack Smith, so we should drop the pretenses. Mary McCord, Norm Eisen and Andrew Weissmann have recrafted a new DC indictment against President Trump by dropping around 10 pages of fraudulent evidence from the prior indictment and labeling it a “superseding indictment.”
The 36-page indictment is available HERE. Essentially, after the supreme court decision on immunity, the majority of the previous case against President Trump was likely to fail, so Mary, Norm and Andrew went back and modified the previously lawfare to fit a narrower scale as requested by the supreme court.
The Lawfare crew then hand off the indictment to Jack Smith who runs it through a Grand Jury, and re-files it as a new set of issues; however, the majority of the case is structurally the same, they just took out the evidence they were using. This fiasco does not appear to be any better than the previous pages of Lawfare.

Both sides face a Friday deadline to propose next steps to U.S. District Judge Tanya Chutkan, the Biden appointee who is overseeing the proceedings in the trial court. Chutkan has scheduled a Sept. 5 hearing to set a course for the case. (read more)

In order for this to work, the court has to find that a President has no duty or obligation to ensure that elections are fair, free, and uncorrupted. Only then are his actions outside the scope of his duties. It’s absurd, but so is that dummy Chutkuan or whatever.
If Trump actually has the “goods” and proof of election fraud–say in GA where it has already been shown that in Fulton County, they cannot reconcile the actual vote totals certified with actual ballots, then this trial would be the opportunity to present the case. Technically, one wouldn’t have to prove the fraud, just present the overwhelming evidence that show the potential of fraud. Any action to investigate would be a prudent action, not a criminal one.
Then again, this whole charade isn’t about seeking justice.

I think that is why so many don’t understand our nation because it’s so taboo to discuss it. The Supreme Court decision required a hearing before a federal judge BEFORE any evidence relating to the President of the United States could be presented to a grand jury to insure that the evidence was not covered by Presidential Immunity. I presume that Smith did not do this.
In addition, in an earlier decision the Supreme Court threw out the Sarbanes Oxley Obstruction Charges on a J6 protester as they were specifically intended to the destruction of financial information in SEC investigations of publicly traded companies not a public disturbance.
I presume that Smith simply reworded the facts in the case on those sham counts as well.
