Judge Aileen Cannon has dismissed the classified documents case against President Trump that was brought by Special Counsel Jack Smith. Using a similar argument recently included by Supreme Court Justice Clarence Thomas, Judge Cannon has dismissed the case as an unconstitutional lawfare attack. The Lawfare community, writ large, is apoplectic.
In her ruling [SEE HERE] Judge Cannon ruled the appointment of Smith was not constitutional. “The Court is convinced that Special Counsel’s Smith’s prosecution of this action breaches two structural cornerstones of our constitutional scheme — the role of Congress in the appointment of constitutional officers, and the role of Congress in authorizing expenditures by law,” Cannon wrote.
“At most, the history reflects an ad hoc, inconsistent practice of naming prosecutors from both inside and outside of government (typically in response to national scandal) who possessed wildly variant degrees of power and autonomy. The lack of consistency makes it near impossible to draw any meaningful conclusions about Congress’s approval of modern special counsels like Special Counsel Smith,” she wrote.
The malevolent forces of the deep state have suffered a tremendous defeat, and the demons are shrieking.
The Washington Post, representing the interests of the U.S. Intelligence Community who fully supported the Lawfare attack, writes:
WASHINGTON – The Justice Department is highly likely to appeal the decision, and the issue may eventually reach the Supreme Court. By dismissing the entire indictment, Cannon’s decision also means that the charges are dropped for Trump’s two co-defendants, Waltine “Walt” Nauta and Carlos De Oliveira.
Even if Cannon’s ruling is eventually overruled, the decision to dismiss Trump’s indictment adds to a string of legal victories for him in recent weeks, including a sweeping Supreme Court ruling July 1 that gives former presidents broad immunity for their official acts while in office.
At the Justice Department, Attorney General Merrick Garland declined to comment on the ruling. A spokesman for Smith did not immediately comment.
On social media, Trump said Monday’s dismissal “should be just the first step” and that the rest of the criminal and civil cases against him also should be tossed out of court. He accused Democrats of conspiring against him to bring those cases, a claim that has been repeatedly denied by federal, state, and local officials. (read more)

I love this Bible verse, Mayberry Lady. I know this is off the subject, but just to say God’s promises are kept! I clung to this promise of God’s during a lengthy period of unemployment. We were so maxed out that it began to look like we would lose everything. I kept praying with this promise. One day when we were facing foreclosure, I felt so scared I didn’t know what to do. It occurred to me to make a list of everything money did for me. I was very surprised to see what ended up on that list — besides the ability to pay the bills, there was self-esteem and the right to take up space on this earth. Suddenly, I realized — big time — Why, money doesn’t do any of that for me — God does!! All that fear left and I KNEW we were being cared for even though I could not see how. Within days, my husband got a really good job (after finding nothing for almost 4 years) and I could leave my temp job (that bought our groceries) and be home with the children. Granted I don’t follow the cases in granular detail like many do, but my question, given the reasoning for the dismissal, is why the judge couldn’t have made that determination on day 1? Jack Smith hasn’t changed. The Constitution hasn’t changed. Why?

The opinion is 93 pages with dozens (hundreds?) of citations. Complete and complex enough to be the syllabus for a one or two semester law school course. For the lefties who are getting headaches, it’s called “rule of law.” Further, this was the only motion decided, so if Weissmann, Eisen, and McCord are inclined to appeal (they do have as much standing as Smith) there are several other reasons to dismiss that would the have to be adjudicated. Since it was not dismissed with prejudice, guess who would hear the next motion?
The talking heads who think she was inexperienced or not up to handling such an important case should hire a competent lawyer to read and explain the opinion.

Because it is a 93 page decision, my guess is that she was ready to release it today. This judge has been very steady, purposeful and above reproach. I doubt she acts based on anything other than the proper time table.

Weiss was already a US Attorney, IIRC, so that appointment would have received Senate approval.

Women in power are neither more nor less likely than men to be evil.
However, it is more of a deviation from the norm of a woman’s character to seek power.
In the case of a judge, it’s not necessarily a position of ‘power’ in the sense that a politician, bureaucrat, CEO would be. The Judiciary is meant to be a position of reflection, not action as the Executive or Legislative branches.
I will not disagree that women don’t ordinarily have the disposition to seek power for power’s sake. I find motherhood to be the best job around, and I’ve had other accomplishments to be proud of. No comparison.
It would seem that men who seek power may be predisposed to do so in order to satisfy their own competitive, selfish natures? Whereas, when women find themselves in powerful positions, there’s a good chance the ‘nurturing’ sex is inclined to consider the greater good.
Competency is the key takeaway IMHO. Highly competent and intelligent women like Judge Cannon are obviously a godsend.
Diversity hires? Not so much.

The opinion she wrote took time to write and to review internally before it was rendered publicly in the courtroom. I have to guess that some bit of legal consultation was done behind the scenes before the opinion was documented in its final form.
I think the timing with the assassination attempt is coincidence. The opinion was coming in its own due time after a reasonably fair hearing of the issues, a hearing which will give the appeals process a solid basis in legal content for higher review when the inevitable DOJ appeals are made.
Jack Smith and his handlers in the DOJ and in the Biden administration will not give up on their lawfare war against Donald Trump and the MAGA movement. Retired Magistrate here: Based on the Supreme Court’s ruling on immunity, the case of election interference in Georgia should also be dismissed. President Trump was still President when he made that telephone call regarding a check of ballots to see whether they were legitimate or not.
With regard to Jack Smith, any other case that Jack Smith was involved in should also be dismissed because he was not constitutionally appointed.
I really admire Judge Cannon; she exposed as much of the illegality against President Trump as she could and then dismissed the case on constitutional grounds. She would be an excellent U.S. Supreme Court appointment when the time comes.
Have to admit I’m feeling God’s presence protecting and guiding the good people trying to thwart the evil deeds trying to destroy us.
