Sometime 5-6 years ago, in the midst of the Mueller insanity, Sundance once attempted to take an official break – and then of course something insane happened in the news, and Sundance returned immediately. I don’t think there has been a noticeable break since. I work 7 days a week very often, and I guess it feels like that these days… 🙁

Was just now talking to a guy on another site who I think is an attorney. According to him this looks tough because of an absurd NY statute. Here is what he said:
You’re absolutely right, there’s no victim. No victim, no damages, which is why even if the statute was violated, the penalty should be a nominal $1. That’s where you’re going to have a real argument I think.
Here’s the statute at issue (Executive Law 63(12)):
“Whenever any person shall engage in repeated fraudulent or illegal acts or otherwise demonstrate persistent fraud or illegality in the carrying on, conducting or transaction of business, the attorney general may apply, in the name of the people of the state of New York, to the supreme court of the state of New York, on notice of five days, for an order enjoining the continuance of such business activity or of any fraudulent or illegal acts, directing restitution and damages and, in an appropriate case, cancelling any certificate…and the court may award the relief applied for or so much thereof as it may deem proper.
The word ‘fraud’ or ‘fraudulent’ as used herein shall include any… misrepresentation…”
Rightly or wrongly, the judge has already held that relying on the accountants’ disclaimer is no defense, and that ruling was upheld by the appeals court already.
The biggest problem in this case (though they are problems) isn’t the judge or even the attorney general, it is that the ludicrous statute upon which they are relying makes any series of mis-statements fraud; without regard to usual aspects of fraud such as knowledge of falsity or reliance by another.
Notice lack of intent, reliance, or even the existence of a victim from the ridiculous definition of “fraud” in this statute.
I don’t think it would be overturned by the First Department appellate court, since they’ve already ruled in the state’s favor. It COULD be overturned if it got to the Court of Appeals, but hanging your hat on that is a long shot. The NY COA takes even fewer cases than the SCOTUS.

Re: NY case. Trump has already been convicted of fraud. The judge attempted to dismantle the Trump Corp based on that ruling. Trump appealed and the appelate court … suspended the judge’s punishment (dismantling of the Trump Corp) pending the verdict in the trial… that we realize will also be a guilty verdict.
Hopefully… the appelate court will continue to suspend the destruction/dismantaling of the Trump Corp pending a ruling by the Appelate court too… recalling that Arthur Anderson was destroyed following the District court’s ruling and never recovered even after they were exonerated on Appeal.
Confusion abounds. Even if this all plays out to the wrongful persecution of President Trump, are they able to take everything from him or just in New York? Sorry NYers but there is life outside the state. President Trump is not a man without means beyond of those borders.

We must also do our best to preserve our lives, our faith, our families and our country.
And, the truth is that… it is not known to us whether God intends to save America. We have certainly digressed into hedonism, atheism and paganism at alarming levels.
I pray that God will be merciful to us… even though we do not deserve it. Reality is that America doesn’t deserve to be saved. We deserve to be punished by God. If we are humble and honest, we can see that. So, yah, weak me is afraid of our future… and that maybe God isn’t going to save us… this time. Americans — all of the West- is weak: morally, physically, mentally.
So I pray for God’s mercy abd justice, recognizing that His justice often doesn’t come in the form we want and pray for. Millions were slaughtered and tortured just in WWII. Victory did eventually come … but there was tremendous suffering until that victory was realized. We have not suffered much at all in the USA… if we are honest about it. That may change.

I can understand the purpose of the law to dissuade shady businesses from luring an unsuspecting customer. I doubt that the law is trying to protect businesses from their customers. Seems like the case doesn’t fit the intent of the law.

When a piece of real estate is sold on the free market in an arm’s length transaction, then you have data, a fact, about the value of the real estate that could be misrepresented. But . . . In the absence of a sale, statements about the value of real estate cannot be misrepresentations because they’re only opinions. So, in this case, there were no “misrepresentations” to be fraudulent, and this statue does not apply.
And, of course, that’s before you get to the fact that no one, no bank, no government, no nobody relied on the Trump organization’s opinions about the value it’s real property. They all did their own due diligence as they were required to do by their own bylaws, and their own lawyers. And after doing your own due diligence, they made loans which were paid back, and no one lost any money.
Yes… but this corrupt NY judge has already ruled that Trump committed fraud. And this judge will rule against Trump in the remainder of this case too. We know that.
Then, punishment and penalties will be applied… that can destroy the Trump Corp similar to the destruction of Arthur Anderson which was destroyed even though later they won on appeal. They still never recovered.
And, even though Trump will immediately appeal, the appellate court structure is likely heavily leftist anti-Trump too.
However, it appears that Leticia has misapplied the law in this case against Trump. That misapplication becomes precedent setting IF permitted to stand. It WILL be used in the future to attack existing and future R/MAGA political opponents too… so hopefully the Appelate court will rule justly and wisely. Not holding my breath.

The statute, as written is vague as it implies this is an avenue the AG MAY persue, after a business has been convicted of multiple fraudulent acts, but it doesn’t explicitly SAY that.
It is similar to Article 14, Sect 3 where it doesn’t actually require a conviction for insurection.
So many legitimate grounds for appeal, this case can go well beyond 2024, before any final resolution.
Wonder what the case authority is re: this law. Have any other businesses been charged in a similar manner as 45 or is it after multiple fraudulent acts where there are victims? 45 will have to take this up the chain if NY is going to just target him repeatedly. What’s that statute on all of this? This loan must be years if not decades ago!

the bigger fight will be whether trump can get an immediate stay on the judge ruling that a trustee or receiver is brought in once he loses this round.
Read long ago that there are so many and so poorly-worded “laws,” that in the course of daily life, we’re probably breaking “thousands” of silly laws perfectly innocently. There was a movement to attempt to sunset such statutes, you can guess how that went.
So they used to say “ignorance of the law is no excuse” but no regular citizen can be expected to know tens of thousands of bogus laws on the books – normal moral behavior like assault, murder, theft, sure everyone ought to know by instinct these actions are wrong.
But all this “regulatory” background noise is not fair or just, but simply a tool of oppression. They can pick & choose whom to prosecute and this selective “persecution” becomes a weaponized tool, as is obvious in all the Trump cases.

The statute is untested; the trial/mistrial is in NY; the appeals court process sounds unfavorable; the judge is corrupt including down the line to the clerk… these leftists hate Trump and will use lawfare to thwart his candidacy. Looking at something objectively means you have truthful verifiable information to work with. I look for verifiable information in what Sundance posts and I have neither the time nor the will to verify everything posted by commenters. That doesn’t mean I don’t find some of it very interesting and if it turns out to be true then kudos to the commenter. After all Sundance does compliment commenters on CTH for their knowledge and remarks.

Many times, when I see doomsday comments I think they are probably trying to discourage and influence others to give up, so I take their comments with a grain of salt. Many of these kind of commenters also make a big show, in their comments, of how much they support Trump. It costs me nothing to ignore them.
