BREAKING: California Lieutenant Governor Eleni Kounalakis has sent a letter to Secretary of State Shirley Weber asking her to “explore every legal option to remove former President Donald Trump from California’s 2024 presidential primary ballot.”
Interesting. If any states do remove Trump from the ballot, would the electoral votes of those states be void?
Not necessarily.
Democrats have been doing this sort of thing to the Libertarian and Green Parties for decades. Find some reason – usually a technicality in their filing paperwork – to get a candidate who they think will pull votes from the Democrat off the ballot. Democrats filed suit in two battleground states in 2020 (WI was one) to get the Green Party off the ballot.
It helps their cause that Democrat appartchaks are usually the ones going over the paperwork.
Something blatantly illegal would have to be rectified; maybe even a do-over election.

I tend to view it as a propaganda effort to discourage and marginalize conservative voters which are still important local voting blocs in cities and counties throughout CA and CO and other ‘blue’ states. The legality, or not, of it isn’t the primary mission. Psychological manipulation is. Classic stuff. We saw it during the Covid op. Expect more of it. The Communist goal, in my view, is top to bottom control from the federal level to the local community level.
How do patriots combat it? IDK, I tend to be a live and let live guy and believe in free will and am lousy at manipulating or convincing people of things. I’m more focused on attacks and defense against overt kinetic acts by the Communists. I’ll leave other gentle readers to figure out remedies to this stuff. My first reaction was that this is the epitome of ridiculousness. I mean: Of all the various states fraudulently administering elections does anyone doubt California’s ability to ensure Trump will lose in that state? As I say, at first that struck me as totally ridiculous. But then of all people apparently the lieutenant governor is evidently so concerned that he is wants to try to take this nakedly extreme and unconscionable measure. So apparently, he of all people actually does have serious misgivings about California being able to throw the election against Trump. This would suggest that Trump is highly likely able to win California in spite of California’s ability to manage election results. If that is the situation in California, it may be that Trump’s ability to win the rest of the nation is even higher. At tis rate, with the election more than ten months off, Trump might be able to win the election by acclamation! I am not truly sanguine about this take, but it is one way to look at the situation.

WASHINGTON, DC – Jack Smith’s appointment as special counsel is unconstitutional and so the Supreme Court must reject his petition against Donald Trump, lawyers representing former Attorney General Ed Meese and two top constitutional scholars in the country argued in a brief filed on Wednesday.
Their amicus (or “friend of the court”) brief argues that Smith lacks authority to represent the United States by asking the Supreme Court to weigh in (called a petition for certiorari) because the office he holds has not been created by Congress and his appointment violates the “Appointments Clause” of the Constitution.
The filing essentially claims U.S. Attorney General Merrick Garland improperly appointed Smith to an office that does not exist with authority Garland does not possess.
Meese, Steven Calabresi, the co-chairman of the Federalist Society, and Gary Lawson, a prominent constitutional law professor, first argue that only Congress can create federal offices such as Smith currently holds, which Congress has not done.

While the Constitution creates the offices of President and Vice President, Congress has the sole authority to create additional offices, because the Constitution says those offices must be “established by Law.” Congress previously passed a law to authorize a similar position called an “independent counsel,” but that statute expired in 1999.
Garland cannot hire a mere employee to perform tasks that Congress has not authorized, the attorneys write. Only an “officer” can hold such a significant level of authority. In creating the Department of Justice, Congress gave it certain powers by law, yet it authorized no office with all the powers of a U.S. Attorney that Garland has given Smith.
The amicus brief further argues, “Even if one somehow thinks that existing statutes authorize appointment of stand-alone special counsels with the full power of a U.S. Attorney, Smith was not properly appointed to such an ‘office.’” They assert even if special counsels were authorized by Congress, anyone in possession of such powers would require presidential nomination and Senate confirmation.
Moreover, the brief argued that Smith has so much power, just like a U.S. Attorney, he is a “principal officer” under the Constitution’s Appointments Clause, which means he must first be nominated by the president and then confirmed by a majority of the U.S. Senate.
“Improperly appointed, he has no more authority to represent the United States in this Court than Bryce Harper, Taylor Swift, or Jeff Bezos,” they write.
