“For social-media activity to constitute state action, an official must not only have state authority, he must also purport to use it. If the official does not speak in furtherance of his official responsibilities, he speaks with his own voice. Here, if Freed’s account had carried a label – e.g, “this is the personal page of James R. Freed” – he would be entitled to a heavy presumption that all of his posts were personal, but Freed’s page was not designated either “personal” or “official.” The ambiguity surrounding Freed’s page requires a fact-specific undertaking in which post’s content and function are the most important considerations. A post that expressly invokes state authority to make an announcement not available elsewhere is official, while a post that merely repeats or shares otherwise available information is more likely personal. Lest any official lose the right to speak about public affairs in his personal capacity, the plaintiff must show that the official purports to exercise state authority in specific posts. The case was then vacated and remanded back to the lower court; with this above ruling acting as a guideline for lower courts when the topic of individual speech vs govt speech comes up.
Mr. Freed had a private Facebook account, mostly family and personal posts. He became a city manager and would occasionally post some photo or remark on his personal Facebook page that was a comment on something with the city. Mr. Lindke then proceeded to make comments on Mr. Freed’s Facebook page (whether regarding city business or some personal observation is unknown, but enough comments to cause Mr. Freed to block him) and so Mr. Freed blocked Mr. Lindke, and that is the lawsuit that this ruling is about.
There is a difference between a person’s right to speak as an individual and when speaking on behalf of an authority such as being an employee of a local jurisdiction, or any govt. employee.
It was nice to see the Supreme Court recognize a private individual’s right to speak and acknowledge there is a difference when speaking as an individual or on behalf of a govt entity.
“Fact specific undertaking” means America first office holders can’t block anyone but authoritarian dems and their gop allies can.
The only exception should be at the level of screaming FIRE in a crowded movie theatre!

Here’s a question for the lawyers out there.
If the Fani trial ever takes place, can the defense in their closing statement make the assertion that the same DA who brought these charges against President Trump and others for alleged false statements among other alleged crimes, is herself guilty of the same crime of making false statements in a court of law according to the judge’s own ruling, yet the judge did not convict her for making those false statements and he still presided over this trial?
The closing statement that should be made to the jury is that a fair trial is one where there is equal justice under the law, not a trial tainted by a judge who contributed to this DA and who ruled to allow her to continue this trial without being disqualified or sentenced for her false statements.
This definitely applies to the NY prosecutors too, but any District Attorney or Circuit Attorney who campaigns specifically on GETTING one individual should already be disqualified for bias, that’s practicing the “Show me the man and I’ll show you the crime” philosophy espoused by the Stalinist chief of police Levrenty Beria, to chilling effect.
This methodology – which defines the national Lawfare against President Trump – is inherently anti-American and unconstitutional.

My Mom and Dad were down by the barn at their little ranch in Santa Ynez, target shooting with friends who came up to visit – I was not there, heard about it all, second-hand – Mom was apparently holding the pistol right up in front of her cheek and when it kicked back, it went right into her cheek under her right eye, barely missing the eye – and apparently bleeding quite awfully as she looked around and everyone was pale and looking at her in shock –
Dad took her over right away to the little hospital where she got stitched up – quickly – stitches on the inside of her cheek and on the outside – 27 stitches in all – as it healed, she started squirting Vitamin E capsules on her face in that area and there was absolutely no scarring -that was in 1975 –
but gee Mom, you should have not done that and why didn’t any of those people who were used to guns point that out before you did that! It still gives me the shudders.
Good thing she’s not trying to get treatment at the little hospital quickly now. She’s competing with the hordes from all over the world. And she might have been the only one paying.
Thinking about what horrible thing could have befallen my Mom, holding a gun so closely (she did get hurt but it could have been so much worse) . . . where was the Secret Service when this was taken?

I was asked to keep an eye on the MS Senate primary for Col. Burton, who managed to win the incumbent senator’s home county by double digits.
Wayne County, circled here, went for Burton by over 20 points as results were posting.
Until the next day, when it turns out we were just kidding, incumbent wins it with 71%. I’m not alleging wrongdoing by either the county or the state, or by any candidates. I just want to know why this continues to happen. On a larger scale in 2020 we watched millions of votes swing and disrupt the entire race.
Now do we all understand why we can’t have faith in elections without transparency? This was also seen in The NY Times feed I was monitoring.

There is no “fixing” Hennepin county MN, that includes Minneapolis. Pain is the remedy. Maybe if people stopped going downtown to sports and convention events it might have some impact, but to stop that, the sports fans need to put down their beer and pay attention. I don’t even drive through Minneapolis because at any time you could get towed, run into a protest, get carjacked, or come to dead stop in bad traffic.
After muslim prayers were allowed over loud speakers just outside of downtown minneapolis, I called little Frey guy and told him we would never, ever step foot in that cesspool again.
We haven’t been even close to hennepin county since then.
Two things this week that can be considered part of a SAF report. They both occurred in a high traffic building supply store.
The first is that someone had written Thomas Jefferson’s quote about the tree of liberty on a wall inside.
The second was while collecting some needed supplies for a project a sudden announcement of about a minute in length was played over the quite loud public address system – in SPANISH. Total time in store was about 40 minutes and it was the ONLY announcement that occurred (i.e. – none in English). I stopped by and saw the manager – calmly expressed my displeasure and left him standing there with my collection of supplies and clear understanding of why the business would suffer.
I notice some of the big corporate advertisements on TV (pharma) are being played in Spanish.
Every company that shoves their anti-American, anti-citizen, pro-depravity, racism (AA) is a company I refuse to patronize.

BTW read an article on AT about Riley Gaines NCAA lawsuit – one example cited in article was the results of the Olympic Marathon race in 2016 – men’s and women’s times – the woman winner would have placed 90th in the men’s race ( she was 16 minutes behind that winner ) –
