Everything about the case in New York City against the Trump organization business operations is ridiculous. There are no victims. There was no fraud. All of the lenders did their own due diligence. All of the loans were paid back without issue and the statement of financial condition was factual and accurate.
Additionally, the statute being used as the predicate for the case is a consumer fraud statute, intended to protect borrowers from predatory lenders. In the four corners of this case, Trump was the borrower, and the banks were the lenders. New York is flipping the statute to claim the borrower defrauded the lenders, despite the lenders denying there was any fraud and there was no harm. The entire case is ridiculous.

I understand I am no legal mind, but it might be interesting to see how the court would respond if President Trump just got up and walked out. I do know when you step into a court room you give up all of your constitutional rights to the judge.
But in a case where the judge and prosecutors are so clearly outside the law as in this prosecution, it may behoove the victim of the court to re-exert his rights.
Perhaps the judge would have him arrested. In which case perhaps a higher court would need to step in and stop the offending court in its tracks. I say better to do it now and get it over with then wait until they attempt the same during the meat of the campaign season.
Retired Magistrate here: No, President Trump does not want to get up and walk out. President Trump’s attorneys are making a record to take it up on appeal; no Defendant, no further record. More importantly, this is a “dog and pony” show; optics are everything. If President Trump were to walk out, the media would have a field day. I understand they already are, but that would just make it worse; as in, see, Trump has something to hide so he just walked out; he is quitting because he knows he can’t win.

Retired Magistrate here: Usually judges have immunity from lawsuits. However, in a case as blatant as this one which should have been dismissed already and where the judge is ignoring the ruling by the Court of Appeals, I would think that President Trump and the Trump family could sue the Judge and the Attorney General for malicious prosecution.
However, remember this is New York so I am not sure the case would go anywhere.
The proper, lawful recourse would be impeachment by the New York State legislators. A political remedy for a political offense.

Assuming Trump wins the presidency, I wonder how much damage the state government of New York will suffer as I am sure they will be denied any advantages, contracts, or political activities to come their way. I already believe that any businesses who can get out of the state will be fleeing ahead of getting entrapped in a similar case.

Retired Magistrate here: Of there is recourse; disbarment of the DA and removal of the judge. However, it is New York City vs. President Trump so no one is going to go down that road.
It is not the way it should be; however, it is the way it is in New York City and surrounding areas. I am sure President Trump is not surprised; he had to deal with all kinds of corruption as a businessman and builder in New York City. Does that make it right, of course not, but it is reality.
As a retired attorney/magistrate I deal with the way things are and not the way we would like things to be. The only way our legal system works is if we have moral individuals as judges, prosecuting attorneys and defense attorneys. There are a few good ones but even those are keeping their heads down because Lawfare has been successful in intimidation practices in filing grievances against attorneys that have represented President Trump. After going through law school, passing the bar exam and establishing a good practice, most attorneys do not want to lose their livelihood.

I spent nearly 30 years in law enforcement in the state of New York.
In my experience, it’s not uncommon for a clerk to speak to a judge during a trial.
Usually, the judge initiated the conversation, but not always.
It’s more common in lower criminal and administrative courts than at the superior level.
The last civil trial I testified in, the judge and I engaged in a lengthy personal conversation about a mutual acquaintance, during a break in the trial.
It all depends on the judge.
Some are tyrants and some are benevolent rulers of their courtrooms.
I might add, it pays to be nice to the clerk.
I knew all the clerks in the courts in my area and endeavored to stay in their good graces.
My personal attorney knows the names of EVERYONE who works at the courthouse, from judges to janitors, and the names of all their family members.

I was a court reporter for over 30 years, the last 20 years spent in federal court, worked with many judges. I never saw a law clerk sit up at the bench alongside the judge. The courtroom deputy clerk, law clerk, and court reporter sat on ground level right below the judge. We each had a court computer and we communicated with each other via the court’s instant messaging program. No need to pass notes. The law clerk would assist the judge when issues arose, even act as a liaison at times between attorneys and judge, but it was always understood who was the final authority in the courtroom. This Trump trial seems very odd.
That’s pretty much my experience.

Town and village courts varied as to courtroom design and weren’t always as formal as superior courts, such as city, county, and supreme courts.
In such cases, I’ve seen the clerk sit in closer proximity to the judge/justice, but very rarely.
Some of the JPs had their wives or daughters working as clerks and the working relationship appeared a bit more relaxed.
Retired Magistrate here: Yes, it really does depend on the Judge. That is why it is so important to get local counsel to represent you in a case. Local counsel knows the Judge, how he/she operates the courtroom, is familiar with local rules and is familiar with how other local counsel operates.

Judith my town has been dealing with a “mixed use” development project entailing high density residential housing, light commercial space, and retail space for the past 15 years. The bait and switch (to 100% residential) was recently attempted by the developer under contract but the Town shot that down immediately. The property involves legitimately historic large multi story institutional buildings that were once state property but that were given to the town in order to develop while maintaining the historic character and appearance of the original buildings.
The developer is now balking at performing the required improvements to the historic buildings and wanted to go full residential – their lowest cost type of construction. It’s been a battle for years since we don’t want the amount of traffic that a full high density residential neighborhood would bring, not to mention our schools are already at or over capacity.
