Governor Greg Abbott today issued a statement on Texas’ constitutional right to defend and protect itself as President Joe Biden continues to attack Texas and refuse to perform his duties to secure the border.
“The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now,” reads the statement. “President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. To summarize: the 5th Circuit ruling on the merits declared that Texas has the right to lay the wire. This ruling was appealed by the corrupt Biden DOJ.
What the Supreme Court did was to “stay” the 5th Circuit’s ruling until the Supreme Court heard the arguments and ruled on the merits.

I think what give Texas — as opposed to any other State — unique “standing” here is that they joined the Union BY ANNEXATION as a previously recognized sovereign country in 1845. The independent Republic of Texas was in existence from 1836 until this annexation into the United States in 1845.
In other words, they were not “created” or “recognized” by any Act of Congress, but rather the voluntarily joined the United States as a fully recognized State [Texas was never first a “territory” as were almost every other post original 13 States].
Incorrect since all thirteen of the original colonies ratified the Constitution. The Northwest Ordinance of 1787 declared that all incoming states to have existed at the same time as the current states. Thus, every state is a creation of itself and ratified the Constitution in the same manner as the original 13. The Northwest Ordinance became part of the Organic Act of 1789 that placed itself, the Declaration of Independence, and the Articles of Confederation into federal law.
9 of the original thirteen states declared in their ratification document that they can resume the powers delegated that all states share the same rights as per the Declaration of Independence. Lincoln and his dictatorship were wrong.

The SCOTUS only vacated the appeals court decision. There was nothing stating what the state of Texas had to do or not to do. The status quo remains. At least until there is a real “fight” between Texas and homeland (in)security.
