When the most powerful law enforcement and intelligence agencies in the United States clearly and continually violate the 1st Amendment to the Constitution by limiting free speech as well as direct control of the news media to delete content critical of the regime in power…do we really need to show the Supreme Court a specific victim of the abuse?
I felt violated as a Citizen when the Supreme Court said We The People didn’t have the “Standing” that would require them to address our concerns about the 2020 election, even though prompt attention to concerns brought to them by the States was guaranteed to us if we ratified the Constitution.
There is no way our Founders left us without recourse from Justices who are not aligned with our Constitution, the very document that they swore would rule all their decisions. If today’s Justices are being forced to rule in a certain manner due to vulnerabilities, they need to step down no matter the cost to themselves or their families.
For the last ~3 years I have been trying to inform anyone who will read of the solutions to government interference and arrogance offered by Justice Scalia and the Rehnquist Court. Those solutions are written out within the MAJORITY opinion of the Rehnquist Supreme Court’s landmark ruling in the case of United States v. But crucial details of the Murthy v Missouri ruling may actually HELP my suit.

The Supreme Court has swept aside a legal effort to stop the Biden Administration’s social media censorship schemes.
By a 6-3 vote, the court found Wednesday that two states and five private plaintiffs had not shown they were personally damaged by federal efforts to make companies like Facebook suppress Covid skeptics. Because they could not show government contacts caused specific censorship acts, the plaintiffs lacked the “standing” for a suit.
“We begin—and end—with standing,” Justice Amy Coney Barrett wrote for the majority, which included the court’s three liberal justices and three centrist conservatives.
The decision technically only applies to an injunction a lower federal court has issued for the plaintiffs. But it effectively ends the lawsuit, once known as Missouri v Bidenand now called Murthy v Missouri.
The ruling leaves Berenson v Biden, my own lawsuit against White House and Pfizer officials over their 2021 conspiracy to force me off Twitter, as the only serious remaining challenge to the Biden administration’s censorship.
For Berenson v Biden, which I filed last year in federal court in Manhattan, the ruling is far more positive than it may first seem.
Why?
The court ruled against the Missouri plaintiffs only on standing. It did not judge the underlying constitutional issues that arise when government officials push social media companies to censor Americans.

Our church does a weekly dinner before the Wednesday night service and she coordinates the meals. I mentioned that it would be helpful for people with allergies or dietary restrictions if we knew in advance what was being served. I even offered to post it on the church website for her, if she didn’t have time. Berenson is wrong. The case will go back to the district court and the AG has said they will be adding more discovery to their lawsuit. The case is far from over.

My mother is a type 2 diabetic; when she went on metformin to control her blood glucose, they put her on a statin as well because that is the “standard of care”. However, my mother’s cholesterol was stellar, and she had no valid reason for taking it other than that’s what the standard of care dictates.
I haven’t been able to convince her to stop taking the statin… doctor said she needs it, so she thinks she needs it. So frustrating!
They’ll do anything to sell more drugs!
I couldn’t tolerate statins so the doctor put me on, generic name is Ezetimibe, generic for Zetia.
Got my cholesterol down from 292 to 196 over a period of 4 years, an also using metformin, but got that down from taking 500mg twice a day to cutting one 500mg in half taking half in am and the other in pm.
Perhaps ask her to ask her doctor, since her child is concerned about statins, if she could try the non-statin Zetia?
I didn’t know about Zetia; I’ll check it out. I don’t know that I’ll convince her to change though.

This month, a Florida appellate court affirmed that U.S. Navy veteran Zachary Young and his company, Nemex Enterprises Inc., could seek punitive damages for the Afghanistan story. Young said that CNN improperly suggested he was an illegal profiteer.
Vel Freedman, Young’s lawyer, said Young lost $40-60 million in economic opportunity and could get up to $600 million if a jury awards him emotional damages. In the end, CNN could be forced to pay $1 billion to Young, if punitive damages would be included.
According to the lawsuit, CNN destroyed Young’s reputation and business after the network’s correspondent Alex Marquardt published the report about Young. Tapper introduced the segment by telling of a “black market” with demands of “exorbitant fees” and “no guarantee of safety or success,” the news source added.

PATEL: 100% accurate. The Steele dossier was handed to Paul Ryan’s chief of staff in 2016. They put out a mealy mouth of retreat to it, response to it, which basically said, oh, we didn’t get it from Christopher Steele directly.
They admitted it in court that they had a copy the entire time and they didn’t tell us in 2016. They didn’t tell us in 2017. They didn’t tell us in 2018, the quintessential piece of evidence, which was exposed because I went to DOJ and got the FISA, which the Steele dossier was an entire part of. And Paul Ryan was the one that fought us tooth and nail on, remember, on declassifying it. Now we know why. He had it for sure. He is a total coward.
It’s been at least twenty years since I began using this perspective as one of my options: I don’t believe anything anyone says about anything.

Your definition of “perfidy” reminds us that all those involved in government, at any level, need to learn the difference between “government service” and “self-service”; we’ve seen a lot of the latter, representative of who we have become as a people (perhaps with the assistance of our demographic change).

3rd Supreme Court ruling of today: SEC vs Jarkesy. Ruling 6-3, majority opinion written by Roberts, 98 pages.
This is the Dodd-Frank Consumer Protection Act where it gave the SEC the option to impose penalties against a company they claim commits a securities fraud by in-house determination vs previously a judge and jury must decide guilt/innocence and affix a fine.
Held – the Dodd-Frank in-house option for the SEC to impose fines violates the defendants 7th Amendment rights and must go through the courts/jury process. There were other matters (from other companies) involved in this case and those were remanded back to the lower courts to adjudicate now that the Supreme Court has made this ruling.

The case began as an administrative proceeding by the SEC against George Jarkesy, an investment adviser and the founder of a hedge fund. Last opinion for the day at SCOTUS is the Idaho abortion case (Moyle), and it’s the opinion that was “accidentally” released yesterday.
Appeal dismissed as improvidently granted, i.e., the Court thinks it should not have granted cert at this stage of the case.
Tomorrow is another opinion day, and we find out at the end of the release of opinions if there will be more opinion days next week.

This post expresses how I felt about hearing the decision. I would have thought that it would be “contrary on it’s face to the First Amendment”. That does not appear to be the main concern of many of the justices, it’s secondary to a whole bunch of rubbish.

During oral argument there was something that jumped out. More than one of the justices exhibited a DC institutional bias not found in the hinterlands amongst conservatives and libertarians. A few justices assumed that there was a real health and safety basis for govt intervention to stop mis and disinformation and that it was not contrary on its face to the First Amendment. It’s the kind of thinking that would cause long dead free speech absolutists on the court to turn in their graves. Justice Barrett’s opinion has such a tone, almost suggesting that this battle, arm in arm with tech companies, against disinformation is a legitimate use of govt power. Throw away that implied, biased assumption and the standing issue takes on an entirely different character.

In a hearing this week in FLA, Jack Smith’s prosecutor admitted the special counsel has “permanent, indefinite” tax money to fund his prosecutions against Trump.
Judge Cannon pushed back, asking about a “cap” and whether it was “limitless.”
DOJ: No cap and yes it’s limitless.

Look at how that income chart reads. No wonder there’s 40 percent excess deaths among the best insured/white collar class.
The people who bought the full Narrative and got boosters are doubling down, and are fully demoralized in the communist sense. They not only have not learned anything, they refuse to learn.
Projecting forward, and assuming the excess deaths continue steady
or get worse, the implication is that the top 5 percent, along with the vast majority of people over 65 will not be with us for the 2028 election.
I do not write that callously. Most of my family and friends are in the two to two plus category. I’m praying daily they’ll be spared.
