My last post in this space posed a request for ideas ‘Treepers’ have concerning ways to ensure that the integrity of the Constitution is maintained and effectively enforced without regard for how the ideas may be effectuated.

I actually have a rather sophisticated – and for the time being a sort of theoretical — answer to this question, which I broach below, but with my February 3, 2024 post I was attempting to see if anyone was thinking in any way along the lines that I have been thinking.  It appears that is not the case. at least not among the dozens who responded to my question last week.

It turns out that all who took time to respond to my request are oppressively aware of the problematic state our republic is in, and are frustrated or angry about it. Please believe me when I say that I have been in a similar frame of mind for MANY years. Some commenters feel too many people are not taking their citizenship seriously enough and / or do not try to inform themselves enough and/or have become too cynical to care. On behalf of such people, I say they did not corrupt the government; they are just going about their lives and their jobs, and they have a reasonable expectation that their government would just do its job and not turn upon them as it has. 

Dealing with the problem at hand calls for much more than ordinary citizenship. For many decades our government has been silently devaluing our currency, giving away huge portions of it to other governments (many of them even dodgier than our own) all over the world, year after every year spending more money that the government takes in via its ever increasing taxation and then on top of that effectively overburdening us with innumerable onerous regulations, causing, after much more than a generation of these depredations, the entire population to be saddled with insuperable debt, debt that can never be paid off (everyone quietly being aware with dread that the only implied resolution of this massive mess is even more massive inflation and devaluation of everything, as if indeed that will solve anything, especially the ever mounting corruption of the government).  And as if all of that were not bad enough, the average beleaguered American is being overwhelmed trying to support his or her family while the government is robbing them of job opportunities with millions of illegal aliens being pumped into our country and then charging the citizens of our country vast amounts of money to defray the extreme cost of importing all of the illegal immigrants brought here to replace the very same taxpayers with the new slaves of the state.  In addition to all of that, the further beleaguered American is having his blood poisoned with fraudulent “vaccines”, and being lied to by the corporate media and the government, with nobody telling the them the complete truth about practically anything at all. In summary, it is pretty tough job to be a conscientious American citizen.  Can one possibly imagine that all of this really characterizes a republic, i.e., a government of the people. by the people and for the people?

However, if we cannot come up with some approximate means of effectively addressing the corruption and decline of the Constitution, then we consign ourselves to watching it die, and howling at the moon. So, some time ago I decided to move beyond grinding my teeth in anger, and on to thinking how on earth something can be done about the sorry state we are in.

My first conclusion was that there cannot be any simple amendment to the Constitution that could not be foiled by people who willfully want to subvert the Constitution (and we all have a pretty good idea who they are). Term Limits is obviously not much of a solution, considering that California has them.

So, what to do? I have concluded that the fix to the problems essentially has to be managed by people intent upon ensuring that the Constitution is enforced and its integrity secured in direct opposition to the wily people beavering away at undermining the Constitution, people who can spot trouble in the offing and then completely nip it in the bud. As I say, amendments like Term Limits or balanced budget amendments simply will not cut it.

Below is part of what I have come up with so far, which I call the U. S. Constitutional Council. The key things to note about the U. S. Constitutional Council is that it sits over the US government, and the government is answerable to the Council.  Its structure and its mandate are specifically focused on, and limited to, ensuring that the Constitution is enforced and its integrity secured; the Council is not empowered to set policy or participate in political processes.

I am not saying that the U. S. Constitution Council is the solution, but I am suggesting that if there is a satisfactory solution it will not be inanimate amendments dependent upon honorable self-enforcement, but will involve people, living, breathing people with a working heart pumping warm blood through their veins. And these people will not be actually part of the federal government; instead, they will be our overseers of the government and dedicated to ensuring that the integrity of the Constitution is maintained and effectively enforced on behalf of We the People.

By the way I also have a proposal — for those who are not fatalists – for amending the Constitution so as to make possible various reforms to our government with reforming amendments in spite of resistance that might come out of Washington DC; but the discussion we have here is freighted with as many issues and controversies as I care to deal with for the present. Bear in mind this is our government, ordained and established by We the People; there should be no question that We the People should be able to modify our government by amending the Constitution in an orderly manner if the need arises – as surely it has – without a by-your-leave from our government. Who is the master, and who is the servant anyway? Right now, practically speaking, there does not appear to be a way to reform our government short of civil unrest, perhaps on a scale that could make the Spanish Civil War look like a walk in the park, and with very doubtful ultimate prospects. There really are not any winners in a civil war; one side may lose less than the other side, but everybody loses plenty before it is over.

(And yes, I am very much aware of the serious concerns about a National Constitutional Convention.)

I posit that, in its most boiled down form, our problem is that we do not have a secure democratic republic because We the People are not effectively at the head of government and in charge in such a way as to ensure that the integrity of the Constitution is maintained and effectively enforced.  This may not align with your perception, so permit me to explain.

The Leftist (who absolutely hate our constitution philosophically and fundamentally), the Democrats party (which is dominated by leftists), and the Deep Staters (who consider our constitution a quaint relic that requires lip service to be followed, worked around or ignored insofar as it affects their progress to total control of our government) all are working tear down the Constitution. 

So, what do we have to ensure that the integrity of the Constitution is maintained and effectively enforced?

We have the balance of powers features as they are incorporated in the Constitution. By now they represent a barely noticeable bump in the road for people grasping for more and more power over the citizenry.

We have the very important (from the pov of legitimizing our so-called ‘republic’) biannual vote … which, besides being corrupted on an industrial scale in recent elections, has devolved into a blizzard of ballots sans proof of custody — as opposed to votes authenticated with voter ID — and a joke.

We have freedom of the Press. … which has essentially become a fig leaf while the Media and indeed public discourse in general have been corrupted to the max.

We have freedom of the Speech. … so long as it does not offend the TPTB

We have freedom of the Religion … ditto 

We have freedom of assembly (and even freedom to riot, burn, murder, pillage etc.) … so long as it does not offend the TPTB; but if it does offend the TPTB, then loss of all civil liberties is possible including indefinite imprisonment without indictment or trial (straight out of A Tale of Two Cities, truly an ominous indication).

And perhaps some other things can be ticked off … all to what avail?

All of these things have their place and their role, but unfortunately, they really do not provide any compelling control or clout over the wayward elements that are actually now installed in our government, and who really do have control and clout over We the People and our government.

Now I am going to offer the outline of an alteration to our Constitution that I propose could in many ways strengthen our Constitution.  The things that I am proposing below may at first blush be considered radical changes – certainly with respect to the status quo. However. I believe that the following concept(s) – though sweeping in their implications as to how our government works, and especially with regards to its relationship to We the People — could be served up as an amendment to Article III of the Constitution with only a few minor actual changes to the Constitution itself as it presently stands.

What is proposed here is something I call The U. S. Constitutional Council

1) The U. S Constitutional Council consists of six councilors elected from each state (for a total of 300), two being elected for a single six-year term only, at each biannual congressional / presidential election. Nobody may ever serve as councilor for more than one term. Nobody serving as councilor may run for any federal elective office for at least one election cycle after stepping down as councilor (this is intended to diminish using a councilorship as a springboard to other elective offices); and nobody who has participated in partisan politics is eligible to be a councilor (to help keep partisanship out of the Council). (Basic requirements, e.g., minimum years of age, minimum years of citizenship, etc., for holding the office as councilor TBD). Also there needs to be a fairly accessible avenue for recalling and replacing rogue Councilors (details TBD). The individual states would pay for the costs of their councilors and their staff; they would not be beholden to Congress for their funding. This funding would be according to a standardized schedule so that there would be no difference among the councilors of the various states.

2) The basic role of the of The U. S. Constitutional Council is to protect the integrity of The U. S. Constitution and to ensure that it is properly enforced as it is and as it is written. The U. S. Constitutional Council is to be explicitly charged to NOT set policy, write laws, and be engaged in politics. 

3) The U. S. Constitutional Council would be charged with initial vetting of all candidates for judgeships and for all nominations of candidates to fill roles as US judges. The Senate would confirm or deny all such nominations, in accordance with the Constitution.

4a) Furthermore, The U. S. Constitutional Council would be empowered to determine the constitutionality of an executive order or a law or a regulation under consideration on the spot. This would do away with ill-advised laws, regulations, or executive orders being put in effect shamelessly affecting the whole population while We the People have no recourse but to file suit, hoping that some judge, of who knows what pedigree, allows the suit ‘standing’, and even if that occurs, the suit has to tortuously work its way over years up through the courts, eventually, if fortunate enough, to be considered by nine justices, who are constantly under extreme and outlandish political scrutiny and pressure.

4b) These kinds of matters would and should be adjudicated essentially on the spot before anything unconstitutional is put into effect. Such adjudication would be determined by an ad hoc panel of an odd number of judges drawn by lot from the pool of appellate court judges, the overall process being managed by The U. S. Constitutional Council, so that nobody knows beforehand who will be involved in deciding the constitutionality of a given matter, and whoever is involved in one such case will very unlikely be involved in the next, etc.

5) The U. S. Constitutional Council would take over and have the authority over the Office of Inspectors General and would manage the designation, hiring, and installation of all Inspectors General and oversee management of all Inspectors General Offices throughout the Federal government and thereby monitor all of the government’s activities. 

6) These are some of the essential roles of the putative U. S. Constitutional Council; there certainly could be other roles, especially where present practices are injurious to good governance.

Preliminary comments:

Some might stand back and observe that it appears that the suggested U. S. Constitutional Council would have an overarching role over the government, superseding the Articles I and II. That indeed is the general idea, but only insofar as it does not participate in setting policy, writing laws, or participating in politics. 

Some may smack their forehead, and exclaim “Oh no, not more government, and more costs.” To this kind of objection, I would say one of the purposes of The U. S. Constitutional Council would be to ensure that expansion of the Federal government be trimmed back and kept constitutional AND ensure that all expenditures by all parts of the government be audited. I can essentially promise with these powers The U. S. Constitutional Council would pay for itself at least a hundred times over every year, and basically be a very good investment as well as a secure anchor for the Constitution.

In the future Judges will be judged for who they are and their capabilities, not for who nominated them.

As I trust anybody can easily see with respect to paragraph 4a&b above, the present means of assuring the constitutionality of OUR (as in ‘belong to We the People’) laws and regulations presently make a complete mockery of the concept that our government is one where We the People are in charge in any respect at all.

I certainly expect comments, but I would ask those commenting to consider the following as an early draft submitted here to address the growing chaos that We the People are experiencing, and I particularly request commenters to offer constructive suggestions, and not just brickbats reflectively thrown out against something apparently never thought of before. If you don’t like it, please offer improvements or alternatives (preferably civil, but not civil war) over the next few days. Maybe something like this has been proposed in the past; I am just not aware it. I am interested in comments on paragraphs numbered 1, 2, 3, 4a, 4b, 5 and particularly 6 as well as the overall concept, i.e., using people to secure our republic as opposed to amendments.

Special Counsel Robert Hur just found Joe Biden was guilty of violating national security laws in removing classified documents— after examining then Senator and Vice President Biden’s some 15-year habit of removing classified files to his offices and residences, where they were stored in unsecured fashion.

Period. End of story.

Hur then as a disinterested Special Counsel, not a local county prosecutor on a limited budget, logically would have indicted and prosecuted Biden.

It really is a jury’s decision to determine whether Biden was guilty or innocent, or whether he is pardoned/exempted by reason of dementia.

The Marine Corp released the identities of all five Marines killed when their CH-53E Super Stallion helicopter went down in the mountains close to San Diego on Tuesday.

We may well look back on February 8, 2024 as the specific moment in time Joe Biden’s bid for reelection was lost. A letter sent from the Treasury to Sen. Tim Scott, R-S.C., also confirms the searches push began under the Trump administration

EXCLUSIVE: The Biden administration has confirmed that terms like “MAGA,” “Trump” and “Kamala” were included in the push by federal investigators for banks to surveil private financial transactions following the Jan. 6, 2021 protests at the U.S. Capitol, a letter obtained by Fox News Digital reveals.

The letter, sent Friday from the Treasury Department to Sen. Tim Scott, R-S.C., the top Republican on the Senate Banking Committee, notes that “Exchange events” convened by its Financial Crimes Enforcement Network, or FinCEN, “began shortly after January 6 under the prior Administration,” and “included terms such as ‘antifa,’ ‘MAGA,’ ‘Trump,’ ‘Biden,’ ‘Kamala,’ ‘Schumer,’ and ‘Pelosi.’”

This marks the first time the Biden administration has gone on the record to confirm some of the keywords included in the Jan. 6-related push by investigators.

“Began under the Trump Administration” doesn’t mean that was PresTrump policy. It means in the interim between Jan 6, 2001 and when Biden was inaugurated

In other words, this was the agency career employees starting to investigate and persecute Jan 6 protestors and Trump supporters using keyword searchers on their banking and credit-card transactions

Much as I support President Trump, I once again am deeply troubled by his proclivity for consistently picking his undermining anti Maga opponents over his friends and tired of accepting the excuses. His most recent endorsement of Tim Sheehy for Montana Senate, who is heavily sponsored by Mitch McConnell and his puppet Steve Daines over very courageous and true MAGA Rep. Matt Rosendale is infuriating. I understand that Kevin McCarthy helped push Trump to make this call…….large part in revenge over Rosendale joining Matt Gaetz in the dissenting 6. While I was able to accept excuses over Trump’s early choices of Pence, Wray, Haspell, Bill Barr, etc etc as due to inexperience, his misplaced trust of Chris Christie or whatever excuse du jour……..what about his later support for Mitch McConnell, retaining Kevin McCarthy, Ronna McDaniel and now Tim Sheehy. The Montana Republican establishment which supports Sheehy and opposes Rosendale are not friends of President Trump even though they pretend they are MAGA to get elected. Where was Sen. Daines on recess appointments or even calling for a full reading of the lame duck Inflation Recovery Act bill and following McConnell on everything else. And Daines’s close political ally and former business partner, Gov Gianforte is totally in bed with the Republican Governors Association hosting events with Gov Kemp and former Gov Ducey and the rest of the anti Trump crowd. Sheehy made his money on govt military contracts and Rep Zinke has been a get along, go along congressman who supported McCarthy while attacking Rosendale, Gaetz and the others. And Trump’s decision to support Sheehy isn’t even a politically expedient call…….since Rosendale enjoys the support of the Montana voters other than the few country club republicans who support Sheehy. Much as I support the principles of MAGA and President Trump, I am completely fed up with this repeatedly bad decisions made by Team Trump. Dumber than a lab rat.
