Retired Magistrate here: Under the New York Statutes, since the 34 felony convictions are all categorized as “E” felonies, low grade felonies and President Trump is a first time offender, after sentencing, which could include probation, the judge could release him on bail, on his own recognizance or place him on house arrest pending appeal. Of course with this judge he could also send him to Rikers pending appeal. I don’t think the judge will do that given the logistics of having to prepare a fairly large space for not only the President but also all of the Secret Service personnel who will be guarding him.
My interpretation of the New York Statutes is that upon conviction and sentencing, the Defendant has an automatic right of first appeal. After the first appeal, then Defense attorneys must give reasons for further appeal.
However, this is the way it should work. Since this case never should have been brought in the first place, this is just a guess on my part.
I think there is a very high probability this lunatic judge with send him to Rikers simply for the fact that their newly reenergized voters (which is one of the reasons they did this) demand it. That would make their voters angry and this might be their last chance.
Of course, house arrest and/or dealing with a probation office would keep him in chains. They would have control over every move he makes.
Retired Magistrate here: In doing some more research, I also found out that the judge could impose a fine, which is what is normally done in cases like this where there is no larceny or a higher felony attached.
However, given the political nature of this case, this option will probably not be considered.
Do not assume the judge is sane or exercising normal judicial temperament. He has terminal TDS.
